Enacted in 1988, this law helps workers and communities prepare for large-scale <span data-term-id=\"58062622\">job loss<\/span> by requiring large employers to provide <span data-term-id=\"58062588\">affected employees<\/span> with <span data-term-id=\"58062589\">advance notice<\/span> of certain \u201ctriggering\u201d events, namely <span data-term-id=\"58062584\">plant closings<\/span> and <span data-term-id=\"58062581\">mass layoffs<\/span>.<\/p>\n<p>If you lose your job without receiving proper 60 days\u2019 notice and the <span data-term-id=\"58062594\">federal <\/span><span data-term-id=\"58062623\">WARN Act<\/span><span data-term-id=\"58062623\"> applies<\/span>, you could be entitled to financial recovery from your employer.<\/p>\n<p>While the <span data-term-id=\"58062582\">WARN Act<\/span> is a federal law, many states also have their own version. Some provide more protection than the federal act. This article focuses on the <span data-term-id=\"58062594\">federal <\/span><span data-term-id=\"58062582\">WARN Act<\/span>, including your <a href=\"https:\/\/www.dol.gov\/agencies\/eta\/layoffs\/warn\" target=\"_blank\" rel=\"noopener\">employer\u2019s compliance obligations<\/a> and your rights as an employee. Knowing your employment rights is the key to protecting them.<\/p>\n<h2>Which Employers Are Covered by the <span data-term-id=\"58062582\">WARN Act<\/span>?<\/h2>\n<p><span data-term-id=\"58062613\">Covered employers<\/span> must comply with the <span data-term-id=\"58062582\">WARN Act<\/span>. The <span data-term-id=\"58062594\">federal <\/span><span data-term-id=\"58062582\">WARN Act<\/span> covers any \u201cbusiness enterprise\u201d that employs:<\/p>\n<ul>\n<li>100 or more <span data-term-id=\"58062608\">full-time employees<\/span> (not including <span data-term-id=\"58062633\">part-time employees<\/span>); <strong>or<\/strong><\/li>\n<li>100 or more employees who work a total of at least 4,000 hours per week (not including overtime hours).<\/li>\n<\/ul>\n<p>Generally, part-time workers and government employees (federal, state, and local) are not covered by the <span data-term-id=\"58062582\">WARN Act<\/span>.<\/p>\n<p>The <span data-term-id=\"58062594\">federal <\/span><span data-term-id=\"58062582\">WARN Act<\/span> defines a <span data-term-id=\"58062633\">part-time employee<\/span> as \u201can employee who is employed for an average of fewer than 20 hours per week or who has been employed for fewer than 6 of the 12 months preceding the date on which notice is required.\u201d<\/p>\n<p><span data-term-id=\"58062600\">Nonprofit<\/span> organizations are not automatically exempt from the <span data-term-id=\"58062582\">WARN Act<\/span>. A <span data-term-id=\"58062600\">nonprofit<\/span> organization that is purely charitable with minimal commercial activity may not be a <span data-term-id=\"58062613\">covered employer<\/span>. However, a <span data-term-id=\"58062600\">nonprofit<\/span> organization that functions as a business enterprise and meets the employee thresholds may be treated the same as for-profit employers and be subject to the <span data-term-id=\"58062585\">WARN <\/span><span data-term-id=\"58062607\">notice<\/span><span data-term-id=\"58062607\"> requirements<\/span>.<\/p>\n<h2>What Events Trigger <span data-term-id=\"58062582\">WARN Act<\/span> Requirements?<\/h2>\n<p>Under the <span data-term-id=\"58062594\">federal <\/span><span data-term-id=\"58062582\">WARN Act<\/span>, three different employer actions trigger the <span data-term-id=\"58062629\">required notice<\/span>. Each trigger is <a href=\"https:\/\/codes.findlaw.com\/us\/title-29-labor\/29-usc-sect-2101\/\" target=\"_blank\" rel=\"noopener\">specifically defined<\/a> and subject to certain thresholds. Central to each trigger is the meaning of \u201c<span data-term-id=\"58062604\">employment loss<\/span>.