These laws allow defendants to seek an expedited dismissal of lawsuits that threaten their <span data-term-id=\"57894449\">First Amendment rights<\/span>.<\/p>\n\n    <\/div>\n\n\n\n<div><p>Speaking out in public is a way for citizens to express discontent with injustice and comment on government actions. Examples are speaking up at a public hearing, writing a news article, or posting on social media.<\/p>\n<p>The <a href=\"https:\/\/constitution.findlaw.com\/amendment1\/freedom-of-speech.html\" target=\"_blank\" rel=\"noopener\"><u>First Amendment<\/u><\/a> protects us from government punishment for expressing our thoughts and opinions. However, people who disagree with a person\u2019s speech may try to silence them by suing them, usually for <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/defamation-libel-slander.html\"><span data-term-id=\"57894453\">defamation<\/span><\/a>. In response, many states have passed \u201canti-SLAPP\u201d laws to help protect the <span data-term-id=\"57894468\">constitutional right<\/span> of <span data-term-id=\"57894443\">free speech<\/span> from retaliation.<\/p>\n<h2><strong>What Are Anti-SLAPP Laws?<\/strong><\/h2>\n<p>SLAPP stands for \u201c<span data-term-id=\"57894442\">Strategic Lawsuit Against Public Participation<\/span>,\u201d meaning it is a lawsuit aimed at silencing someone who speaks out on <span data-term-id=\"57894452\">matters of public concern<\/span>. <span data-term-id=\"57894441\">Anti-SLAPP laws<\/span> enable defendants to get frivolous <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/defamation-libel-slander.html\"><span data-term-id=\"57894453\">defamation<\/span> lawsuits<\/a> that threaten their <span data-term-id=\"57894481\">freedom of speech<\/span> dismissed more quickly. The party that filed the lawsuit must show that the claim is not a frivolous lawsuit; otherwise, they may have to pay the other party\u2019s legal fees.<\/p>\n<p><span data-term-id=\"57894441\">Anti-SLAPP laws<\/span> typically address matters of \u201cpublic concern,\u201d not private disputes. For example, government activity, political activity, school board meetings or public hearings, or issues relating to consumer information, health, safety, or community are <span data-term-id=\"57894452\">matters of public concern<\/span>.<\/p>\n<p>For example, a court would consider reporting a hospital\u2019s history of unsafe practices a <span data-term-id=\"57894452\">matter of public concern<\/span>, but a patient\u2019s billing dispute with a doctor a private issue. Employment issues, such as complaints about a supervisor, tend to be private disputes.<\/p>\n<p>The purpose of <span data-term-id=\"57894441\">anti-SLAPP laws<\/span> is to encourage public debate and prevent the chilling of speech out of fear of punishment. Therefore, private matters do not qualify under <span data-term-id=\"57894469\">anti-SLAPP protection<\/span>.<\/p>\n<p>To get a clear picture of how <span data-term-id=\"57894441\">anti-SLAPP laws<\/span> operate, it\u2019s important to understand the basis for a <span data-term-id=\"57894453\">defamation<\/span> lawsuit.<\/p>\n<h2><strong>Understanding Defamation Lawsuits<\/strong><\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/defamation-libel-slander.html\"><span data-term-id=\"57894453\">Defamation<\/span> <\/a>is the intentional publishing or communication of a false statement of fact that harms someone\u2019s reputation. There are two main types:<\/p>\n<ul>\n<li><strong>Libel<\/strong> is a type of <span data-term-id=\"57894453\">defamation<\/span> where the statement is written.<\/li>\n<li><strong>Slander<\/strong> is <span data-term-id=\"57894453\">defamation<\/span> that is spoken.<\/li>\n<\/ul>\n<p>To make a successful claim of <span data-term-id=\"57894453\">defamation<\/span>, the <span data-term-id=\"57894495\">litigant<\/span> must prove:<\/p>\n<ul>\n<li>The defendant made a false statement presented as fact (not their opinion)<\/li>\n<li>The defendant published or communicated the statement to a third party<\/li>\n<li>The statement harmed the reputation of the <span data-term-id=\"57894495\">litigant<\/span><\/li>\n<\/ul>\n<p>If the plaintiff is not a public figure, they only need to show that the defendant was negligent in publishing the statement. However, with celebrities or public figures, the plaintiff must show that there was actual malice (knowingly or having reckless disregard for the truth) in publishing or communicating the statement, which is a higher bar.