Instead, the trustee negotiates a repayment plan for what you owe. This plan will last anywhere from three to five years, depending on how much debt you have and what you can afford to pay each month. After successfully completing your repayment plan, non-priority unsecured debts are discharged.

Creditors must update your debts. If you completed a Chapter 7 filing, your creditors must report your debt as discharged. If you filed Chapter 13 and are in the middle of your repayment plan, creditors must update your credit report to reflect this fact.

Not all creditors report accounts the way they’re supposed to. If your creditors continue to report your debts as late or charged off, they are violating several laws.

This article examines and explains what creditors are required to do once your bankruptcy is complete. It also discusses your legal options when creditors fail to update your credit report to reflect a discharged status.

If you believe your creditors are misreporting your post-bankruptcy accounts, contact a local bankruptcy attorney. It may not be intentional. This often results from the company’s failure to update its records, especially after a bankruptcy filing.

Credit reporting agencies rely on first-party creditors and debt collectors to report the status of a debtor’s account accurately. At a minimum, you can demand that the credit reporting agency update your report to reflect the correct account status.

Common Errors on Your Credit Report After Bankruptcy

Creditors rarely report an account incorrectly on purpose. Most lenders have thousands of customers, and some errors are to be expected. That doesn’t make dealing with one any easier. Let’s take a closer look at some of the most common post-bankruptcy reporting errors.

Discharged Debts Still Showing Balances

When the bankruptcy court approves a debtor’s bankruptcy, it discharges whatever debt remains after the trustee liquidates the individual’s assets. The trustee distributes the proceeds from the sale of the debtor’s non-exempt property to the creditors of the estate.

When the court discharges the debtor’s liabilities, the debtor no longer owes the money, and account balances become zero. Creditors of the estate must update the debtor’s credit report to reflect a zero balance. If the creditor fails to do this, it may make it appear that the person still owes the debt. For example, your credit card debt may have been discharged by the court, but an error can leave it showing an active balance for the full amount owed on your credit report.

“Charged Off” Instead of “Discharged in Bankruptcy”

Another common error you may see on your credit report is an account that is showing as “charged off” instead of “discharged.” An account is charged off when the account holder goes several months without making a payment.

The whole point of filing Chapter 7 bankruptcy is to remove these negative marks from your credit. While the “discharged” status alerts potential lenders that you filed bankruptcy, it’s still better than a charged-off account.

Accounts Showing as “Open”

As soon as the court discharges your accounts in bankruptcy, they’re no longer open. They’re closed, and your credit report should reflect that. If your creditor doesn’t update their records, the credit reporting agencies keep reporting the accounts as open.

This type of entry makes it appear that you’re still using the credit card or borrowing against a loan/line of credit. In addition to being incorrect, it can also make potential lenders reluctant to approve a loan.

Collection Accounts for Discharged Debts

In most cases, a person won’t file bankruptcy until creditors initiate collection activity. This may involve anything from phone calls to legal action. As soon as you file your bankruptcy petition, your creditors must stop all collection activity as part of the “automatic stay.” They’re also legally required to stop reporting the account as being in collections. Continuing to report the account as delinquent or in collections may provide grounds for a harassment lawsuit.

Incorrect “Date of Last Activity”

If your accounts close when the bankruptcy judge issues your discharge, your credit report should reflect the new status. It should also report that the activity on the account stopped on the date of your bankruptcy filing. It’s illegal for a lender to “re-age” a debt. It makes it appear that the account was left open until a later date.

Reasons Why Creditors Don’t Always Update a Credit Report

Account errors by creditors are usually oversights or computer errors. While this doesn’t make the errors okay, it does explain how they can happen. Some of the common reasons a creditor may incorrectly report the status of an account include:

Creditors have outdated systems

Some creditors are behind on updating records

Collection agencies may not have discharge information

Regardless of the reason, it doesn’t justify or excuse the creditor’s mistake. The negative impact false reporting can have on your personal, professional, and financial well-being is a violation of the Fair Credit Reporting Act (FCRA).