\u201d The <span data-term-id=\"58062594\">federal <\/span><span data-term-id=\"58062582\">WARN Act<\/span> defines an <span data-term-id=\"58062604\">employment loss<\/span> as any of the following:<\/p>\n<ul>\n<li>An employment termination (other than a termination for cause, a voluntary departure, or a retirement)<\/li>\n<li>A layoff longer than six months<\/li>\n<li>A reduction in work hours of more than 50% during each month of any six-month period<\/li>\n<\/ul>\n<h3><span data-term-id=\"58062584\">Plant Closings<\/span><\/h3>\n<p>A <span data-term-id=\"58062584\">plant closing<\/span> triggers the <span data-term-id=\"58062594\">federal <\/span><span data-term-id=\"58062582\">WARN Act<\/span>. A <span data-term-id=\"58062584\">plant closing<\/span> is defined as:<\/p>\n<ul>\n<li>The permanent or temporary <span data-term-id=\"58062599\">shutdown<\/span> of a <span data-term-id=\"58062628\">single site of employment<\/span>, <strong>or<\/strong><\/li>\n<li>One or more facilities or operating units within a <span data-term-id=\"58062628\">single site of employment<\/span>, if the <span data-term-id=\"58062599\">shutdown<\/span> results in an <span data-term-id=\"58062604\">employment loss<\/span> at the <span data-term-id=\"58062628\">single site of employment<\/span> during any <span data-term-id=\"58062611\">30-day period<\/span> for 50 or more employees (excluding any <span data-term-id=\"58062633\">part-time employees<\/span>)<\/li>\n<\/ul>\n<h3><span data-term-id=\"58062581\">Mass Layoffs<\/span><\/h3>\n<p>A <span data-term-id=\"58062581\">mass layoff<\/span> is a reduction in the workforce that is not the result of a <span data-term-id=\"58062584\">plant closing<\/span>. This is an <span data-term-id=\"58062604\">employment loss<\/span> at a <span data-term-id=\"58062628\">single site of employment<\/span> during a <span data-term-id=\"58062611\">30-day period<\/span> of either:<\/p>\n<ul>\n<li>At least 33% of the employees (excluding <span data-term-id=\"58062633\">part-time employees<\/span>) <em>and<\/em> at least 50 employees; <strong>or<\/strong><\/li>\n<li>500 employees (excluding <span data-term-id=\"58062633\">part-time employees<\/span>)<\/li>\n<\/ul>\n<h3>Multiple <span data-term-id=\"58062604\">Employment Losses<\/span> at a Single Site<\/h3>\n<p>The <span data-term-id=\"58062582\">WARN Act<\/span> prohibits employers from using multiple, smaller layoffs or terminations at a single location to avoid\u00a0coverage.<\/p>\n<p><span data-term-id=\"58062604\">Employment losses<\/span> within a 90-day period for two or more groups at a single employment site that don\u2019t meet a threshold individually but exceed it when combined are considered a <span data-term-id=\"58062584\">plant closing<\/span> or <span data-term-id=\"58062581\">mass layoff<\/span>. The employer then must show that the <span data-term-id=\"58062604\">employment losses<\/span> are separate, distinct, and not an attempt to evade the <span data-term-id=\"58062594\">federal <\/span><span data-term-id=\"58062582\">WARN Act<\/span> requirements<\/p>\n<h2>What Notice Are You Entitled To?<\/h2>\n<p><span data-term-id=\"58062610\">WARN Act<\/span><span data-term-id=\"58062610\"> compliance<\/span> requires employers to meet strict <span data-term-id=\"58062607\">notice requirements<\/span>.<\/p>\n<h3>Who Is Entitled to Notice<\/h3>\n<p>Before ordering a <span data-term-id=\"58062584\">plant closing<\/span> or <span data-term-id=\"58062581\">mass layoff<\/span>, an employer must provide <a href=\"https:\/\/codes.findlaw.com\/us\/title-29-labor\/29-usc-sect-2102\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58062606\">written notice<\/span> <\/a>of the order at least 60 days before the order to:<\/p>\n<ul>\n<li>The <span data-term-id=\"58062588\">affected employees<\/span> (or their representative)<\/li>\n<li>The state or state-designated entity that carries out <span data-term-id=\"58062621\">rapid-response services<\/span><\/li>\n<li>The <span data-term-id=\"58062592\">chief elected official<\/span> of the <span data-term-id=\"58062625\">unit of <\/span><span data-term-id=\"58062591\">local government<\/span> where the <span data-term-id=\"58062602\">plant closure<\/span> or <span data-term-id=\"58062581\">mass layoff<\/span> will occur<\/li>\n<\/ul>\n<p>The <span data-term-id=\"58062598\">60-day <\/span><span data-term-id=\"58062607\">notice<\/span><span data-term-id=\"58062607\"> requirement<\/span> (measured in <span data-term-id=\"58062609\">calendar days<\/span>) gives the <span data-term-id=\"58062593\">affected workers<\/span> time to prepare for their pending <span data-term-id=\"58062604\">employment loss<\/span>, and gives communities time to prepare for the impact of large-scale unemployment.