Examples of <span data-term-id=\"57645997\">election interference<\/span> include <span data-term-id=\"57646000\">voter suppression<\/span>, intimidation, fraud, and campaign finance violations. There are federal and state laws prohibiting <span data-term-id=\"57645997\">election interference<\/span>.<\/p>\n\n    <\/div>\n\n\n\n<p>Under the U.S. Constitution, states make their own <span data-term-id=\"57646002\">election laws<\/span>. State legislatures determine issues such as\u00a0<span data-term-id=\"57646003\">early voting<\/span>,\u00a0<span data-term-id=\"57646015\">mail-in ballots<\/span>, and ballot tabulation.<\/p>\n<p>The <span data-term-id=\"57646005\">federal government<\/span> also controls some aspects of national voting. <a href=\"https:\/\/constitution.findlaw.com\/article1.html\" target=\"_blank\" rel=\"noopener\">Article I, Section 4<\/a>, of the Constitution specifies that states shall prescribe their own time, place, and manner of choosing senators and representatives. The U.S. <span data-term-id=\"57646008\">Supreme Court<\/span> ruled that this extends to other state elections as well.<\/p>\n<p>The Constitution does not set an official <span data-term-id=\"57646007\">Election Day<\/span>. Congress has the power to select an official election date, which was set by law in 1845. Every administration has added new laws relating to <span data-term-id=\"57646004\">voting rights<\/span> and <span data-term-id=\"57645997\">election interference<\/span>.<\/p>\n<h2><strong><span data-term-id=\"57645997\">Election Interference<\/span> Explained<\/strong><\/h2>\n<p><span data-term-id=\"57645997\">Election interference<\/span> is any effort to change the outcome of an election, through lawful or unlawful means. Campaigning and electioneering are forms of <span data-term-id=\"57645997\">election interference<\/span>, though few people object to them. Unlawful <span data-term-id=\"57645997\">election interference<\/span> is any effort to violate voters\u2019 <span data-term-id=\"57646017\">civil rights<\/span> through <span data-term-id=\"57646000\">voter suppression<\/span>, <span data-term-id=\"57645998\">voter intimidation<\/span>, fraud, or other means.<\/p>\n<p>Other forms of electoral interference include campaign finance violations, media misconduct, and vote-buying. This article will review some recent changes to U.S. <span data-term-id=\"57645997\">election interference<\/span> laws and what they mean for the average voter.<\/p>\n<h2><strong><span data-term-id=\"57646016\">Federal <\/span><span data-term-id=\"57646002\">Election<\/span><span data-term-id=\"57646002\"> Laws<\/span><\/strong><\/h2>\n<p><span data-term-id=\"57646016\">Federal <\/span><span data-term-id=\"57646002\">election<\/span><span data-term-id=\"57646002\"> laws<\/span> provide controls for national presidential elections and serve as the basis for state <span data-term-id=\"57646002\">election laws<\/span>.<\/p>\n<p>The U.S. Code contains all <span data-term-id=\"57646016\">federal <\/span><span data-term-id=\"57646002\">election<\/span><span data-term-id=\"57646002\"> laws<\/span>. Existing <span data-term-id=\"57645997\">election interference<\/span> laws include:<\/p>\n<ul>\n<li><a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-242\/\" target=\"_blank\" rel=\"noopener\">18 U.S.C. 242<\/a>: Prohibits any government agent acting under color of authority from depriving any individual of their rights, including their right to vote<\/li>\n<li>18 U.S.C. 245: Prohibits force or threats<\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-598\/\" target=\"_blank\" rel=\"noopener\">18 U.S.C. 598<\/a>: Prohibits the use of federal funds to interfere with the right to vote<\/li>\n<li>52 U.S.C. 10307: Prohibiting fraud or coercion in registration or voting (part of the <span data-term-id=\"57646004\">Voting Rights<\/span> Act) and protecting <span data-term-id=\"57645999\">election officials<\/span> during vote tabulation and reporting<\/li>\n<\/ul>\n<p><span data-term-id=\"57646001\">Executive Order<\/span> 13848, signed in 2018, maintains sanctions against potential <span data-term-id=\"57646006\">foreign interference<\/span> by hostile nations. The effect of this order remains directed at other nations and does not affect internal elections.<\/p>\n<h3><strong>The <span data-term-id=\"57646016\">Federal Election<\/span> Campaign Act<\/strong><\/h3>\n<p>The\u00a0<a href=\"https:\/\/www.fec.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57646016\">Federal Election<\/span> Commission\u00a0(FEC)<\/a>\u00a0is a regulatory agency that enforces campaign finance laws. Federal law restricts how much donors may contribute to a candidate before and during an election, and how candidates can spend the money. One such law is the <a href=\"https:\/\/codes.findlaw.com\/us\/title-52-voting-and-elections\/52-usc-sect-30101.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57646016\">Federal Election<\/span> Campaign Act<\/a>\u00a0(FECA). This act limits the amount of money a candidate or their committee can receive, and requires disclosure to the FEC.<\/p>\n<p>Campaign finance violations under the FECA can include:<\/p>\n<ul>\n<li>Excess donations<\/li>\n<li>Money from prohibited sources (such as foreign donors)<\/li>\n<li>Using the funds for personal rather than campaign purposes<\/li>\n<\/ul>\n<p>Part of the FECA involves limiting <a href=\"https:\/\/www.findlaw.com\/voting\/how-do-i-protect-my-right-to-vote-\/foreign-interference-in-us-elections--laws.html\"><span data-term-id=\"57646006\">foreign interference<\/span><\/a> in U.S. elections through <a href=\"https:\/\/www.findlaw.com\/voting\/how-u-s-elections-work\/u-s-campaign-finance-laws.html\">contributions to candidates and Super PACs<\/a>. Foreign nations and investors are strictly limited in how much they can contribute, and candidates must disclose what they receive.