To promote <span data-term-id=\"58041701\">fair hiring practices<\/span> and avoid lawsuits, there are a few laws <span data-term-id=\"58041683\">hiring managers<\/span> should know:<\/p>\n<h3>Ban the Box and <span data-term-id=\"58041716\">Fair Chance Act<\/span> Hiring Laws<\/h3>\n<p>Many states and cities have passed \u201c<a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/ban-the-box-laws-by-state.html\">Ban the Box<\/a>\u201d or \u201cFair Chance\u201d laws. These laws are designed to eliminate bias against those with prior <span data-term-id=\"58041685\">criminal convictions<\/span>. <span data-term-id=\"58041655\">Ban the Box laws<\/span> remove the <span data-term-id=\"58041693\">checkbox<\/span> on <span data-term-id=\"58041651\">job applications<\/span> that asks whether the applicant has ever been convicted of a crime.<\/p>\n<p>Fair Chance in Hiring Laws go a step further. They usually prevent an employer from asking <span data-term-id=\"58041684\">criminal history<\/span><span data-term-id=\"58041684\"> questions<\/span> until after an interview or a <span data-term-id=\"58041665\">conditional offer of employment<\/span>. The <span data-term-id=\"58041692\">application forms<\/span> would not ask for <span data-term-id=\"58041686\">criminal history<\/span><span data-term-id=\"58041686\"> information<\/span>. These laws apply to <span data-term-id=\"58041653\">private employers<\/span>.<\/p>\n<p>The <a href=\"https:\/\/oig.hhs.gov\/careers\/the-fair-chance-to-compete-for-jobs-act\/\" target=\"_blank\" rel=\"noopener\">Fair Chance to Compete for Jobs Act<\/a> is a <span data-term-id=\"58041670\">federal law<\/span> that prohibits <span data-term-id=\"58041694\">federal agencies<\/span> from requesting <span data-term-id=\"58041649\">criminal history<\/span> or <span data-term-id=\"58041679\">conviction records<\/span> from <span data-term-id=\"58041651\">job applicants<\/span> before an offer of employment.<\/p>\n<p>Currently, the states with either <span data-term-id=\"58041715\">Ban the Box policies<\/span> or Fair Chance laws are <span data-term-id=\"58041659\">California<\/span>, <span data-term-id=\"58041704\">Colorado<\/span>, <span data-term-id=\"58041680\">Connecticut<\/span>, the <span data-term-id=\"58041714\">District of Columbia<\/span>, <span data-term-id=\"58041676\">Hawaii<\/span>, <span data-term-id=\"58041691\">Illinois<\/span>, Maine, <span data-term-id=\"58041677\">Maryland<\/span>, <span data-term-id=\"58041698\">Massachusetts<\/span>, <span data-term-id=\"58041687\">Minnesota<\/span>, <span data-term-id=\"58041690\">New Jersey<\/span>, <span data-term-id=\"58041689\">New Mexico<\/span>, Oregon, <span data-term-id=\"58041709\">Rhode Island<\/span>, Vermont, and Washington.<\/p>\n<p>The laws vary by state but typically only allow questions about an <span data-term-id=\"58041669\">applicant\u2019s <\/span><span data-term-id=\"58041649\">criminal history<\/span> after a <span data-term-id=\"58041667\">conditional job offer<\/span>. So timing is critical in these states.<\/p>\n<h3>Equal Employment Opportunity Commission (<span data-term-id=\"58041657\">EEOC<\/span>) Guidance<\/h3>\n<p>Even if your state and <span data-term-id=\"58041663\">jurisdiction<\/span> does not have these laws, the <span data-term-id=\"58041696\">U.S. Equal Employment Opportunity Commission<\/span> (<span data-term-id=\"58041657\">EEOC<\/span>) advises employers to avoid discrimination when making <span data-term-id=\"58041666\">employment decisions<\/span>. The <a href=\"https:\/\/www.eeoc.gov\/laws\/guidance\/enforcement-guidance-consideration-arrest-and-conviction-records-employment-decisions\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58041695\">EEOC<\/span><span data-term-id=\"58041695\">\u2019s guidance<\/span><\/a> encourages employers to delay <span data-term-id=\"58041671\">criminal history<\/span><span data-term-id=\"58041671\"> inquiries<\/span> until after making a <span data-term-id=\"58041667\">conditional job offer<\/span> and to consider if the <span data-term-id=\"58041685\">criminal conviction<\/span> is <span data-term-id=\"58041668\">job-related<\/span>.<\/p>\n<h3><span data-term-id=\"58041682\">Fair Credit Reporting Act<\/span> (<span data-term-id=\"58041674\">FCRA<\/span>)<\/h3>\n<p>The federal <a href=\"https:\/\/corporate.findlaw.com\/business-operations\/fair-credit-reporting-act.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58041682\">Fair Credit Reporting Act<\/span> (<span data-term-id=\"58041674\">FCRA<\/span>)<\/a> requires employers who use third-party companies to run <span data-term-id=\"58041650\">background checks<\/span> to notify the applicant and get their written consent before doing it.<\/p>\n<h2>Creating a Legally Compliant Application<\/h2>\n<p>First, check your <span data-term-id=\"58041658\">state laws<\/span> and local <span data-term-id=\"58041663\">jurisdictions<\/span> to determine if there are Ban the Box or Fair Chance laws. Then review your <span data-term-id=\"58041678\">initial <\/span><span data-term-id=\"58041651\">job application<\/span> and remove any references to <span data-term-id=\"58041654\">criminal records<\/span>.