An FCRA compliant background check involves standalone disclosures and written permission, and follows a strict adverse action process if negative results occur.<\/p>\n\n    <\/div>\n\n\n\n<p>Employers have an interest in performing <span data-term-id=\"58064062\">background checks<\/span> and looking into <span data-term-id=\"58064068\">criminal history<\/span> of <span data-term-id=\"58064110\">job applicants<\/span> for <span data-term-id=\"58064075\">employment purposes<\/span>.<\/p>\n<p>Employers who use outside <span data-term-id=\"58064080\">employment screening<\/span> agencies to conduct criminal <span data-term-id=\"58064062\">background checks<\/span> must follow the <a href=\"https:\/\/codes.findlaw.com\/us\/title-15-commerce-and-trade\/15-usc-sect-1681\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58064061\">Fair Credit Reporting Act<\/span> (<span data-term-id=\"58064063\">FCRA<\/span>)<\/a> guidelines. The <span data-term-id=\"58064063\">FCRA<\/span> is a <span data-term-id=\"58064087\">federal law<\/span> governing the collection, accuracy, and privacy of consumer information held by credit reporting agencies. Failure to follow <span data-term-id=\"58064074\">FCRA<\/span><span data-term-id=\"58064074\"> requirements<\/span> can lead to penalties such as fines and <span data-term-id=\"58064112\">class action<\/span> lawsuits.<\/p>\n<p>There are also <span data-term-id=\"58064078\">state laws<\/span> and federal guidelines for conducting <span data-term-id=\"58064081\">employment <\/span><span data-term-id=\"58064062\">background checks<\/span>.<\/p>\n<p>Many states with <a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/ban-the-box-laws-by-state.html\">\u201c<span data-term-id=\"58064119\">Ban the Box<\/span>\u201d or Fair Chance laws<\/a> prohibit employers from asking about <span data-term-id=\"58064077\">criminal records<\/span> or convictions during the <span data-term-id=\"58064073\">hiring process<\/span> or before conditional offer of employment. Be sure to check with your state and local jurisdiction to understand when you can ask about <span data-term-id=\"58064068\">criminal history<\/span>.<\/p>\n<p>Even if your state doesn\u2019t have a <span data-term-id=\"58064119\">Ban the Box<\/span> law, the U.S. Equal Employment Opportunity Commission (<span data-term-id=\"58064102\">EEOC<\/span>) guidance encourages employers to postpone questions about <span data-term-id=\"58064068\">criminal history<\/span> until after making a conditional job offer. Employers should also consider whether any criminal conviction is job-related.<\/p>\n<h2><span data-term-id=\"58064066\">FCRA<\/span><span data-term-id=\"58064066\"> Compliance<\/span> Checklist for <span data-term-id=\"58064062\">Background Checks<\/span><\/h2>\n<p>When performing <span data-term-id=\"58064062\">background checks<\/span> in your <span data-term-id=\"58064088\">screening process<\/span>, you should know about timing, <span data-term-id=\"58064082\">disclosure requirements<\/span>, obtaining <span data-term-id=\"58064079\">written consent<\/span>, and what to do if there is a negative result. See below for an example.<\/p>\n<p>__ Conduct <span data-term-id=\"58064062\">background check<\/span> and review <span data-term-id=\"58064101\">background check<\/span><span data-term-id=\"58064101\"> report<\/span><\/p>\n<p>__ If no concerning information, proceed to <span data-term-id=\"58064071\">hiring decision<\/span><\/p>\n<p>__ If concerning information that results in a rejection, go to <span data-term-id=\"58064091\">Adverse Action Process<\/span><\/p>\n<h2><span data-term-id=\"58064091\">Adverse Action Process<\/span><\/h2>\n<p>If there is a negative result, hold off on any <span data-term-id=\"58064097\">employment decision<\/span> until you have performed the <span data-term-id=\"58064091\">adverse action process<\/span>. This gives an applicant or employee the opportunity to clarify or correct a negative result.<\/p>\n<p>__ Send <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/pre-adverse-vs-adverse-action-notices-timing-content-and-templates.html\"><strong>Pre-Adverse Action Notice<\/strong><\/a> along with the name and contact information of the reporting company and a <span data-term-id=\"58064093\">copy of the report<\/span><\/p>\n<p>__ Allow waiting period for applicant or employee to respond to <span data-term-id=\"58064090\">background check<\/span><span data-term-id=\"58064090\"> results<\/span> and clear up any <span data-term-id=\"58064085\">inaccuracies<\/span> with reporting agency<\/p>\n<p>__ After waiting period, based on response, make <span data-term-id=\"58064071\">hiring decision<\/span><\/p>\n<p>__ If not hiring or promoting the applicant or employee, send a final <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/pre-adverse-vs-adverse-action-notices-timing-content-and-templates.html\"><strong>Adverse Action Notice<\/strong><\/a>\u00a0<\/p>\n<p>Typically, the waiting period is five <span data-term-id=\"58064108\">business days<\/span>, but your state or local jurisdiction may have a set number of <span data-term-id=\"58064108\">business days<\/span>.<\/p>\n<p>As an employer or hiring manager, you want to make sure your processes are meeting <span data-term-id=\"58064111\">compliance requirements<\/span> with federal, state, and <span data-term-id=\"58064086\">local laws<\/span>. You may consider having an <a href=\"https:\/\/lawyers.findlaw.com\/\" target=\"_blank\" rel=\"noopener\">employment attorney<\/a> review your process, and review or draft disclosures, authorizations, and adverse action notices.<\/p>\n<h2><strong>Record Retention Requirement Under <span data-term-id=\"58064063\">FCRA<\/span><\/strong><\/h2>\n<p>The <span data-term-id=\"58064063\">FCRA<\/span> does not have a specific period for record retention but the <span data-term-id=\"58064102\">EEOC<\/span> requires employers to retain the records for at least one year from the record date or the date the employment action was taken, whichever is later. It is recommended as a best practice for employers to keep records for up to five years due to the statute of limitations for <span data-term-id=\"58064063\">FCRA<\/span> claims. However, check your <span data-term-id=\"58064078\">state laws<\/span> as they may require longer retention periods.<\/p>\n<h2>Examples of Disclosure Notice and Authorization Form<\/h2>\n<p><strong>(<span data-term-id=\"58064084\">Standalone Document<\/span> &#8211; <span data-term-id=\"58064076\">Disclosure Form<\/span>)<\/strong><\/p>\n<p><strong>DISCLOSURE FOR BACKGROUND INVESTIGATION <\/strong><\/p>\n<p>[Name of Company] (\u201cCompany\u201d) may use a <span data-term-id=\"58064065\">background screening<\/span> company to obtain a <span data-term-id=\"58064064\">consumer report<\/span> (\u201c<span data-term-id=\"58064070\">background report<\/span>\u201d) on you for purposes of employment.
