The actual truth about AI <span data-term-id=\"59271794\">hiring<\/span> systems and <span data-term-id=\"59271831\">computer-based assessments<\/span> is harder to find.<\/p>\n<p><span data-term-id=\"59271796\">Automated decision systems<\/span> (ADS) and the use of <span data-term-id=\"59271805\">algorithms<\/span> in the <span data-term-id=\"59271794\">hiring<\/span> process have been around longer than the current AI debate. Keyword trackers have been in use since before the internet. Since the late 1980s, with Resumix and applicant tracking systems (ATS), employers have used the latest technology to screen applicants efficiently.<\/p>\n<p>Objections over the use of ADS programs often focus on the lack of <span data-term-id=\"59271830\">human oversight<\/span>. It increasingly seems to job-seekers that <a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/what-are-my-legal-rights-when-employers-use-ai-in-hiring.html\">human beings are being left out of the process<\/a>, making <span data-term-id=\"59271803\">employment discrimination<\/span> harder to detect. California has clarified that its existing <span data-term-id=\"59271803\">employment-discrimination<\/span> law applies when employers use <span data-term-id=\"59271796\">automated decision systems<\/span> in <span data-term-id=\"59271794\">hiring<\/span> and other workplace decisions.<\/p>\n<p>In this article, we\u2019ll look at the current landscape of AI <span data-term-id=\"59271794\">hiring<\/span> laws in California. If you believe you\u2019ve already been a victim of illegal AI-based <span data-term-id=\"59271794\">hiring<\/span> discrimination, consider speaking with a <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/california\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">local employment law attorney<\/a> to assess your specific situation.<\/p>\n<h2>California&#8217;s AI <span data-term-id=\"59271794\">Hiring<\/span> Rules<\/h2>\n<p>California primarily addresses AI in <span data-term-id=\"59271794\">hiring<\/span> through its powerful <a href=\"https:\/\/www.dor.ca.gov\/Home\/FairEmploymentAct\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"59271799\">Fair Employment and Housing Act<\/span><\/a> (<span data-term-id=\"59271797\">FEHA<\/span>). The <span data-term-id=\"59271801\">California Civil Rights Council<\/span> has confirmed that <span data-term-id=\"59271797\">FEHA<\/span>&#8216;s anti-discrimination protections apply to all <span data-term-id=\"59271796\">automated decision systems<\/span> (ADS) and AI tools.<\/p>\n<p>This means employers in California:<\/p>\n<ul>\n<li><strong>Cannot use discriminatory systems<\/strong>: Employers and other covered entities may not use an ADS or <span data-term-id=\"59271813\">selection criteria<\/span> that discriminates against applicants or employees based on a characteristic protected by <span data-term-id=\"59271797\">FEHA<\/span><\/li>\n<li><strong>May need to provide accommodations<\/strong>: An employer may need to offer <span data-term-id=\"59271811\">reasonable accommodation<\/span> where an automated assessment or screening process disadvantages an applicant because of a disability, religious practice, or another protected basis<\/li>\n<li><strong>Cannot use unlawful screening questions or tests<\/strong>: Automated tools cannot be used to ask <a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/can-i-sue-for-illegal-interview-questions.html\">otherwise illegal <span data-term-id=\"59271794\">hiring<\/span> questions<\/a> through games, puzzles, or any other assessment that is likely to elicit disability-related information<\/li>\n<li><strong>Must comply with <span data-term-id=\"59271829\">recordkeeping requirements<\/span><\/strong>: Covered employers and entities must retain certain personnel and employment records (including applications, <span data-term-id=\"59271813\">selection criteria<\/span>, and ADS data) for four years from the later of the record\u2019s creation or the related personnel action<\/li>\n<\/ul>\n<p>Some AI-<span data-term-id=\"59271794\">hiring<\/span> tools may also raise questions under consumer-reporting law. In a 2026 <a href=\"https:\/\/www.classaction.org\/media\/kistler-et-al-v-eightfold-ai-inc-complaint.pdf\" target=\"_blank\" rel=\"noopener\">proposed class action lawsuit<\/a>, job applicants alleged that Eightfold AI created applicant evaluations that qualify as consumer or investigative consumer reports under federal law and California\u2019s Investigative Consumer Reporting Agencies Act. As of August 2026, litigation is ongoing.