Changes to the I-9 verification process add \u201calternative procedures\u201d that allow employers to use live video systems to check physical documents.<\/p>\n\n    <\/div>\n\n\n\n<p>As part of a hiring or <span data-term-id=\"58091387\">onboarding<\/span> process, employers must verify their <span data-term-id=\"58091403\">new hires<\/span>\u2019 identity and right to work in the United States. This is typically done <span data-term-id=\"58091410\">onsite<\/span> during the employee\u2019s <span data-term-id=\"58091406\">first day of employment<\/span>. However, with the rise of <span data-term-id=\"58091362\">remote employees<\/span>, there is an <span data-term-id=\"58091349\">alternative procedure<\/span> to handle <span data-term-id=\"58091357\">employment eligibility verification<\/span>.<\/p>\n<h2><span data-term-id=\"58091410\">Onsite<\/span> I-9 <span data-term-id=\"58091364\">Verification Process<\/span><\/h2>\n<p>The traditional <span data-term-id=\"58091364\">verification process<\/span> is <span data-term-id=\"58091353\">in-person<\/span> and is handled as follows:<\/p>\n<ol>\n<li>\n<p>The <span data-term-id=\"58091403\">new hire<\/span> completes an I-9 form on their <span data-term-id=\"58091409\">first day of work<\/span>. They must enter their name, address, and date of birth, and confirm that they are allowed to work in the U.S.<\/p>\n<\/li>\n<li>\n<p>The <span data-term-id=\"58091403\">new hire<\/span> must show <span data-term-id=\"58091359\">employment authorization documents<\/span> such as a passport, driver\u2019s license plus a Social Security card, or other identification on a <span data-term-id=\"58091380\">List A<\/span>, B, or C of <a href=\"https:\/\/www.uscis.gov\/i-9-central\/form-i-9-acceptable-documents\" target=\"_blank\" rel=\"noopener\">acceptable documents<\/a> provided by the <span data-term-id=\"58091371\">U.S. Citizenship and Immigration Services<\/span> (<span data-term-id=\"58091352\">USCIS<\/span>) within <span data-term-id=\"58091374\">three business days<\/span>.<\/p>\n<\/li>\n<li>\n<p>The employer then conducts a <span data-term-id=\"58091396\">physical examination<\/span> of the documents and completes the form. They keep the forms and <span data-term-id=\"58091386\">copies of the documents<\/span> on file in the event of a government audit.<\/p>\n<\/li>\n<\/ol>\n<p>The U.S. <span data-term-id=\"58091358\">Department of Homeland Security<\/span> (<span data-term-id=\"58091355\">DHS<\/span>) and the Social Security Administration (SSA) have an <a href=\"http:\/\/e-verify\/\"><span data-term-id=\"58091348\">E-Verify<\/span> system<\/a> as a way for an employer to perform the I-9 verification online. Employers enrolled in <span data-term-id=\"58091348\">E-Verify<\/span> and in <span data-term-id=\"58091356\">good standing<\/span> may use the <span data-term-id=\"58091348\">E-Verify<\/span> system. If you have a large company, all <span data-term-id=\"58091377\">hiring sites<\/span> should <span data-term-id=\"58091397\">enroll<\/span> in the <span data-term-id=\"58091348\">E-Verify<\/span> system.<\/p>\n<h2><span data-term-id=\"58091399\">Remote I-9 <\/span><span data-term-id=\"58091364\">Verification<\/span><span data-term-id=\"58091364\"> Process<\/span><\/h2>\n<p>During the <span data-term-id=\"58091373\">pandemic<\/span>, there were <span data-term-id=\"58091376\">COVID-19 flexibilities<\/span> to process <span data-term-id=\"58091363\">form <\/span><span data-term-id=\"58091351\">I-9<\/span><span data-term-id=\"58091363\"> documents<\/span> and conduct <span data-term-id=\"58091354\">remote verifications<\/span>. These changes were then added to the <span data-term-id=\"58091347\">Form I-9<\/span> published in August 2023. On this updated form, there is a checkbox to use an \u201c<span data-term-id=\"58091349\">alternative procedure<\/span>,\u201d which allows an <span data-term-id=\"58091365\">authorized representative<\/span> of the company to conduct <span data-term-id=\"58091384\">live video interactions<\/span> with <span data-term-id=\"58091407\">remote hires<\/span>.<\/p>\n<p>The process for remote <span data-term-id=\"58091383\">I-9 compliance<\/span> is as follows:<\/p>\n<ol>\n<li>\n<p><span data-term-id=\"58091382\">Qualified employers<\/span> use the current <span data-term-id=\"58091347\">Form I-9<\/span> and check the box for \u201c<span data-term-id=\"58091349\">Alternative Procedure<\/span>\u201d<\/p>\n<\/li>\n<li>\n<p><span data-term-id=\"58091362\">Remote employees<\/span> <span data-term-id=\"58091366\">completing <\/span><span data-term-id=\"58091347\">Form I-9<\/span> can use electronic signatures<\/p>\n<\/li>\n<li>\n<p>Employers conduct a <span data-term-id=\"58091379\">remote examination<\/span> of the <span data-term-id=\"58091402\">eligibility documents<\/span> by live video.<\/p>\n<\/li>\n<\/ol>\n<p><span data-term-id=\"58091372\">E-Verify<\/span><span data-term-id=\"58091372\"> employers<\/span> must keep <span data-term-id=\"58091386\">copies of the documents<\/span> for future <span data-term-id=\"58091385\">document inspection<\/span> or I-9 audits.<\/p>\n<p><strong>Note:<\/strong> Employers should use the <span data-term-id=\"58091347\">Form I-9<\/span> version dated 1\/20\/2025.