<\/p>\n<h3><strong>Vote Buying<\/strong><\/h3>\n<p>Vote buying, which is paying individuals to vote for or against a candidate or initiative, is a violation of <a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-597\/\" target=\"_blank\" rel=\"noopener\">18 U.S.C. 597<\/a>. Vote buying is a tricky legal issue, as it requires the actual purchase of a voter\u2019s vote for money. Stunts such as <a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/oct\/15\/why-vote-buying-is-illegal\" target=\"_blank\" rel=\"noopener\">Elon Musk\u2019s offer<\/a> to pay a jackpot to registered voters who signed a petition during the 2024 Presidential election walk the line between legal and illegal. The closer the effort is to <span data-term-id=\"57646007\">Election Day<\/span> and the higher its dollar value, the more likely it is to be unlawful.<\/p>\n<h3><strong><span data-term-id=\"57646000\">Voter Suppression<\/span><\/strong><\/h3>\n<p>The <span data-term-id=\"57646004\">Voting Rights<\/span> Act of 1965 and subsequent amendments attempted to eliminate racially based <span data-term-id=\"57646000\">voter suppression<\/span> by eliminating poll taxes, literacy tests, and other barriers to voting then rampant in Southern and some Northern states. In 2013, the <span data-term-id=\"57646008\">Supreme Court<\/span> struck down Section 4 of the Act, which required states to obtain \u201cpreclearance\u201d from the <span data-term-id=\"57646005\">federal government<\/span> before changing their voting laws in <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/12-96.html\" target=\"_blank\" rel=\"noopener\"><em>Shelby County v. Holder<\/em><\/a>. A number of <a href=\"https:\/\/www.findlaw.com\/voting\/how-do-i-protect-my-right-to-vote\/voter-suppression-and-voter-id-laws.html\">state <span data-term-id=\"57646013\">voter ID<\/span> laws<\/a> followed in the aftermath of that ruling.<\/p>\n<h3><strong><span data-term-id=\"57645998\">Voter Intimidation<\/span><\/strong><\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/us\/title-18-crimes-and-criminal-procedure\/18-usc-sect-245\/\" target=\"_blank\" rel=\"noopener\">18 U.S.C. 245<\/a> forbids the use of \u201cforce or threat of force\u201d to prevent anyone from voting, registering, or acting as an <span data-term-id=\"57645999\">election official<\/span>. Like other types of <span data-term-id=\"57646000\">voter suppression<\/span>, <span data-term-id=\"57645998\">voter intimidation<\/span> is difficult to define on paper. For instance, the presence of firearms at a polling station could be interpreted as <span data-term-id=\"57645998\">voter intimidation<\/span>.<\/p>\n<p><a href=\"https:\/\/www.aclu.org\/sites\/default\/files\/field_pdf_file\/kyr-voterintimidation-v03.pdf\" target=\"_blank\" rel=\"noopener\">Other types of <span data-term-id=\"57645998\">voter intimidation<\/span><\/a> can include:<\/p>\n<ul>\n<li>Aggressive questioning of voters about their citizenship or other qualifications, especially at the polling stations<\/li>\n<li>Spreading false information about voting requirements<\/li>\n<li>Holding oneself out as an <span data-term-id=\"57645999\">election official<\/span> and demanding photo ID or other documentation to approach the polls<\/li>\n<\/ul>\n<p><span data-term-id=\"57645998\">Voter intimidation<\/span> attempts to scare legitimate voters away from the polls to sway the election.<\/p>\n<h2><strong>Electoral Fraud<\/strong><\/h2>\n<p>Voter fraud and electoral fraud are among the most hotly contested forms of <span data-term-id=\"57645997\">election interference<\/span> in the U.S. today. Despite claims from both sides, <a href=\"https:\/\/www.congress.gov\/116\/meeting\/house\/108824\/documents\/HHRG-116-JU00-20190129-SD020.pdf\" target=\"_blank\" rel=\"noopener\">the U.S. government<\/a> has tallied fewer than 1,200 cases of electoral fraud in the past 25 years. This is from billions of votes cast at all levels of voting, from city council offices to national elections.<\/p>\n<p><a href=\"https:\/\/codes.findlaw.com\/us\/title-52-voting-and-elections\/52-usc-sect-10307\/\" target=\"_blank\" rel=\"noopener\">52 U.S.C. 10307<\/a> makes all forms of election fraud illegal. Election fraud can include:<\/p>\n<ul>\n<li>Casting more than one ballot<\/li>\n<li>Registering under a false name<\/li>\n<li>Casting a ballot with fraudulent information.<\/li>\n<li>Altering or tampering with ballots after the voter has placed them in the ballot box<\/li>\n<\/ul>\n<p>Illegal votes are not counted, and the person responsible for them will face criminal charges.<\/p>\n<h2><strong>Reporting Violations<\/strong><\/h2>\n<p><span data-term-id=\"57645997\">Election interference<\/span> is a state and federal offense. Both the <a href=\"https:\/\/www.usa.gov\/voter-fraud\" target=\"_blank\" rel=\"noopener\">U.S. government<\/a> and state <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/incorporation-and-legal-structures\/state-guide-corporations-offices.html\">Secretary of State offices<\/a> have links where voters can report suspected violations of voters\u2019 rights.<\/p>\n<p>If you see violations on <span data-term-id=\"57646007\">Election Day<\/span>, such as unlawful electioneering or <span data-term-id=\"57645998\">voter intimidation<\/span> at the polls, report them to the <span data-term-id=\"57645999\">election officials<\/span> overseeing that polling station.