<\/p>\n<h3><span data-term-id=\"59271802\">Anti-Bias Testing<\/span> and AI <span data-term-id=\"59271794\">Hiring<\/span><\/h3>\n<p>California\u2019s AI-employment rules don\u2019t require every employer to conduct a formal, independent <span data-term-id=\"59271806\">bias audit<\/span> before using an automated <span data-term-id=\"59271794\">hiring<\/span> tool. They have the option to show they\u2019ve made an effort to test for and prevent discrimination, which may benefit them in a legal dispute. Under <span data-term-id=\"59271797\">FEHA<\/span>\u00a0regulations, a court or agency may consider evidence (or the lack thereof) of <span data-term-id=\"59271802\">anti-bias testing<\/span> or similar efforts to prevent unlawful discrimination.<\/p>\n<p>Useful reviews can examine whether the system disproportionately screens out applicants based on a characteristic protected by <span data-term-id=\"59271797\">FEHA<\/span>, such as race, sex, age, disability, religion, national origin, or another <span data-term-id=\"59271812\">protected characteristic<\/span>. Employers may also ask vendors for documentation about:<\/p>\n<ul>\n<li>How the tool was tested<\/li>\n<li>What data it uses<\/li>\n<li>How the vendor addresses identified bias risks<\/li>\n<\/ul>\n<p>A third-party vendor may also face liability where it qualifies as an employer\u2019s agent or otherwise falls within <span data-term-id=\"59271797\">FEHA<\/span>\u2019s coverage.<\/p>\n<h3>Executive Order N-6-26<\/h3>\n<p>California is also studying how <span data-term-id=\"59271795\">artificial intelligence<\/span> may reshape employment beyond individual <span data-term-id=\"59271794\">hiring<\/span> decisions. On May 21, 2026, Governor Gavin Newsom issued <a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2026\/05\/5.21.26-AI-Workforce-EO-FINAL-SIGNED.pdf\" target=\"_blank\" rel=\"noopener\">Executive Order N-6-26<\/a>, which directs state agencies to examine AI-driven workforce disruption and recommend policies to help workers and businesses.<\/p>\n<p>Executive Order N-6-26 doesn\u2019t create new legal duties for private employers, establish an applicant right to human review, or provide a new individual legal claim for <a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/what-are-my-legal-rights-when-employers-use-ai-in-hiring.html\">AI-related <span data-term-id=\"59271794\">hiring<\/span> discrimination<\/a>. Instead, it directs state agencies to collect information and develop recommendations that could inform future legislation or regulations.<\/p>\n<h3>Mobley v. Workday, Inc.<\/h3>\n<p>The issue of bias and use of AI in <span data-term-id=\"59271810\">screening resumes<\/span> is being litigated in <a href=\"https:\/\/www.courtlistener.com\/docket\/66831340\/47\/mobley-v-workday-inc\/\" target=\"_blank\" rel=\"noopener\"><em>Mobley v. Workday, Inc<\/em><\/a><em>.<\/em> The plaintiffs allege that Workday\u2019s applicant-screening technology and related <span data-term-id=\"59271794\">hiring<\/span> products violate <span data-term-id=\"59271808\">anti-discrimination laws<\/span>, unlawfully screening out disadvantaged applicants based on <span data-term-id=\"59271812\">protected characteristics<\/span>, including age, race, sex, and disability. The litigation raises the question of when an AI-<span data-term-id=\"59271794\">hiring<\/span> vendor may be liable as an employer\u2019s agent or under other <span data-term-id=\"59271803\">employment-discrimination<\/span> theories.<\/p>\n<p>In a June 22, 2026 ruling, the court allowed substantial portions of the plaintiffs\u2019 amended discrimination claims to proceed. As of August 2026, no liability finding, settlement, or final judgment has occurred.