Debt buyers who purchase accounts and collect for their own benefit, rather than on behalf of another party, may also fall outside <span data-term-id=\"58701371\">FDCPA<\/span> coverage. In <a href=\"https:\/\/caselaw.findlaw.com\/court\/us-supreme-court\/16-349.html\" target=\"_blank\" rel=\"noopener\"><em>Henson v. Santander Consumer USA Inc.<\/em> (2017)<\/a>, the U.S. Supreme Court ruled unanimously that a company purchasing defaulted debts and collecting on them for its own account is not a &#8220;<span data-term-id=\"58701368\">debt collector<\/span>&#8221; under the <span data-term-id=\"58701371\">FDCPA<\/span>, as it is not collecting debts owed to another party.<\/p>\n<p>The law protects you from abusive collection practices for personal, family, or household debts. This includes <span data-term-id=\"58701374\">credit cards<\/span>, <span data-term-id=\"58701406\">medical bills<\/span>, car loans, <span data-term-id=\"58701379\">student loans<\/span>, and mortgages. It does not apply to business debts.<\/p>\n<p>Many states have their own debt collection laws that may provide you with additional protection. For example,\u00a0<a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displayText.xhtml?lawCode=CIV&amp;division=3.&amp;title=1.6C.&amp;part=4.&amp;chapter=&amp;article=1.\" target=\"_blank\" rel=\"noopener\">California\u2019s Rosenthal Act<\/a>\u00a0applies similar rules to <span data-term-id=\"58701372\">original creditors<\/span>. Your rights can depend on both federal and <span data-term-id=\"58701387\">state law<\/span>, depending on where you live.<\/p>\n<p>Other <span data-term-id=\"58701377\">federal laws<\/span>, such as the\u00a0<a href=\"https:\/\/www.aba.com\/banking-topics\/compliance\/acts\/telephone-consumer-protection-act\" target=\"_blank\" rel=\"noopener\">Telephone Consumer Protection Act (TCPA)<\/a>, restrict autodialed or prerecorded calls and texts to your cell phone without your prior express consent. State consumer protection laws may also give you additional remedies.<\/p>\n<h2>Things <span data-term-id=\"58701368\">Debt Collectors<\/span> Can\u2019t Do<\/h2>\n<p>Most <span data-term-id=\"58701368\">debt collectors<\/span> follow the law, but some use illegal tactics. The\u00a0<a href=\"https:\/\/codes.findlaw.com\/us\/title-15-commerce-and-trade\/15-usc-sect-1692\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58701371\">FDCPA<\/span><\/a>\u00a0makes it unlawful for collectors to do any of the following:<\/p>\n<ul>\n<li>Lie about your debt or pretend to be an attorney<\/li>\n<li>Threaten you with arrest or actions they cannot legally take<\/li>\n<li>Call before 8 a.m. or after 9 p.m. in your time zone<\/li>\n<li>Publish or advertise your debt in order to shame or pressure you into paying<\/li>\n<li>Use obscene or profane language<\/li>\n<li>Threaten violence or harm<\/li>\n<li>Call repeatedly to harass you<\/li>\n<li>Contact you at work if the collector knows or has reason to know that your employer does not permit such calls<\/li>\n<li>Contact your family, friends, neighbors, or coworkers about your debt, except to locate you<\/li>\n<li>Claim you have committed a crime<\/li>\n<li>Threaten to sue unless they actually intend to file a lawsuit<\/li>\n<li>Add unauthorized fees or interest<\/li>\n<li>Deposit <span data-term-id=\"58701409\">post-dated checks<\/span> early<\/li>\n<li>Send documents that look like court or <span data-term-id=\"58701404\">government agency<\/span> papers<\/li>\n<li>Discuss your debt with third parties, including disclosing to others that you owe a debt, outside of narrow statutory exceptions such as contacting a consumer reporting agency or communicating with your own attorney<\/li>\n<\/ul>\n<p>It\u2019s important to be aware of what collectors aren\u2019t permitted to do. Knowing your rights under the <span data-term-id=\"58701371\">FDCPA<\/span> not only limits what collectors can do, but also lets you know when they\u2019ve gone too far.