You can hire a consumer rights attorney or ask your bankruptcy lawyer to sue the creditor for violating this federal statute. Your creditors have the burden of reporting your accounts correctly. It’s not your job to chase them down and beg them to fix their credit reporting issue.

How To Fix Bankruptcy Reporting Errors Yourself

While it’s true that creditors and credit bureaus have a duty to report accurate consumer information, you should always try to rectify the situation on your own if at all possible. When you go online to annualcreditreport.com and download your free credit report, take time to review it for errors.

If you identify mistakes on your credit report, follow the steps below to try to resolve the problem. If you aren’t able to do this or your efforts aren’t successful, it might be a good time to seek legal advice. The longer you wait to address the issue, the more harm you may suffer.

Step 1: Gather Your Bankruptcy Documents

If you’re going to file a claim against the credit bureau, you’ll need proof that they’re reporting incorrect information. It’s not enough to say that the entry on your credit report is inaccurate.

Some of the documentation a consumer protection lawyer will need to support your claim includes:

A copy of your bankruptcy discharge order

A list of the creditors you included in your bankruptcy (Schedule D, E, F)

Proof of your bankruptcy filing date (your bankruptcy petition will have this)

Your bankruptcy case number

If you hire an attorney to help with your claim, they may be able to secure some of this documentation for you.

Step 2: Get All Three Credit Reports

The only way to know for sure how many inaccurate records are on your credit report is to review copies of the report from all three major credit bureaus. Sometimes, the information on these three versions differs. Annualcreditreport.com gives you free access to your credit report once per year. Review your report from all three major credit reporting agencies: Experian, Equifax, and TransUnion.

Highlight the entries that are incorrect. This makes it easier for the Consumer Financial Protection Bureau (CFPB) to determine if your claim is valid.

Step 3: Create a Detailed Error List

List the inaccurate information in your credit history. For example, if you included a credit card in your bankruptcy but it appears on your Experian credit report with an open balance, note it.

When compiling your list of credit report errors, include the following information:

Creditor name

Which credit bureau the error appears on

A description of the specific error (balance, status, date, etc.)

What the entry is supposed to say

Try to have this information available when you meet with a consumer protection attorney for the first time. The more information you provide, the better.

Step 4: Dispute with Credit Bureaus

Once you’re confident that you’ve identified all credit report errors, file your formal dispute. Here are some helpful tips for filing your credit record dispute:

File your dispute online or by mail

Include a copy of your bankruptcy discharge order

Clearly explain each error with as much detail as possible

Request a correction within 30 days from the date of your dispute

If sending a physical copy of the dispute, use certified mail and get a return receipt

If you aren’t comfortable filing the dispute yourself, you can ask your attorney to do it for you. However, you’ll still need to provide your lawyer with the above information.

Step 5: Dispute Directly with Creditors

Filing a dispute with the credit bureau to fix the mistakes on your credit report is only the first step. Don’t depend on them. There are ways to follow up after filing your dispute and increase your chances for a quicker resolution:

Send the creditor your own letter with proof of the discharge

Request a written confirmation of the correction

Demand that the creditor resolve the issue and confirm as much within 30 days of the date of your letter

If you’re uncomfortable taking these steps, have a consumer protection attorney do it for you.

Step 6: Document Everything

Document everything in a credit bureau dispute. A hard copy keeps those you’re dealing with from claiming you didn’t provide the necessary information. This includes the steps you’ve taken to correct errors on your credit report.

Keep the following in mind when documenting your resolution efforts:

Keep copies of all letters

Save all certified mail receipts

Take a screenshot of dated dispute confirmations

Record any phone calls you make to the creditors or credit bureaus (Note: Only do this if it is legal to do so in your home state)

Having all involved documents can help you avoid delays and difficulties during the process.