<\/p>\n<h3>What the <span data-term-id=\"58062606\">Written Notice<\/span> Must Include<\/h3>\n<p><a href=\"https:\/\/codes.findlaw.com\/cfr\/title-20-employees-benefits\/cfr-sect-20-639-7\/\" target=\"_blank\" rel=\"noopener\">Notice to the <span data-term-id=\"58062588\">affected employees<\/span><\/a> must state (in a language understandable to the employees):<\/p>\n<ul>\n<li>Whether the planned action is expected to be permanent or temporary, and whether the entire plant is closing<\/li>\n<li>The expected date the <span data-term-id=\"58062584\">plant closing<\/span> or <span data-term-id=\"58062581\">mass layoff<\/span> will begin, and the expected date the employee will be separated<\/li>\n<li>Whether or not bumping rights (seniority-based priority) exist<\/li>\n<li>The name and telephone number of a company official to contact for further information.<\/li>\n<\/ul>\n<p>The <span data-term-id=\"58062613\">covered employer<\/span> must notify either each representative of the <span data-term-id=\"58062588\">affected employees<\/span> or, if there is no representative, each employee.<\/p>\n<h3>How the Employer Must Deliver Notice to Employees<\/h3>\n<p>The <span data-term-id=\"58062582\">WARN Act<\/span> is flexible about <a href=\"https:\/\/codes.findlaw.com\/cfr\/title-20-employees-benefits\/cfr-sect-20-639-8\/\" target=\"_blank\" rel=\"noopener\">how the employer must give notice<\/a> to the employees. But it does specify that a ticketed notice regularly included in each employee\u2019s paycheck or pay envelope does <em>not <\/em>satisfy the <span data-term-id=\"58062607\">notice requirement<\/span>.<\/p>\n<p>The employer may send the <span data-term-id=\"58062585\">WARN notice<\/span> to the employee\u2019s last known address by first-class mail, by personal delivery, or by including the notice in the employee\u2019s pay envelope.<\/p>\n<h2>When the <span data-term-id=\"58062598\">60-Day <\/span><span data-term-id=\"58062607\">Notice<\/span><span data-term-id=\"58062607\"> Requirement<\/span> Doesn\u2019t Apply<\/h2>\n<p>The law provides specific <a href=\"https:\/\/codes.findlaw.com\/us\/title-29-labor\/29-usc-sect-2102\/\" target=\"_blank\" rel=\"noopener\">reductions to the <span data-term-id=\"58062598\">60-day <\/span><span data-term-id=\"58062607\">notice<\/span><span data-term-id=\"58062607\"> requirement<\/span><\/a>. It is the employer\u2019s job to prove an exception applies.<\/p>\n<ul>\n<li><strong><span data-term-id=\"58062601\">Unforeseeable business circumstances<\/span>: <\/strong>An employer may order a <span data-term-id=\"58062584\">plant closing<\/span> or <span data-term-id=\"58062581\">mass layoff<\/span> without 60 days\u2019 notice if the <span data-term-id=\"58062584\">plant closing<\/span> or <span data-term-id=\"58062581\">mass layoff<\/span> is caused by business circumstances that were not reasonably foreseeable at the time notice would have been required. An example of this is the global <span data-term-id=\"58062634\">pandemic<\/span>.<\/li>\n<li><strong><span data-term-id=\"58062630\">Faltering company<\/span>: <\/strong>An employer may order the <span data-term-id=\"58062599\">shutdown<\/span> of a <span data-term-id=\"58062628\">single site of employment<\/span> without 60 days\u2019 notice if the employer was actively seeking capital or business that, if obtained, would have prevented the <span data-term-id=\"58062599\">shutdown<\/span> and reasonably and in good faith believed that providing the notice would prevent the employer from obtaining the needed capital or business.