<\/p>\n<p>The larger issue is the <span data-term-id=\"59271809\">machine-learning<\/span>\u00a0process that generates AI <span data-term-id=\"59271805\">algorithms<\/span>. AI learns through assessing previous records. If a company has a long history of <span data-term-id=\"59271794\">hiring<\/span> individuals from certain locations or from certain colleges, the AI will prioritize those locations and colleges, even if no bias is intended. This can cause <a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/disparate-impact-discrimination.html\"><span data-term-id=\"59271804\">disparate impact<\/span><\/a> even without discriminatory intent.<\/p>\n<h3><span data-term-id=\"59271804\">Disparate Impact<\/span> vs. Discriminatory Intent<\/h3>\n<p><a href=\"https:\/\/calcivilrights.ca.gov\/2025\/06\/30\/civil-rights-council-secures-approval-for-regulations-to-protect-against-employment-discrimination-related-to-artificial-intelligence\/\" target=\"_blank\" rel=\"noopener\">The <span data-term-id=\"59271801\">California Civil Rights Council<\/span> recognized<\/a> that the greater danger with AI tools was not intentional bias, but disparate and possibly unconscious impacts caused by inadequate AI training. For instance, no employer will say \u201cOnly hire employees under the age of 30,\u201d but may say \u201csort resumes by date of college graduation.\u201d Doing so may disproportionately disadvantage older applicants. That result can create age-discrimination risk, particularly if the employer cannot show that the criterion is job-related and legally justified.<\/p>\n<p>\u201cKnockout\u201d questions can also create legal risk. These may be lawful questions designed to eliminate applicants who are not qualified for business reasons. \u201cWill you relocate if required?\u201d is a legitimate question, since moving may be a <span data-term-id=\"59271825\">business necessity<\/span>. However, an employer can\u2019t ask disability-related questions, including whether an applicant will need a <span data-term-id=\"59271811\">reasonable accommodation<\/span>, before making a conditional job offer. A knockout question about accommodations could violate\u00a0<span data-term-id=\"59271808\">anti-discrimination laws<\/span>.<\/p>\n<h3>Upcoming Legislation: The \u201cNo Robo Bosses Act\u201d<\/h3>\n<p>California\u2019s first \u201cNo Robo Bosses Act,\u201d Senate Bill 7, passed the state legislature in 2025, but Governor Gavin Newsom vetoed it. <a href=\"https:\/\/www.gov.ca.gov\/wp-content\/uploads\/2025\/10\/SB-7-Veto.pdf\" target=\"_blank\" rel=\"noopener\">In his veto message<\/a>, Newsom said the bill\u2019s restrictions on workplace AI were overly broad and overlapped in part with protections already available under California employment law.<\/p>\n<p>Lawmakers introduced a follow-up measure, Senate Bill 947, in 2026 under the same name. <a href=\"https:\/\/sd05.senate.ca.gov\/news\/ca-senate-approves-no-robo-bosses-act-2026-ensure-human-oversight-ai-workplace\" target=\"_blank\" rel=\"noopener\">It passed the California Senate in May 2026<\/a> and remains under consideration in the Assembly. SB 947 is primarily a workplace-management bill. Its proposed restrictions focus on employers\u2019 use of ADS in decisions affecting existing workers, particularly discipline, discharge, and deactivation.<\/p>\n<p>If enacted in its current form, SB 947 would limit employers\u2019 use of an ADS in workplace decisions. Among other things, it would:<\/p>\n<ul>\n<li>Prohibit <span data-term-id=\"59271823\">California employers<\/span> from relying solely on an automated system for <span data-term-id=\"59271827\">employment decision-making<\/span> (including decisions to fire, discipline, or deactivate a worker)<\/li>\n<li>Require <span data-term-id=\"59271830\">human oversight<\/span> and independent verification when an automated system helps inform a termination or disciplinary decision<\/li>\n<li>Restrict use of automated systems to predict a worker\u2019s behavior, beliefs, intentions, personality, emotional state, or other personal characteristics<\/li>\n<li>Restrict