But courts have disagreed about the application of <span data-term-id=\"59241554\">Title IX<\/span> when it comes to <span data-term-id=\"59241556\">transgender student-athletes<\/span> competing on sports teams matching their <span data-term-id=\"59241551\">gender identity<\/span>.<\/p>\n<p>After the Supreme Court decided <a class=\"reset interactable cursor-pointer decoration-1 underline-offset-1 text-super hover:underline\" href=\"https:\/\/supreme.findlaw.com\/supreme-court-insights\/bostock-v-clayton-county-case-summary-.html\" target=\"_blank\" rel=\"nofollow noopener\"><em>Bostock v. Clayton County<\/em><\/a>, a Title VII employment case, it held that firing someone based on their <span data-term-id=\"59241551\">gender identity<\/span> or <span data-term-id=\"59241567\">sexual orientation<\/span> qualified as <span data-term-id=\"59241594\">sex discrimination<\/span>. Several courts and the <span data-term-id=\"59241572\">U.S. Department of Education<\/span>\u2019s Office for Civil Rights (OCR) read <em>Bostock<\/em> to support allowing transgender athletes to compete on teams aligned with their <span data-term-id=\"59241551\">gender identity<\/span> under <span data-term-id=\"59241554\">Title IX<\/span>. Other courts and several states rejected that approach in the sports context, emphasizing \u201c<span data-term-id=\"59241589\">biological sex<\/span>\u201d and insisting that <em>Bostock<\/em> was limited to Title VII.<\/p>\n<p>This split in interpretation left the legality of state\u2011level bans unsettled until the Supreme Court decided <em><span data-term-id=\"59241555\">West Virginia<\/span> v. B.P.J.<\/em><\/p>\n<p>We explore the decision below.<\/p>\n<h2><span data-term-id=\"59241555\">West Virginia<\/span> vs. B.P.J.<\/h2>\n<p>In June 2026, the Supreme Court issued a consolidated opinion for <em><span data-term-id=\"59241555\">West Virginia<\/span> v. B.P.J.<\/em> and <em>Little v. Hecox<\/em> (collectively, \u201c<em>B.P.J.<\/em>\u201d).<\/p>\n<p>Simply put, the Court confirmed that the<a href=\"https:\/\/www.findlaw.com\/legalblogs\/supreme-court\/scotus-upholds-state-bans-against-transgender-athletes\/\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"> individual states may enforce bans<\/a> on trans student-athletes without violating <span data-term-id=\"59241554\">Title IX<\/span> or the <span data-term-id=\"59241588\">Equal Protection Clause<\/span>.<\/p>\n<h3>About the Case<\/h3>\n<p>Both cases involved transgender girls challenging <span data-term-id=\"59241552\">state laws<\/span> that limited participation in <span data-term-id=\"59241584\">girls\u2019 and women\u2019s sports<\/span> based on <span data-term-id=\"59241589\">biological sex<\/span>.<\/p>\n<p><span data-term-id=\"59241555\">West Virginia<\/span>\u2019s<a href=\"https:\/\/www.wvlegislature.gov\/bill_status\/bills_text.cfm?billdoc=HB2917%20INTR.htm&amp;yr=2021&amp;sesstype=RS&amp;i=2917\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"> <span data-term-id=\"59241600\">Save Women\u2019s Sports Act<\/span><\/a> and <span data-term-id=\"59241557\">Idaho<\/span>\u2019s<a href=\"https:\/\/legislature.idaho.gov\/wp-content\/uploads\/sessioninfo\/2020\/legislation\/H0500E1.pdf\" target=\"_blank\" rel=\"noopener noreferrer nofollow\"> Fairness in Women\u2019s Sports Act<\/a> required student-athletes to compete on sports teams according to their <span data-term-id=\"59241559\">sex assigned at birth<\/span>. The plaintiffs in both cases had argued that these restrictions violated the <span data-term-id=\"59241588\">equal protection clause<\/span> and <span data-term-id=\"59241554\">Title IX<\/span>.<\/p>\n<p>The Supreme Court upheld both states\u2019 laws. It doesn\u2019t require the states to adopt such restrictions.