<\/li>\n<li><strong><span data-term-id=\"58062590\">Natural disaster<\/span>: <\/strong>An employer may order a <span data-term-id=\"58062584\">plant closing<\/span> or <span data-term-id=\"58062581\">mass layoff<\/span> without 60 days\u2019 notice if the <span data-term-id=\"58062584\">plant closing<\/span> or <span data-term-id=\"58062581\">mass layoff<\/span> is due to a <span data-term-id=\"58062590\">natural disaster<\/span>, such as a flood, hurricane, tornado, wildfire, earthquake, or drought.<\/li>\n<\/ul>\n<p>Even when an exception to the <span data-term-id=\"58062607\">notice requirement<\/span> applies, employers generally must provide as much notice as practicable and explain the reason for the reduced notice.<\/p>\n<p>In addition, the <a href=\"https:\/\/codes.findlaw.com\/us\/title-29-labor\/29-usc-sect-2103\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58062607\">notice requirement<\/span> doesn\u2019t apply<\/a> in certain circumstances:<\/p>\n<ul>\n<li><strong>Limited Engagement: <\/strong>The <span data-term-id=\"58062594\">federal <\/span><span data-term-id=\"58062582\">WARN Act<\/span> does not apply to a <span data-term-id=\"58062584\">plant closing<\/span> or <span data-term-id=\"58062581\">mass layoff<\/span> at a temporary facility or resulting from the completion of a specific project or undertaking, if the employees were hired with the clear understanding that their employment was limited to that duration.<\/li>\n<li><strong>Strike or <span data-term-id=\"58062603\">Lockout<\/span>:<\/strong> The <span data-term-id=\"58062594\">federal <\/span><span data-term-id=\"58062582\">WARN Act<\/span> does not apply where \u201cthe closing or layoff constitutes a strike or constitutes a <span data-term-id=\"58062603\">lockout<\/span>\u201d\u00a0as long as the <span data-term-id=\"58062603\">lockout<\/span> is not being used to evade the law.<\/li>\n<\/ul>\n<h2>What If Your Employer Violates the <span data-term-id=\"58062582\">WARN Act<\/span>?<\/h2>\n<p>An employer who violates the <span data-term-id=\"58062594\">federal <\/span><span data-term-id=\"58062582\">WARN Act<\/span> is subject to civil action in federal <span data-term-id=\"58062605\">district court<\/span>. In other words, you can sue them.<\/p>\n<p>Employers who fail to give adequate notice may be liable to each <span data-term-id=\"58062588\">affected employee<\/span> for <span data-term-id=\"58062596\">back pay<\/span> and benefits for the violation period, but not reinstatement. Further, <span data-term-id=\"58062626\">reasonable attorney\u2019s fees<\/span> and costs may be recovered in the judgment. <span data-term-id=\"58062588\">Affected employees<\/span> may file civil lawsuits individually or join a <a href=\"https:\/\/www.findlaw.com\/litigation\/filing-a-lawsuit\/how-to-file-a-class-action-lawsuit.html\">class action lawsuit<\/a>.<\/p>\n<p>Employers may also be subject to additional <span data-term-id=\"58062618\">civil penalties<\/span> if they fail to notify the required government authorities.<\/p>\n<h2>Additional Protections Under State <span data-term-id=\"58062582\">WARN Acts<\/span><\/h2>\n<p>Many states have their own &#8220;mini-WARN&#8221; laws. Some states have broader coverage for employees or stricter requirements for employers than the <span data-term-id=\"58062594\">federal <\/span><span data-term-id=\"58062582\">WARN Act<\/span>, <a href=\"https:\/\/www.findlaw.com\/state\/california-law\/the-california-worker-adjustment-and-retraining-notification-warn-act.html\">such as <span data-term-id=\"58062620\">California<\/span><\/a>. To check your state\u2019s <span data-term-id=\"58062582\">WARN Act<\/span> requirements, visit your state\u2019s <span data-term-id=\"58062586\">Department of Labor<\/span> or Employment Development Department website for more information.<\/p>\n<h2>What Should You Do If You&#8217;re Affected?<\/h2>\n<p>If you\u2019ve experienced an <span data-term-id=\"58062604\">employment loss<\/span>, it\u2019s important to protect your rights.<\/p>\n<ul>\n<li>Document everything<\/li>\n<li>Keep any notices or other communications you receive from your employer<\/li>\n<li>Determine if your situation qualifies for <span data-term-id=\"58062582\">WARN Act<\/span> protection<\/li>\n<li>Consider consulting with an employment attorney<\/li>\n<\/ul>\n<p>Losing your job can be overwhelming.