<\/p>\n<h2>Right to Debt <span data-term-id=\"58701402\">Validation<\/span><\/h2>\n<p>Unless the required information was already included, the <span data-term-id=\"58701368\">debt collector<\/span>\u00a0should send you a <span data-term-id=\"58701376\">written\u00a0<\/span><a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-finances\/debt-collection.html\"><span data-term-id=\"58701376\">notice<\/span><\/a>\u00a0within five days of initial contact. <a href=\"https:\/\/codes.findlaw.com\/us\/title-15-commerce-and-trade\/15-usc-sect-1692g\/\" target=\"_blank\" rel=\"noopener\">This notice should include<\/a>:<\/p>\n<ul>\n<li>The <span data-term-id=\"58701382\">amount of the debt<\/span> owed<\/li>\n<li>The <span data-term-id=\"58701411\">name of the creditor<\/span><\/li>\n<li>A statement that you have 30 days to dispute the debt<\/li>\n<li>A statement that the collector will provide verification if you dispute the debt in writing within that period<\/li>\n<li>A statement that the collector will provide the <span data-term-id=\"58701372\">original creditor<\/span>\u2019s name and address upon written request within the 30-day window<\/li>\n<\/ul>\n<p>On November 30, 2021, the <a href=\"https:\/\/www.ecfr.gov\/current\/title-12\/chapter-X\/part-1006\/subpart-B\/section-1006.34\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58701383\">CFPB<\/span>&#8216;s Regulation F<\/a> expanded these requirements to include additional information identifying the debt. It should also include an itemization date and a notice that more information about consumer protections is available at the\u00a0<a href=\"https:\/\/www.consumerfinance.gov\/consumer-tools\/debt-collection\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58701383\">CFPB<\/span>&#8216;s website<\/a>.<\/p>\n<p>If you file a written dispute of the debt within 30 days, the collector should cease collection until they send verification or a copy of a judgment. Courts say verification means more than just repeating the amount owed, even though the law does not define it. Collectors who keep trying to collect without sending this documentation are breaking <span data-term-id=\"58701377\">federal law<\/span>.<\/p>\n<p>You can still dispute a debt after 30 days, but only those made within the window require the collector to pause collection. Missing the deadline does not mean you admit you owe the debt.<\/p>\n<p>To request <span data-term-id=\"58701402\">validation<\/span>, send a formal <span data-term-id=\"58701396\">dispute letter<\/span> by <span data-term-id=\"58701391\">certified mail<\/span> with <span data-term-id=\"58701405\">return receipt<\/span>. In your letter, state that you are disputing the debt and request <span data-term-id=\"58701402\">validation<\/span> under the\u00a0<a href=\"https:\/\/www.ftc.gov\/legal-library\/browse\/rules\/fair-debt-collection-practices-act-text\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58701371\">FDCPA<\/span><\/a>. Keep a copy for your records.<\/p>\n<h2>Right To Stop Contact<\/h2>\n<p>You have the right to demand in writing that a <span data-term-id=\"58701368\">debt collector<\/span> stop all communications with you. Once the collector receives your written request.it must stop contacting you. There are three narrow exceptions. The collector may still reach out to advise you that collection efforts are ending, to notify you that certain remedies may be invoked, or to inform you that a specific remedy is being pursued.<\/p>\n<p>Sending a cease communication letter does not erase the debt. The collector can still engage in <span data-term-id=\"58701381\">credit reporting<\/span> to bureaus, sue you, or take other legal collection steps. It will stop the calls and letters.<\/p>\n<h2>Right to Privacy<\/h2>\n<p>In general, <span data-term-id=\"58701368\">debt collectors<\/span> <a href=\"https:\/\/codes.findlaw.com\/us\/title-15-commerce-and-trade\/15-usc-sect-1692c\/\" target=\"_blank\" rel=\"noopener\">can\u2019t discuss your debt<\/a> with others or third parties. There are only narrow exceptions to this, such as contacting your attorney, a consumer reporting agency, the creditor, or the creditor&#8217;s attorney. Telling neighbors, coworkers, or family members about your debt is an <span data-term-id=\"58701371\">FDCPA<\/span> violation.<\/p>\n<h2>Right To Limit How They Contact You<\/h2>\n<p>You also have more control over how collectors contact you under the\u00a0<a href=\"https:\/\/www.ecfr.gov\/current\/title-12\/chapter-X\/part-1006\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58701370\">Consumer Financial Protection Bureau<\/span>&#8216;s Regulation F<\/a>.