Step 7: Follow Up

Be prepared to follow up with the credit bureau to confirm that it made the necessary changes. Don’t depend on either the bureau or the credit reporting agencies to handle it. Credit bureaus have 30 days to investigate your claim. As soon as that period ends, be prepared to take the following steps:

Get an updated credit report

Check your credit report to see if corrections were made

Look to see if there are any new errors on your report

If the credit bureau did what it was supposed to do, your credit report will be correct, and you can go ahead with any plans you had to secure new credit. If they did not make the changes you requested, you’ll have to take further action, up to and including legal action.

Step 8: Escalate If Needed

If your discharged debts haven’t been removed, you may have to take additional steps to rectify the situation. Your options include:

Sending a second dispute to the credit bureau

Filing a complaint with the CFPB (Consumer Financial Protection Bureau), although its efficacy was severely impaired in 2025

Filing a separate complaint with the Federal Trade Commission (FTC)

If further attempts prove fruitless, consider hiring a consumer protection attorney to take over the fight. Creditors and credit reporting agencies are more likely to act when they receive a dispute from an attorney.

When DIY Disputes Don’t Work

If your efforts don’t resolve the issue, you’ll need to decide whether you want to take further action. One way to gauge when it’s time to talk to a consumer protection attorney or bankruptcy lawyer is when you can check off one or more of the items in the checklist below:

You have sent 2-3 written disputes with no resolution

The credit bureau claims they “verified” incorrect information

The credit bureau made the corrections, but the errors reappear months later

Multiple creditors are refusing to update your report

Lenders have denied you credit due to these errors

Creditors claim they never received a copy of your discharge notice

A credit bureau refuses to investigate, claiming that your dispute is frivolous

If any of these are true in your situation, you have to weigh the negative impact of the credit report errors with your desire to resolve them. By refusing or failing to correct mistakes on your credit report, a creditor or credit bureau is violating federal law. Since the creditor (or credit bureau) may have to pay your costs and attorney fees if you win, it’s worth discussing this with a local consumer protection attorney.

Your Legal Rights Under the Fair Credit Reporting Act (FCRA)

The Fair Credit Reporting Act (FCRA) is a federal law that protects consumers from arbitrary and incorrect entries on their credit report. When you seek debt relief through bankruptcy, the court will review your case to ensure you qualify.

Once the trustee accepts your bankruptcy petition, they’ll contact the creditors you include in your schedules of debts and assets. This means creditors know you’re going through bankruptcy proceedings.

Once your bankruptcy is complete, the judge will discharge your debts. In a Chapter 7 bankruptcy, this means that you no longer owe a balance on these debts. Under Chapter 13 bankruptcy, it means that the court has approved a three-to-five-year repayment plan and any discharge will occur after it’s completed.

Once creditors receive a copy of your discharge, they must update your account status with the credit reporting agencies. If they fail to do so, or if the credit bureaus do not update their records, they violate the FCRA.

The FCRA requires that financial institutions, credit reporting agencies, and other entities involved in reporting your credit follow certain rules. Once the court discharges a credit card in bankruptcy, the lender can no longer report a delinquency on your credit report.

Some of the other duties under the FCRA include:

Creditors must report accurately

Credit bureaus must take reasonable steps to investigate disputes

Credit bureaus must correct any legitimate errors within 30 days of receipt

Credit reporting agencies must delete any information they cannot verify

If a credit bureau doesn’t meet the above requirements, you may have a legal claim for damages. The best way to know for sure is to talk to a consumer protection attorney.

FCRA Violations

If a bank or other financial institution violates the FCRA, it may face possible legal action from the consumer. The specific consequences depend on the facts of your case. For instance, if a creditor marks an account as discharged but does not list a zero balance, they have violated the FCRA.

If another creditor fails to change the account status to discharged in bankruptcy, they also violate the FCRA. However, this violation is likely more serious than the above example.

