It can be as little as 24 hours or as long as a week. Whatever the specific requirements, all laws require:<\/p>\n<ul>\n<li>A specific notice period<\/li>\n<li>Requirements for what the notice must contain, such as an agenda or roster<\/li>\n<li>Locations where the notice must be posted<\/li>\n<li>Where and how notice of a closed meeting must be given<\/li>\n<li>Special rules for emergency meetings<\/li>\n<\/ul>\n<p>For instance, <a href=\"https:\/\/codes.findlaw.com\/mo\/title-xxxix-conduct-of-public-business\/mo-rev-st-610-020\/\" target=\"_blank\" rel=\"noopener\">Missouri requires 24 hours\u2019 notice<\/a> for a <span data-term-id=\"57173525\">public meeting<\/span>. The federal Sunshine Act requires one week\u2019s notice. <a href=\"https:\/\/codes.findlaw.com\/ca\/government-code\/gov-sect-54950\/\" target=\"_blank\" rel=\"noopener\">California\u2019s Ralph M. Brown Act<\/a> requires 72 hours&#8217; notice for a\u00a0<span data-term-id=\"57173573\">regular meeting<\/span> and 24 hours&#8217; notice for a <span data-term-id=\"57173565\">special meeting<\/span>, but this can be waived in an emergency.<\/p>\n<h2>Your Right To Attend <span data-term-id=\"57173525\">Public Meetings<\/span><\/h2>\n<p>Under the <span data-term-id=\"57173531\">First Amendment<\/span>, <span data-term-id=\"57173527\">members of the public<\/span> have the right to <a href=\"https:\/\/constitution.findlaw.com\/amendment1\/first-amendment-freedom-of-assembly-and-petition.html\" target=\"_blank\" rel=\"noopener\">peaceably assemble and petition the government<\/a> for redress. That includes going to <span data-term-id=\"57173525\">public meetings<\/span> <span data-term-id=\"57173549\">in person<\/span> and finding out how the government is administering. Your right to <span data-term-id=\"57173534\">free speech<\/span> means you cannot be excluded from <span data-term-id=\"57173530\">open meetings<\/span> or prevented from speaking, unless you\u2019re disruptive.<\/p>\n<p>Your <a href=\"https:\/\/constitution.findlaw.com\/amendment1.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57173531\">First Amendment<\/span> rights<\/a> guarantee you admittance to any government function open to the public. You cannot be excluded based on your opinions, prior criticism of the government, political party, or protected class.<\/p>\n<p>As a practical matter, <span data-term-id=\"57173540\">public officials<\/span> can control entry to a forum based on seating capacity or potential prejudice to a participant. For instance, judges may exclude individuals from the gallery if they believe it will be unfair to a defendant or hazardous to the jury.<\/p>\n<p>You cannot be denied access because of how you look, dress, or behave, provided it is within reason. For example, wearing clothes is not optional. The U.S. <span data-term-id=\"57173535\">Supreme Court<\/span> has long held that <span data-term-id=\"57173569\">reasonable <\/span><a href=\"https:\/\/dictionary.findlaw.com\/definition\/time-place-or-manner-restriction.html\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"57173569\">time<\/span>, place, and manner restrictions<\/a> are permitted in any public forum.<\/p>\n<p>You can be asked to leave or even forcibly removed for:<\/p>\n<ul>\n<li>Disrupting the meeting, such as shouting, making a <span data-term-id=\"57173558\">disruption<\/span>, or demonstrating in violation of posted rules<\/li>\n<li>Refusing to follow <span data-term-id=\"57173564\">reasonable rules<\/span> (such as rules against political attire or signs)<\/li>\n<li>Violent or threatening behavior<\/li>\n<li>Refusing to follow <span data-term-id=\"57173544\">time limits<\/span> during <span data-term-id=\"57173537\">public comment<\/span><span data-term-id=\"57173537\"> periods<\/span><\/li>\n<\/ul>\n<p>You cannot be removed because the <span data-term-id=\"57173559\">council members<\/span> don\u2019t like what you\u2019re saying or because you were mean to an elected official. Ejection and even arrest are possible for making threats, using profanity, or going over your <span data-term-id=\"57173544\">time limit<\/span>.<\/p>\n<h2>Speaking During <span data-term-id=\"57173537\">Public Comment<\/span><span data-term-id=\"57173537\"> Periods<\/span><\/h2>\n<p>Not all meetings have <span data-term-id=\"57173537\">public comment<\/span><span data-term-id=\"57173537\"> periods<\/span>. The meeting notice may contain an <span data-term-id=\"57173539\">agenda item<\/span> for <span data-term-id=\"57173526\">public comment<\/span> and state whether it will be \u201cgeneral comment\u201d or \u201citem-specific comment.