Your estate is far more likely to be taxed at the <span data-term-id=\"56786870\">state level<\/span> if you live in one of the 13 states that have an estate tax. That\u2019s because estates valued at up to $15 million ($30 million for <span data-term-id=\"56786867\">married couples<\/span>) are not subject to the <span data-term-id=\"56786827\">federal estate tax<\/span>, but estates as small as $2 million may be subject to <span data-term-id=\"56786826\">state estate taxes<\/span>. There is no federal <span data-term-id=\"56786823\">inheritance tax<\/span>, but five states levy the tax on inheritances as small as $1,000.<\/p>\n<p>The enactment of the Tax Cuts and Jobs Act in 2017 resulted in far fewer individual estates facing the <span data-term-id=\"56786827\">federal estate tax<\/span>, as it raised the amount that was excluded from the tax from $5.5 million to just over $11 million. For <span data-term-id=\"56786867\">married couples<\/span> filing jointly, the estate tax increased from $11 million to $22 million. The 2025 One Big Beautiful Bill Act increased the <span data-term-id=\"56786827\">federal estate tax<\/span> exclusion again, to $15 million for individuals in 2026 and $30 million for married filing jointly. All of these numbers are adjusted annually for inflation.<\/p>\n<p>For wealthy <span data-term-id=\"56786864\">taxpayers<\/span>, the increased <span data-term-id=\"56786868\">federal estate tax<\/span><span data-term-id=\"56786868\"> exemption<\/span> did not change their state estate and <span data-term-id=\"56786823\">inheritance tax<\/span> obligations. To make matters more complicated, each state has its own estate and <span data-term-id=\"56786823\">inheritance tax<\/span> rules. In the sections that follow, we will explain the differences between inheritance and estate taxes. We\u2019ll also look at the filing thresholds and tax brackets for each state that imposes one of the taxes. For most states, there is either an estate tax or an <span data-term-id=\"56786823\">inheritance tax<\/span>, with <span data-term-id=\"56786830\">Maryland<\/span> being the only state that imposes both.<\/p>\n<h2>Estate Taxes vs. <span data-term-id=\"56786823\">Inheritance Taxes<\/span><\/h2>\n<p>The primary difference between estate and <span data-term-id=\"56786823\">inheritance taxes<\/span> is the party responsible for paying. Estate taxes are usually assessed on the <span data-term-id=\"56786879\">total value<\/span> of an individual\u2019s estate after they have died and are paid by the estate itself. The estate tax is paid before the heirs receive their inheritance, thereby reducing the amount they receive. <span data-term-id=\"56786845\">State <\/span><span data-term-id=\"56786823\">inheritance taxes<\/span> are commonly paid by the individual who receives an inheritance from an estate.<\/p>\n<p>The estate tax is collected based on the fair market <span data-term-id=\"56786861\">value of the estate<\/span> at the time of the <span data-term-id=\"56786881\">decedent<\/span><span data-term-id=\"56786881\">\u2019s death<\/span>. The <span data-term-id=\"56786874\">decedent<\/span><span data-term-id=\"56786874\">\u2019s estate<\/span> is based on the deceased\u2019s:<\/p>\n<ul>\n<li>Money and financial accounts<\/li>\n<li>Investments<\/li>\n<li>Property, including <span data-term-id=\"56786865\">real estate<\/span> and business interests<\/li>\n<li>Other assets<\/li>\n<\/ul>\n<p>The <span data-term-id=\"56786857\">taxable estate<\/span>\u2019s value is usually reduced by any of the <span data-term-id=\"56786825\">decedent<\/span>\u2019s unpaid debts and other obligations that must be paid by the estate.<\/p>\n<p>The <span data-term-id=\"56786823\">inheritance tax<\/span> is assessed on the value of the assets received by each beneficiary. For example, a beneficiary who received a family business valued at $5 million would pay more in <span data-term-id=\"56786823\">inheritance taxes<\/span> than a beneficiary who inherited a vacation home valued at $500,000 from the same person.<\/p>\n<h2>States With an Estate Tax<\/h2>\n<p>The following jurisdictions collect an estate tax, each with its own <span data-term-id=\"56786848\">exemption amount<\/span> and <span data-term-id=\"56786840\">estate <\/span><span data-term-id=\"56786824\">tax rate<\/span>. We\u2019ve listed the date by which the estate <span data-term-id=\"56786833\">tax return<\/span> must be filed with the state\u2019s department of revenue, along with the amount that is exempt from the estate tax for 2026.