If a creditor violates the FCRA by not reporting your discharged accounts correctly, you have several options. These include:

You can sue the creditor in federal court and possibly recover damages

The court may order the creditor to pay your costs and attorney fees if you win

The court can order the creditor or credit bureau to fix your credit report

The law doesn’t require hiring an attorney to handle your FCRA claim, but the process is complex. Consider speaking with a seasoned consumer protection lawyer before filing a lawsuit.

What Damages Can You Recover After an FCRA Violation?

If you can prove that a creditor (or credit bureau) has violated the FCRA, you can demand damages. Damages is another term for the financial compensation you can receive if you win your civil lawsuit. You must demand damages when you file your claim. Let’s examine some of the damages that may be available.

Statutory Damages: $100-$1,000 Per Violation

According to the FCRA, anyone who willfully violates the law must pay statutory damages. The specific amount of damages depends on the number of violations and the seriousness of the violation.

In general, you can receive anywhere from $100 to $1,000 for each violation you suffer at the hands of a creditor or credit reporting agency. You don’t need to prove that you suffered any harm. If three separate creditors refuse to update your credit report, you may recover between $300 and $3,000. Your potential damages would be the same for a single creditor with three violations against you.

Neither the consumer nor the creditor controls the amount of damages. The judge has total discretion over the specific amount of damages they order the creditor to pay.

Actual Damages: Real Financial Harm

As with any civil lawsuit, you can demand actual damages when you file your FCRA claim. Actual damages are exactly what they sound like: damages you suffered as a direct result of the creditor’s actions.

You can prove that you deserve actual damages by submitting evidence showing any of the following:

You had to pay a higher interest rate on a loan you got due to the credit report error

You lost your apartment deposit when the landlord denied your application due to your having negative marks on your credit report

You dedicated time and expense trying to fix the error on your credit report

If you see errors on your credit report after bankruptcy, sign up for a credit monitoring service. The service will notify you when there are changes to your report. For example, if a creditor corrects an account status to reflect a bankruptcy discharge but later changes it back to a negative status, you’ll be alerted.

Emotional Distress Damages

In some FCRA cases, the victim can demand and recover damages for emotional distress. Emotional distress is the mental and emotional suffering you experience as a result of the creditor’s FCRA violation.

Some of the elements of emotional distress include the following:

The anxiety and stress you experience from credit denials

Embarrassment and humiliation you feel when someone sees your credit report

Difficulty sleeping and other adverse health impacts

You must submit documentation to substantiate your claim of emotional distress. Your consumer protection attorney can do this using medical records and expert testimony.

Punitive Damages

Punitive damages allow a judge to punish a defendant for willful misbehavior. Courts rarely award punitive damages in an FCRA case. You must prove the creditor or credit bureau’s conduct was willful or reckless, and that it knew of the issue and intentionally refused to fix it. This is a difficult legal bar to achieve.

Attorney Fees and Costs

There’s no guarantee that a plaintiff in a civil case will receive attorney fees and costs from the other party. Since the defendant in an FCRA case is in a much better position to bear the costs of legal action, there’s a good chance the court will award them to you.

Many consumer protection lawyers will take cases on a contingency basis, which means they’ll take a percentage of your damages if you win. There are no upfront costs, such as a retainer.

What an FCRA Attorney Can Do for You

You may be able to handle your FCRA case on your own. However, if you want to increase your chances of winning or settling your claim, consider hiring an experienced consumer protection attorney.

Your attorney will do much more than appear in court for you. Hiring legal counsel can help with almost every aspect of your case. Some of the things an attorney can do for you include:

Explain the different steps and expertise involved

They will investigate your claim and document their findings

Send the creditor or credit bureaus a demand letter, which may provide results without going to trial

Filing a legal claim

Most consumer protection attorneys handle FCRA cases on a contingency basis. This means you don’t owe anything if you lose or have to pay upfront. If you receive settlement proceeds, your lawyer gets a percentage of the money.

Disclaimer: State and federal laws change frequently due to new legislation, higher court rulings, and other means.