<\/p>\n<h3>Prohibited Application Questions<\/h3>\n<p>Any questions about <span data-term-id=\"58041649\">criminal history<\/span> such as, \u201cin the past 7 years, have you been arrested, charged, or convicted\u2026\u201d may get you in trouble. Remove these questions from your application:<\/p>\n<ul>\n<li>\n<p><em>Have you ever been convicted of a felony or misdemeanor?<\/em><\/p>\n<\/li>\n<li>\n<p><em>Have you ever been arrested or charged with a crime?<\/em><\/p>\n<\/li>\n<\/ul>\n<h3>Permitted Application Questions<\/h3>\n<p>There are permissible questions you may add to your <span data-term-id=\"58041660\">employment application<\/span> such as:<\/p>\n<ul>\n<li>\n<p><em>Are you legally authorized to work in the United States?<\/em><\/p>\n<\/li>\n<li>\n<p><em>Do you hold the required certifications or licensing for this role? <\/em><\/p>\n<\/li>\n<\/ul>\n<p>You may include a statement on the application such as \u201cApplicants will be subject to a <span data-term-id=\"58041650\">background check<\/span> only after a <span data-term-id=\"58041665\">conditional offer of employment<\/span> is made in accordance with state and <span data-term-id=\"58041664\">local laws<\/span>.\u201d<\/p>\n<p>You can look at a sample of a <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/ban-the-box-compliant-job-application-template.html\">Ban the Box Compliant <span data-term-id=\"58041651\">Job Application<\/span> <span data-term-id=\"58041721\">Template<\/span><\/a> and adapt for your purposes<\/p>\n<h3>Disclosure and Authorization for <span data-term-id=\"58041650\">Background Checks<\/span><\/h3>\n<p>Second, if you are conducting <span data-term-id=\"58041650\">background checks<\/span>, give the applicant a stand-alone document, called a <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/pre-adverse-vs-adverse-action-notices-timing-content-and-templates.html\">Disclosure For Background Investigation<\/a> <strong>\u00a0<\/strong>to alert them you may use a <span data-term-id=\"58041706\">background screening<\/span> company for employment purposes. Include the name of the Consumer Reporting Agency (CRA) and a summary of the rights under the <span data-term-id=\"58041682\">Fair Credit Reporting Act<\/span>. The applicant must then sign an authorization (that you provide) acknowledging they received the Disclosure For Background Investigation and they authorize the <span data-term-id=\"58041650\">background check<\/span>.<\/p>\n<h2>What If a <span data-term-id=\"58041650\">Background Check<\/span> Shows an Adverse Result?<\/h2>\n<p>If the <span data-term-id=\"58041706\">background screening<\/span> process shows an adverse result, you must send a <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/pre-adverse-vs-adverse-action-notices-timing-content-and-templates.html\">Pre-<span data-term-id=\"58041672\">Adverse Action Notice<\/span><\/a>\u00a0to the applicant informing them that a decision may adversely affect their application for employment based on information in a consumer background report. You must provide the name and contact information of the Consumer Reporting Agency (CRA) and include a copy of the <span data-term-id=\"58041650\">background check<\/span> report and a copy of the \u201cSummary of Your Rights Under the <span data-term-id=\"58041682\">Fair Credit Reporting Act<\/span>.\u201d<\/p>\n<p>The applicant has a time period (commonly five <span data-term-id=\"58041713\">business days<\/span>) to correct or clarify the information. For example, a <span data-term-id=\"58041654\">criminal record<\/span> might have been <span data-term-id=\"58041712\">expunged<\/span> but still shows up. If the applicant does not correct the information after the <span data-term-id=\"58041710\">waiting period<\/span>, the employer must send a final <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/pre-adverse-vs-adverse-action-notices-timing-content-and-templates.html\"><span data-term-id=\"58041672\">Adverse Action Notice<\/span><\/a>\u00a0to the applicant.<\/p>\n<p>Generally the <span data-term-id=\"58041711\">application process<\/span> sequence should be as follows:<\/p>\n<p>(1) Present <span data-term-id=\"58041667\">conditional job offer<\/span> to applicant<\/p>\n<p>(2) Get applicant consent for <span data-term-id=\"58041650\">background check<\/span><\/p>\n<p>(3) Perform <span data-term-id=\"58041650\">background check<\/span><\/p>\n<p>(4) If there is an adverse result, send Pre-<span data-term-id=\"58041672\">Adverse Action notice<\/span><\/p>\n<p>(5) After <span data-term-id=\"58041710\">waiting period<\/span>, send <span data-term-id=\"58041672\">Adverse Action Notice<\/span><\/p>\n<p>Penalties for Ban the Box or <span data-term-id=\"58041662\">Fair Chance hiring<\/span> violations vary by <span data-term-id=\"58041663\">jurisdiction<\/span>.