\u201d The distinction is important because you may not make a general comment in an \u201citem-specific\u201d period. This is one time you may be told to stop talking and asked to leave.<\/p>\n<h3>The Process<\/h3>\n<p>Depending on the jurisdiction and type of meeting, you may need to sign up to speak. The committee or council may limit the\u00a0time for <span data-term-id=\"57173526\">public comment<\/span>.<\/p>\n<p>When you sign up to speak, you agree to any restrictions the forum imposes on public commenters. In some smaller forums, you may line up to speak, or be called in sign-up order. Larger forums may have other rules.<\/p>\n<p>Your right to speak is covered by the <span data-term-id=\"57173531\">First Amendment<\/span>, but so is the right of the forum to limit what you can say. In general, you can:<\/p>\n<ul>\n<li>Criticize officials, public policy, recent decisions<\/li>\n<li>Advocate for changes related to this forum or public agency<\/li>\n<li>Support or oppose items on the agenda<\/li>\n<li>Speak in a calm, reasonable manner<\/li>\n<\/ul>\n<p>You cannot:<\/p>\n<ul>\n<li>Make threats, use inciteful or <a href=\"https:\/\/www.findlaw.com\/injury\/torts-and-personal-injuries\/defamation-libel-slander.html\">defamatory speech<\/a> (false statements that harm someone&#8217;s reputation), or espouse hate speech<\/li>\n<li>Shout or make a scene<\/li>\n<li>Use excessive profanity<\/li>\n<li>Make comments unrelated to the <span data-term-id=\"57173561\">subject matter<\/span> of the meeting<\/li>\n<li>Go over the <span data-term-id=\"57173544\">time limit<\/span><\/li>\n<\/ul>\n<p>The <span data-term-id=\"57173528\">government body<\/span> cannot impose\u00a0<a href=\"https:\/\/constitution.findlaw.com\/amendment1\/content-and-viewpoint-based-regulation-of-speech.html\" target=\"_blank\" rel=\"noopener\">\u201ccontent-based\u201d restrictions<\/a>\u00a0that limit speech to what is favorable to a certain political party, candidate, religious group, or other category. They cannot limit speech they personally don\u2019t like or give extra time to supporters. For an example of how this should work, watch a Congressional subcommittee questioning a witness and observe how opposing parties request \u201ctheir time\u201d when a witness rambles or refuses to answer a question.<\/p>\n<p>To keep an <span data-term-id=\"57173530\">open meeting<\/span> moving, some reasonable limits are permitted. <span data-term-id=\"57173544\">Time limits<\/span> are allowed, as long as they are enforced and applied equally. <span data-term-id=\"57173525\">Public meetings<\/span> may also:<\/p>\n<ul>\n<li>Limit topics to government business or the agenda<\/li>\n<li>Request people refrain from discussing the state\u2019s governor or national politics<\/li>\n<li>Prohibit signs, props, political clothing, and anything that may block the audience&#8217;s view or create a disturbance<\/li>\n<li>Restrict repetitive comments on the same topic, especially if several people seem to have colluded to hammer on a single point<\/li>\n<li>Remove individuals who shout, make personal attacks, use excessive profanity, or go over their allotted time<\/li>\n<\/ul>\n<p>They may not:<\/p>\n<ul>\n<li>Ask you to leave because they don\u2019t like what you say (as long as it\u2019s factual)<\/li>\n<li>Tell you to stop talking before your allotted time is up<\/li>\n<li>Tell you to stop being mean to someone (criticism is allowed as long as it\u2019s not defamatory)<\/li>\n<\/ul>\n<p>The same rules should be applied to anyone who speaks, without favoritism.<\/p>\n<h2>How To Make <span data-term-id=\"57173526\">Public Comments<\/span><\/h2>\n<p>The old saying \u201ceveryone has an opinion\u201d has a cruder counterpart. To avoid having that punchline apply to you, prepare yourself before making a <span data-term-id=\"57173526\">public comment<\/span> with a few simple steps.<\/p>\n<h3>Before the Meeting<\/h3>\n<p>Review the <span data-term-id=\"57173555\">meeting agenda<\/span> and what the speakers are discussing. If there are rules for the <span data-term-id=\"57173526\">public comment<\/span> session, such as <span data-term-id=\"57173544\">time limits<\/span> and comment restrictions, know what they are. If you plan to speak on a specific issue or policy matter, bring documentation and notes. Arrive early if there is a sign-up list.