<\/p>\n<p>In <span data-term-id=\"56786828\">Connecticut<\/span>, all estates are generally required to file an estate <span data-term-id=\"56786833\">tax return<\/span>, even if they are exempt from the state\u2019s tax. If you have any questions, consider getting guidance from either a tax professional or <a href=\"https:\/\/lawyers.findlaw.com\/estate-planning\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">an estate attorney<\/a>.<\/p>\n<h2>States With an <span data-term-id=\"56786823\">Inheritance Tax<\/span><\/h2>\n<p>The following states assess an <span data-term-id=\"56786823\">inheritance tax<\/span> on the beneficiaries of an estate. <span data-term-id=\"56786846\">Inheritance <\/span><span data-term-id=\"56786824\">tax<\/span><span data-term-id=\"56786846\"> rates<\/span> vary based on the amount of <span data-term-id=\"56786862\">inherited assets<\/span> and the beneficiary\u2019s relationship with the deceased. If you\u2019re receiving an inheritance in one of these states, speaking with an <a href=\"https:\/\/lawyers.findlaw.com\/estate-planning\/?fli=dcta\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"56786869\">estate planning<\/span><\/a> or <a href=\"https:\/\/lawyers.findlaw.com\/tax\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">tax attorney<\/a> is a good idea.<\/p>\n<h2>Out-of-State Beneficiaries<\/h2>\n<p>A common inheritance and estate tax complication arises when the <span data-term-id=\"56786825\">decedent<\/span> lives in a state with a tax, but the beneficiary does not. Both the estate tax and the <span data-term-id=\"56786823\">inheritance tax<\/span>\u00a0are imposed by the state where the\u00a0<span data-term-id=\"56786825\">decedent<\/span>\u00a0resided, so the beneficiary will likely have to pay them.<\/p>\n<p>Let\u2019s use an example. Felix lived in <span data-term-id=\"56786830\">Maryland<\/span>, which has both an estate and an <span data-term-id=\"56786823\">inheritance tax<\/span>. He left his entire estate, valued at $7 million, to his nephew Oscar in <span data-term-id=\"56786847\">Iowa<\/span>, which does not tax either. The estate may be required to pay\u00a0<span data-term-id=\"56786830\">Maryland<\/span>\u00a0<span data-term-id=\"56786823\">inheritance tax<\/span>\u00a0on the amount by which the estate exceeds the state\u2019s $5 million exemption ($2 million). Oscar would need to pay any <span data-term-id=\"56786823\">inheritance <\/span><span data-term-id=\"56786876\">tax<\/span><span data-term-id=\"56786876\"> due<\/span> on amounts he receives above the exemption. These tax payments would be required even though Oscar lives in a state that has neither an estate tax nor an <span data-term-id=\"56786823\">inheritance tax<\/span>.<\/p>\n<h2>When To Contact an Estate or Tax Attorney<\/h2>\n<p>If you have received a substantial inheritance from someone who is not your spouse or parent and lived in a state with an <span data-term-id=\"56786823\">inheritance tax<\/span>, it\u2019s a good idea to contact an <a href=\"https:\/\/lawyers.findlaw.com\/estate-planning\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">estate or tax attorney<\/a> to determine whether you owe anything. Each state has different rules regarding who is exempt from the tax and what tax brackets apply to beneficiaries who receive an inheritance. An attorney can determine when the <span data-term-id=\"56786823\">inheritance tax<\/span> is owed and how much.<\/p>\n<p>Executors of an estate that might be subject to state or <span data-term-id=\"56786827\">federal estate taxes<\/span> should work with an attorney to ensure that the estate pays all of the taxes owed before it is distributed to the beneficiaries. The <span data-term-id=\"56786849\">IRS<\/span> and state revenue agencies can hold the executor liable for any unpaid estate taxes. In addition, the <span data-term-id=\"56786849\">IRS<\/span> and state revenue agencies often have the option to go after beneficiaries who received distributions from the estate if they find that taxes are still due.