systems that infer <span data-term-id=\"59271812\">protected characteristics<\/span> or use automated analysis to retaliate against workers for exercising legal rights<\/li>\n<li>Require notice to workers when an automated system was used in certain termination or disciplinary decisions<\/li>\n<li>Create potential enforcement mechanisms, including Labor Commissioner enforcement and private actions by workers or their representatives<\/li>\n<\/ul>\n<p>SB 947 addresses the workplace treatment of current workers. It wouldn\u2019t create a general right for job applicants to opt out of AI-based resume screening, or require every employer to disclose every use of AI in <span data-term-id=\"59271794\">hiring<\/span>. Applicants\u2019 existing protections against discriminatory AI screening instead come principally from the <span data-term-id=\"59271814\">California <\/span><span data-term-id=\"59271799\">Fair Employment and Housing Act<\/span> and the AI-related <span data-term-id=\"59271797\">FEHA<\/span> regulations.<\/p>\n<h2>What This Means for California Job-Seekers<\/h2>\n<p>It\u2019s difficult to tell whether an employer used an automated system in a <span data-term-id=\"59271794\">hiring<\/span> decision. California\u2019s <span data-term-id=\"59271797\">FEHA<\/span> rules prohibit the discriminatory use of those systems. They don\u2019t grant every applicant a general right to learn of, opt out of, or obtain a human review of AI-based screening.<\/p>\n<p>California job applicants should keep some things in mind when applying for work online. Other states aren\u2019t bound by California regulations. Whether <a href=\"https:\/\/www.findlaw.com\/state\/california-law\/california-employment-laws.html\">California employment law<\/a> applies can depend on the employer\u2019s California connections, where the relevant <span data-term-id=\"59271794\">hiring<\/span> conduct occurred, and the applicant\u2019s circumstances. If you\u2019re outside California, don\u2019t assume its state laws apply.<\/p>\n<p>Even companies <span data-term-id=\"59271794\">hiring<\/span> in-state may have HR departments <span data-term-id=\"59271800\">recruiting<\/span> remotely. Your resume may be processed by someone on the East Coast or overseas.<\/p>\n<p>With this in mind, keep your eyes open for these warning signs:<\/p>\n<ul>\n<li>Resumes that are declined immediately or at odd hours or days<\/li>\n<li>Form emails that misspell your name or the job title in the same way it was misspelled on the job listing<\/li>\n<li>Privacy notices or opt-out notices, especially for California-based employers<\/li>\n<li><span data-term-id=\"59271807\">Job advertisements<\/span> that ask dubious questions about accommodations or current location<\/li>\n<\/ul>\n<p>If you have the option to ask the employer questions, inquire about their AI use, or ask if a human reviews the AI\u2019s decision.<\/p>\n<h2>If You Believe You\u2019ve Been Discriminated Against<\/h2>\n<p>In California, you can file a complaint against an employer with the <a href=\"https:\/\/calcivilrights.ca.gov\/complaintprocess\/how-to-file-a-complaint\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"59271815\">California Civil Rights Department<\/span> <\/a>(<span data-term-id=\"59271832\">CRD<\/span>). AI-related <span data-term-id=\"59271794\">hiring<\/span> discrimination is actionable, even if the bias was not intentional. For employment cases, you have three years from the date you were injured or affected. Consider contacting a California civil rights or <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/california\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">employment law attorney<\/a> for legal advice on your case. An attorney can explain the types of evidence you\u2019ll need for your claim.<\/p>\n<p>Collect as much evidence as possible about your case. You may find complaints on LinkedIn or Reddit about the platform or employer.<\/p>\n<p>You may discover an employer used an AST. Preserve any information about the vendor, the criteria used, and whether the employer describes testing the tool for bias.
