This is one example of how the <span data-term-id=\"57234581\">California<\/span> <span data-term-id=\"57234560\">WARN Act<\/span> may cover an employer that the <span data-term-id=\"57234568\">federal <\/span><span data-term-id=\"57234560\">WARN Act<\/span> does not.<\/p>\n<h2>Events That Trigger the <span data-term-id=\"57234581\">California<\/span> <span data-term-id=\"57234560\">WARN Act<\/span><\/h2>\n<p>Under <span data-term-id=\"57234600\">California<\/span><span data-term-id=\"57234600\"> law<\/span>, three types of employment events trigger the <span data-term-id=\"57234596\">WARN Act<\/span> <span data-term-id=\"57234562\">notice<\/span><span data-term-id=\"57234562\"> requirements<\/span>. These three terms are defined in<a href=\"https:\/\/codes.findlaw.com\/ca\/labor-code\/lab-sect-1400-5\/\" target=\"_new\" rel=\"noopener\"><u> <\/u><u><span data-term-id=\"57234561\">California<\/span> <span data-term-id=\"57234587\">Labor Code Section<\/span> 1400.5<\/u><\/a>\u200b.<\/p>\n<ol>\n<li>\n<p><strong><span data-term-id=\"57234559\">Mass layoffs<\/span>:<\/strong> <span data-term-id=\"57234600\">California<\/span><span data-term-id=\"57234600\"> law<\/span> defines a <span data-term-id=\"57234559\">mass layoff<\/span> as one that impacts 50 or more employees in a <span data-term-id=\"57234576\">30-day period<\/span>. For comparison, the <span data-term-id=\"57234568\">federal <\/span><span data-term-id=\"57234560\">WARN Act<\/span> requires 500 or more <span data-term-id=\"57234566\">affected employees<\/span> (or 50 to 499 if that number represents 1\/3 of the workforce at that location).<\/p>\n<\/li>\n<li>\n<p><strong>Terminations or <span data-term-id=\"57234580\">Plant Closures<\/span>:<\/strong> An employer that terminates operations or substantially closes down a <span data-term-id=\"57234577\">covered establishment<\/span> must comply with the <span data-term-id=\"57234581\">California<\/span> <span data-term-id=\"57234560\">WARN Act<\/span>.<\/p>\n<\/li>\n<li>\n<p><strong>Relocations:<\/strong> The <span data-term-id=\"57234581\">California<\/span> <span data-term-id=\"57234560\">WARN Act<\/span> is triggered if an employer relocates all or substantially all of the industrial or commercial operations of a <span data-term-id=\"57234577\">covered establishment<\/span> to a location more than 100 miles away.<\/p>\n<\/li>\n<\/ol>\n<p>Each of these events triggers the <span data-term-id=\"57234581\">California<\/span> <span data-term-id=\"57234596\">WARN Act<\/span> <span data-term-id=\"57234562\">notice<\/span><span data-term-id=\"57234562\"> requirement<\/span>.<\/p>\n<h2><span data-term-id=\"57234562\">Notice Requirements<\/span><\/h2>\n<p>When it comes to notice, the <span data-term-id=\"57234605\">WARN requirements<\/span> are specific about the details.<\/p>\n<h3>When and Who the <span data-term-id=\"57234579\">Covered Employer<\/span> Must Notify<\/h3>\n<p>A <span data-term-id=\"57234579\">covered employer<\/span> must provide <span data-term-id=\"57234573\">advance notice<\/span> <em>at least<\/em> 60 days before the triggering event occurs. The 60-day <span data-term-id=\"57234608\">Cal-<\/span><span data-term-id=\"57234564\">WARN notice<\/span> must be in writing and provided to:<\/p>\n<ul>\n<li>\n<p>The <span data-term-id=\"57234566\">affected employees<\/span><\/p>\n<\/li>\n<li>\n<p>The <span data-term-id=\"57234570\">Employment Development Department<\/span> (<span data-term-id=\"57234599\">EDD<\/span>)<\/p>\n<\/li>\n<li>\n<p>The <span data-term-id=\"57234583\">Local Workforce Development Board<\/span><\/p>\n<\/li>\n<li>\n<p>The <span data-term-id=\"57234575\">chief elected official<\/span> of the affected <span data-term-id=\"57234574\">local government<\/span><\/p>\n<\/li>\n<\/ul>\n<p>The <span data-term-id=\"57234572\">written notice<\/span> to <span data-term-id=\"57234566\">affected employees<\/span> may be delivered in person, by first-class mail, or in the employee&#8217;s pay envelope (if it meets certain requirements).<\/p>\n<h3>Detailed Information<\/h3>\n<p>The Act also requires the employer to include certain information in the <span data-term-id=\"57234569\">60-day notice<\/span>. The employer must provide important details, such as:<\/p>\n<ul>\n<li>The employer&#8217;s <span data-term-id=\"57234582\">contact information<\/span> (including a <span data-term-id=\"57234588\">telephone number<\/span>)<\/li>\n<li>Job titles affected<\/li>\n<li>The number of affected workers<\/li>\n<li>The location of the worksite<\/li>\n<li>The duration of the triggering event (if it is temporary)<\/li>\n<\/ul>\n<p>This information helps the community and the affected workers prepare for the impact.