<\/p>\n<p>The two most common defenses to a <span data-term-id=\"57894453\">defamation<\/span> claim are:<\/p>\n<ul>\n<li>The statement is true<\/li>\n<li>The statement is an opinion, not a fact<\/li>\n<\/ul>\n<p>A privileged statement, such as those made by spouses or legislators on the floor of a legislature, is also not eligible for a <span data-term-id=\"57894453\">defamation<\/span> claim (no matter how heated it is).<\/p>\n<h2><strong>How SLAPP Lawsuits Exploit Defamation Law<\/strong><\/h2>\n<p><span data-term-id=\"57894453\">Defamation<\/span>\u00a0law aims to protect a person\u2019s reputation. However, in certain contexts, this law can be weaponized to silence\u00a0<span data-term-id=\"57894443\">free speech<\/span>.<\/p>\n<p>SLAPP lawsuits are typically filed by high-profile individuals or companies seeking to silence critics who cannot afford to defend themselves in court. Even if a claim lacks merit, the threat of an expensive lawsuit is enough to keep people silent.<\/p>\n<p>Often, the plaintiffs in SLAPP lawsuits don\u2019t intend to win. Instead, they seek to threaten, punish, and deter those who speak out against them.<\/p>\n<h2><strong>What Is an Example of a SLAPP Lawsuit?<\/strong><\/h2>\n<p>In 2024, the Center for Countering Digital Hate (CCDH) criticized Elon Musk\u2019s X Corp.\u2019s handling of hate speech and misinformation. <a href=\"https:\/\/www.courtlistener.com\/docket\/67654013\/1\/x-corp-v-center-for-countering-digital-hate-inc\/\" target=\"_blank\" rel=\"noopener\">X responded by suing CCDH<\/a> for improperly scraping data and publishing negative reports about X Corp.\u2019s content, costing X Corp. tens of millions in lost ad revenue.<\/p>\n<p><a href=\"https:\/\/caselaw.findlaw.com\/court\/us-dis-crt-n-d-cal\/115973985.html\" target=\"_blank\" rel=\"noopener\">The U.S. <span data-term-id=\"57894501\">District Court<\/span> for Northern <span data-term-id=\"57894445\">California<\/span><\/a> held that CCDH\u2019s activity is an exercise of <span data-term-id=\"57894443\">free speech<\/span> on issues of public concern and is covered by <span data-term-id=\"57894445\">California<\/span>\u2019s <span data-term-id=\"57894440\">anti-SLAPP statute<\/span>. The judge noted that although X accused CCDH of <span data-term-id=\"57894453\">defamation<\/span>, X did not bring a <span data-term-id=\"57894453\">defamation<\/span> claim requiring it to prove the reporting was false. Instead, X brought claims of breach of contract and CCDH\u2019s interference with X&#8217;s advertisers. X\u2019s <span data-term-id=\"57894453\">defamation<\/span> claims only arose when describing their injury of losing revenue from advertisers.<\/p>\n<p>The judge dismissed X\u2019s claim, finding that it was brought only to punish the speaker and not to address actual contract or data-access issues. CCDH could then file for recovery of its <span data-term-id=\"57894447\">attorney\u2019s fees<\/span>.<\/p>\n<h2><strong>What States Have Anti-SLAPP Laws?<\/strong><\/h2>\n<p>Many states have adopted the <span data-term-id=\"57894480\">Uniform Public Expression Protection Act<\/span> (UPEPA). These states (shown in dark blue on the map below) provide the strongest protection.<\/p>\n<p>Some states have enacted their own <span data-term-id=\"57894441\">anti-SLAPP law<\/span> that provides more limited protections. These three states are shown in a medium blue on the map. Other states do not have <span data-term-id=\"57894441\">anti-SLAPP laws<\/span> at all, and instead rely on state and federal constitutional protections for <span data-term-id=\"57894443\">free speech<\/span>. Those states are:<\/p>\n<ul>\n<li>Alabama<\/li>\n<li>Alaska<\/li>\n<li>Michigan<\/li>\n<li>Mississippi<\/li>\n<li>New Hampshire<\/li>\n<li>North Carolina<\/li>\n<li>North Dakota<\/li>\n<li>South Carolina<\/li>\n<li>South Dakota<\/li>\n<li>West Virginia<\/li>\n<li>Wisconsin<\/li>\n<li>Wyoming<\/li>\n<\/ul>\n<p>Even in states or <span data-term-id=\"57894463\">jurisdictions<\/span> that have them, <span data-term-id=\"57894441\">anti-SLAPP laws<\/span> vary significantly in scope and effectiveness.