\u00a0Collectors are presumed to violate the law if they place more than seven <span data-term-id=\"58701389\">phone calls<\/span> to you within a seven-day period about a particular debt, or place a call within seven days after speaking with you about that debt. This presumption applies to <span data-term-id=\"58701389\">phone calls<\/span>. Texts, emails, and <span data-term-id=\"58701388\">social media<\/span> messages are subject to separate rules under Regulation F, including opt-out requirements and the general prohibition on harassing or oppressive conduct.<\/p>\n<h2>Right To Sue for Violations<\/h2>\n<p>If a collector violates any provision of the <span data-term-id=\"58701371\">FDCPA<\/span>, you have the right to bring a private lawsuit in state or federal court.<\/p>\n<h2>How To Stop <span data-term-id=\"58701368\">Debt Collectors<\/span> From Contacting You<\/h2>\n<p>If a <span data-term-id=\"58701368\">debt collector<\/span> calls you too often, uses threats or abusive language, or tries to collect a debt resulting from <span data-term-id=\"58701394\">identity theft<\/span>, you have legal options.<\/p>\n<h3>Write a Cease Communication Letter<\/h3>\n<p>The first step is to send the collector a letter telling them to stop contacting you. Under the <span data-term-id=\"58701371\">FDCPA<\/span>, the collector must comply after receiving your letter. However, this is subject to the three narrow exceptions described above.<\/p>\n<p>The letter doesn\u2019t erase the debt. The collector can still sue you, report the debt to credit bureaus, or take other legal steps. You will still need to deal with the debt by paying it, disputing it, settling it, or considering bankruptcy.<\/p>\n<h3>Document All Contact<\/h3>\n<p>Keep a record of every contact from collectors, as documenting all <span data-term-id=\"58701400\">debt collector<\/span><span data-term-id=\"58701400\"> contacts<\/span> is vital for your case. Write down the date, time, who contacted you, what was said or written, and if anyone else was present.<\/p>\n<p>You may also want to record calls. In most states, you can record a call you are part of without telling the other person. Some states require everyone on the call to agree. Check your <span data-term-id=\"58701387\">state\u2019s laws<\/span> before recording.<\/p>\n<h2>Will <span data-term-id=\"58701368\">Debt Collectors<\/span> Take You to Court?<\/h2>\n<p>A <span data-term-id=\"58701368\">debt collector<\/span> can sue you to collect an unpaid debt. Lawsuits are usually a last resort, but can happen if you don\u2019t respond to earlier contact. Under the <span data-term-id=\"58701371\">FDCPA<\/span>, a collector can only sue you in the state where you live or where you signed the contract.<\/p>\n<h2>The <span data-term-id=\"58701398\">Statute of Limitations<\/span><\/h2>\n<p>Every state sets a deadline for how long a collector can sue you for an unpaid debt. After that time has passed, the debt is &#8220;time-barred,&#8221; and the collector can\u2019t obtain a court judgment. The deadline is usually three to six years, but some states allow more time.<\/p>\n<p>If you make a payment or admit in writing that you owe an old debt, you may restart the <span data-term-id=\"58701398\">statute of limitations<\/span> in many states. Be careful about what you say or sign if a collector contacts you about an old debt.<\/p>\n<p>Suing or threatening to sue on a time-barred debt is itself an <span data-term-id=\"58701371\">FDCPA<\/span> violation. If you do not raise the <span data-term-id=\"58701398\">statute of limitations<\/span> as a defense in court, a judge may still enter a judgment against you. Ignoring a lawsuit is never a safe strategy.<\/p>\n<h2>What Happens if You\u2019re Sued<\/h2>\n<p>If a collector sues you, you\u2019ll receive court papers that list the debt, the amount claimed, and your deadline to respond. You may have as little as 20 to 30 days to reply.<\/p>\n<p>Don\u2019t ignore a lawsuit. If you don\u2019t respond, the court will likely enter a default judgment. A judgment lets the collector <span data-term-id=\"58701375\">garnish<\/span> your wages or take money from your <span data-term-id=\"58701378\">bank account<\/span>.