<\/p>\n<p>The employer must indicate whether it will coordinate assistance, such as<a href=\"https:\/\/edd.ca.gov\/en\/jobs_and_training\/rapid-response-services-for-business\/\" target=\"_new\" rel=\"noopener\"><u> <\/u><u><span data-term-id=\"57234586\">Rapid Response<\/span><\/u><\/a>\u200b services. These services help the <span data-term-id=\"57234566\">affected employees<\/span> find new job opportunities, prepare for a <span data-term-id=\"57234609\">new career<\/span>, prepare for interviews, file for unemployment benefits, and learn about training and education opportunities.<\/p>\n<p>For union shops, the notice must also indicate:<\/p>\n<ul>\n<li>Whether <span data-term-id=\"57234610\">bumping rights<\/span> exist (protecting workers with seniority)<\/li>\n<li>The union name and address<\/li>\n<li>The name and address of the chief elected officer of each union<\/li>\n<\/ul>\n<p>The notice must also include information about the<a href=\"https:\/\/benefitscal.com\/\" target=\"_new\" rel=\"noopener\"><u> <\/u><u><span data-term-id=\"57234602\">CalFresh<\/span><\/u><\/a>\u200b program, which provides grocery assistance for eligible people.<\/p>\n<h3>Potential Exceptions and Special Circumstances<\/h3>\n<p>The <span data-term-id=\"57234581\">California<\/span> <span data-term-id=\"57234560\">WARN Act<\/span> includes several exceptions that may affect its coverage. This applies only to termination or relocation events, not to <span data-term-id=\"57234559\">mass layoffs<\/span>.<\/li>\n<li><strong>Project or seasonal work:<\/strong> Workers in particular industries hired for a specific project or for the duration of a season may not be entitled to <span data-term-id=\"57234560\">WARN Act<\/span> protections. An employee can sue under both the federal and <span data-term-id=\"57234561\">California<\/span> WARN statutes in the same case, but can recover under only one or the other, not both.<\/p>\n<p>An employee generally has three years to file a lawsuit for a <span data-term-id=\"57234581\">California<\/span> <span data-term-id=\"57234560\">WARN Act<\/span> violation. The<a href=\"https:\/\/www.findlaw.com\/state\/california-law\/california-civil-statute-of-limitations-laws.html\" target=\"_new\"><u> <\/u><u>statute of limitations<\/u><\/a>\u200b clock usually starts running on the date of the triggering event.<\/p>\n<p>Because a triggering event may affect many employees, a<a href=\"https:\/\/www.findlaw.com\/litigation\/legal-system\/class-action-cases.html\" target=\"_new\"><u> <\/u><u>class-action lawsuit<\/u><\/a>\u200b may be appropriate. In a class action lawsuit, similarly situated people unite to file a single lawsuit against the employer.<\/p>\n<p>If successful, the court may award the affected worker or workers:<\/p>\n<ul>\n<li><a href=\"https:\/\/codes.findlaw.com\/ca\/labor-code\/lab-sect-1402\/\" target=\"_new\" rel=\"noopener\"><u><span data-term-id=\"57234571\">Back pay<\/span><\/u><\/a>\u200b (up to 60 days)<\/li>\n<li>The value of the employee&#8217;s<a href=\"https:\/\/codes.findlaw.com\/ca\/labor-code\/lab-sect-1402\/\" target=\"_new\" rel=\"noopener\"><u> benefits<\/u><\/a>\u200b that were lost. This includes medical expenses that would have been covered under the employer-provided health insurance<\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/ca\/labor-code\/lab-sect-1403\/\" target=\"_new\" rel=\"noopener\"><u><span data-term-id=\"57234585\">Civil penalties<\/span><\/u><\/a>\u200b ($500 per day per violation)<\/li>\n<li><a href=\"https:\/\/codes.findlaw.com\/ca\/labor-code\/lab-sect-1404\/\" target=\"_new\" rel=\"noopener\"><u><span data-term-id=\"57234589\">Attorney&#8217;s fees<\/span><\/u><\/a>\u200b<\/li>\n<\/ul>\n<p>Under<a href=\"https:\/\/codes.findlaw.com\/ca\/labor-code\/lab-sect-1402\/\" target=\"_new\" rel=\"noopener\"><u> <\/u><u><span data-term-id=\"57234561\">California<\/span> <span data-term-id=\"57234587\">Labor Code Section<\/span> 1402(c<\/u><\/a>\u200b), the employer&#8217;s liability may be reduced if it made certain payments, such as:<\/p>\n<ul>\n<li>Wages to the employee during the employer&#8217;s violation period (excluding accrued vacation time)<\/li>\n<li>Voluntary and unconditional payments to the employee that were not required by a legal obligation<\/li>\n<li>Payments to a third party or trustee, such as healthcare benefit premiums, for the employee during the violation period<\/li>\n<\/ul>\n<p>In addition, the<a href=\"https:\/\/codes.findlaw.com\/ca\/labor-code\/lab-sect-1406\/\" target=\"_new\" rel=\"noopener\"><u> <\/u><u><span data-term-id=\"57234561\">California<\/span> Labor Code<\/u><\/a>\u200b empowers the Labor Commissioner to investigate potential <span data-term-id=\"57234560\">WARN Act<\/span> violations and to order temporary relief to the affected workers during the investigation.<\/p>\n<h2>Rights and Options for <span data-term-id=\"57234561\">California<\/span> Employees<\/h2>\n<p>If you get <span data-term-id=\"57234594\">laid off<\/span> from your job, your workplace closes, or your workplace moves more than 100 miles away, you may be entitled to <span data-term-id=\"57234581\">California<\/span><span data-term-id=\"57234581\">&#8216;s <\/span><span data-term-id=\"57234560\">WARN Act<\/span> protections.
