This constitutional protection forms the basis for civil rights protections.<\/p>\n\n\n\n<p>Federal anti-discrimination laws prohibit adverse actions based on protected characteristics, such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Race<\/li>\n\n\n\n<li>Religion<\/li>\n\n\n\n<li>National origin<\/li>\n\n\n\n<li>Disability<\/li>\n\n\n\n<li>Age<\/li>\n\n\n\n<li>Sex\/gender<\/li>\n<\/ul>\n\n\n\n<div><p>The<a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/fair-housing-federal-laws.html\"> Fair Housing Act<\/a> (Title VIII of the Civil Rights Act of 1968) prohibits sex discrimination in rentals, house sales, or financing. <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/sex-discrimination-in-education.html\">Title IX of the Education Amendments of 1972<\/a> bans sex discrimination in education programs that get federal funding.<\/p><\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Do Federal Discrimination Laws Cover LGBTQ Discrimination?<\/h3>\n\n\n\n<p>Federal non-discrimination laws do not expressly list sexual orientation and gender identity as protected classes for discrimination in employment, housing, and public accommodations.\u00a0 However, some <a href=\"https:\/\/www.findlaw.com\/civilrights\/discrimination\/gender-discrimination.html\">federal anti-discrimination laws<\/a> have been interpreted to protect members of the LGBTQ+ community from discrimination.<\/p>\n\n\n\n<p>For example, <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/title-vii-of-the-civil-rights-act-of-1964-equal-employment.html\">Title VII of the Civil Rights Act of 1964<\/a> of 1964 bans employment discrimination on the basis of sex. In <a href=\"https:\/\/supreme.findlaw.com\/supreme-court-insights\/bostock-v-clayton-county-case-summary-.html\" target=\"_blank\" rel=\"noopener\"><em>Bostock v. Clayton County<\/em> (2020)<\/a>, the U.S. Supreme Court held that sex discrimination in employment includes discrimination based on sexual orientation and gender identity.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">The Role of Executive Orders<\/h3>\n\n\n\n<p>Executive orders can play a role by directing federal agencies and contractors on how they should interpret existing discrimination laws. However, this can also lead to inconsistencies. For example:<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">State Law Protections<\/h2>\n\n\n\n<p>Federal law sets the \u201cfloor\u201d for discrimination protections. State laws must provide at least the same protection to their residents as the federal government. However, they can also go above and beyond the federal protections. Many states have done this by adding sexual orientation and gender identity to the protected classes in their discrimination laws. Individuals in these states who suffer discrimination in employment, housing, and public accommodations may file a complaint or civil suit.<\/p>\n\n\n\n<p>States will also often expand protections to cover additional parties. For example, federal employment discrimination law under Title VII applies to employers with 15 or more employees. But <a href=\"https:\/\/www.findlaw.com\/state\/california-law\/california-employment-laws.html\">California\u2019s employment discrimination law<\/a> applies to businesses with five or more employees. Illinois applies its anti-discrimination law to all employers (although some damage awards may require 15+ employees). In fact, most state anti-discrimination laws apply to <strong>all employers<\/strong>, regardless of size. This means that people who identify as transgender or <span data-term-id=\"59228699\">non-binary<\/span> may have a harder time making a legal claim for discrimination.<\/p>\n<p>The remaining states (shown in light blue on the map) have no explicit protections for those in the LGBTQ+ community.