<\/p>\n<p><span data-term-id=\"58701377\">Federal law<\/span> caps how much a collector can take from your paycheck. The limit is whichever is lower: 25% of your weekly disposable earnings, or the portion of your weekly disposable earnings that exceeds 30 times the federal minimum wage. Some states impose lower limits. Certain income and property is also exempt from collection under federal and <span data-term-id=\"58701387\">state law<\/span>, including many federal benefits such as <span data-term-id=\"58701384\">Social Security<\/span>, disability payments, and veterans&#8217; benefits.<\/p>\n<h2>If You Are \u201cJudgment Proof\u201d<\/h2>\n<p>If you have no income or assets that collectors can reach, you may be &#8220;judgment proof.&#8221; Even if a collector wins in court, they may not be able to collect anything from you. Judgments can last for years, so this status may change if your finances improve. Consider speaking with a <a href=\"https:\/\/lawyers.findlaw.com\/consumer-protection\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">consumer law attorney<\/a> if you think this applies to you.<\/p>\n<h2>How Bankruptcy Can Stop a Lawsuit<\/h2>\n<p>Filing for bankruptcy puts an automatic stay in place. This court order stops most <span data-term-id=\"58701403\">collection activity<\/span> right away, including lawsuits, wage <span data-term-id=\"58701375\">garnishments<\/span>, and calls from collectors. Depending on the type of bankruptcy, you may be able to erase the debt or set up a repayment plan.<\/p>\n<h2>What To Do if a <span data-term-id=\"58701368\">Debt Collector<\/span> Violates Your Rights<\/h2>\n<p>If a collector crosses the line, you have several options. You can report the conduct to federal and state agencies, or take the collector to court.<\/p>\n<h3>File a Complaint With the <span data-term-id=\"58701386\">FTC<\/span> and the <span data-term-id=\"58701383\">CFPB<\/span><\/h3>\n<p>You can file a complaint online with the <span data-term-id=\"58701380\">Federal Trade Commission<\/span> (<span data-term-id=\"58701386\">FTC<\/span>) and the <a href=\"https:\/\/www.consumerfinance.gov\/about-us\/the-bureau\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58701370\">Consumer Financial Protection Bureau<\/span> (<span data-term-id=\"58701383\">CFPB<\/span>)<\/a>. Include the <span data-term-id=\"58701373\">collection agency<\/span>\u2019s name and address, the <span data-term-id=\"58701372\">original creditor<\/span>\u2019s name, dates and times of contact, names of witnesses, and copies of any letters or recordings. These agencies do not resolve individual cases, but your complaint helps them spot patterns and take action against violators.<\/p>\n<h3>File a Complaint With Your <span data-term-id=\"58701399\">State Attorney General<\/span><\/h3>\n<p>Send a complaint to your <span data-term-id=\"58701399\">state <\/span><span data-term-id=\"58701385\">attorney general<\/span><span data-term-id=\"58701385\">\u2019s office<\/span> or consumer protection office. Send copies to the <span data-term-id=\"58701373\">collection agency<\/span> and the <span data-term-id=\"58701372\">original creditor<\/span>. This process can take time and results will vary, but filing a complaint creates a record and may make collectors change their behavior.<\/p>\n<h3>Sue the <span data-term-id=\"58701368\">Debt Collector<\/span><\/h3>\n<p>You also have the right to sue a collector that violates the <span data-term-id=\"58701371\">FDCPA<\/span>. This is a strict liability law, meaning you do not need to prove actual harm to recover damages.<\/p>\n<p>You have one year from the violation to file a lawsuit in state or federal court. A successful <span data-term-id=\"58701371\">FDCPA<\/span> lawsuit can result in statutory damages of up to $1,000, reimbursement for proven losses such as missed work or emotional harm, and recovery of your legal fees and filing costs.<\/p>\n<p>If you lose and the court finds you sued in bad faith or to harass the collector, you may have to pay their attorney\u2019s fees and costs. Winning an <span data-term-id=\"58701371\">FDCPA<\/span> lawsuit does not erase the debt itself. You still owe the debt, even if the collector broke the law.<\/p>\n<h2>Get Legal Help With Debt Collection Issues<\/h2>\n<p>Debt collection laws are complex, and your rights depend on your state.