<\/p>\n<p>During the meeting, listen carefully to the speakers and take notes as needed. Making a comment about something already reviewed in the body of the meeting is unlikely to be well received.<\/p>\n<h3>During the <span data-term-id=\"57173537\">Public Comment<\/span><span data-term-id=\"57173537\"> Period<\/span><\/h3>\n<p>Listen while others speak. If someone makes your comment or something substantially similar, either bow out or rephrase your comment. Don\u2019t repeat the comment, as you may be asked to sit down.<\/p>\n<p>State your name and other identifying information if required. Speak clearly and slowly, and avoid shouting, name-calling, and finger-pointing. If you have concerns about what has been said or done, reference that specifically. Don\u2019t make vague generalizations. Stating that there are five unhoused people who hang around the convenience store near your house and asking how the town can help is better than grousing about \u201cthe homeless problem\u201d and demanding a solution.<\/p>\n<p>When your time is up, it\u2019s up. Even if you didn\u2019t get to say everything you wanted to, thank the board for their time and leave.<\/p>\n<h3>How To Make Your Comments Stand Out<\/h3>\n<p><span data-term-id=\"57173526\">Public comments<\/span> should not consist of yelling at the opposition because you disagree or blindly agreeing with the side you approve of. The best ways to get your comments heard and to make an impact include:<\/p>\n<ul>\n<li>Make specific suggestions and requests rather than general comments. If possible, link your statements to actions that have already been taken or not taken.<\/li>\n<li>Acknowledge good efforts and offer critiques of less-than-successful efforts. For example, instead of \u201cthat homeless shelter cost millions and didn\u2019t work, what a waste of time,\u201d you could suggest \u201ccould that shelter be repurposed into something else, so it doesn\u2019t just sit there?\u201d<\/li>\n<li>Use local data and examples rather than anecdotes. Personal observations are good when you\u2019re at a <span data-term-id=\"57173553\">city council<\/span><span data-term-id=\"57173553\"> meeting<\/span>. \u201cI live on Second Street behind the high school. Can anything be done about the football field lights? They\u2019re shining right into the front windows of both my and my neighbors\u2019 houses.\u201d<\/li>\n<li>Acknowledge other viewpoints and other comments. Don\u2019t attack other speakers for having differing opinions (\u201cThat\u2019s really stupid\u201d), but use them for educational purposes by offering gentle corrections.<\/li>\n<\/ul>\n<p>The more often you attend local meetings, the more the board members and <span data-term-id=\"57173559\">councilmembers<\/span> will listen to your remarks. Be sure to thank officials for replying, even if they disagree. Take time to talk with others in your community who share your viewpoints, and don\u2019t forget to build bridges with those who seem to disagree. They live there too.<\/p>\n<h2>Recording <span data-term-id=\"57173525\">Public Meetings<\/span><\/h2>\n<p>You may have the right to record <span data-term-id=\"57173525\">public meetings<\/span>, with limitations. When and where this right applies depends largely on your state laws and the type of meeting you want to record.<\/p>\n<p>Recording is often prohibited or restricted in courtrooms and legal proceedings, though rules vary by jurisdiction and court type. Check the specific court&#8217;s rules before attempting to record any legal proceeding. There may also be rules against recording where participants have a reasonable expectation of privacy. People can and do discriminate, throw out opposing political parties, and shut down commenters who say mean things about their favorite politician. What are your rights if something happens at a <span data-term-id=\"57173525\">public meeting<\/span>?<\/p>\n<h3>If You\u2019re Removed From the Meeting<\/h3>\n<p>If you\u2019re told to leave or physically removed from the meeting:<\/p>\n<ul>\n<li>Do not physically resist. When you\u2019re told to go, go. You can argue about your <span data-term-id=\"57173531\">First Amendment<\/span> rights in court, but unless you\u2019re willing to go to jail first, it\u2019s better to leave on your feet.<\/li>\n<li>If you have a recording device, now is the time to use it. Note that it will not be admissible in court. If you cannot record, make careful mental notes of who says what.<\/li>\n<li>Ask why you are being removed.
