If granted, this motion is one of the few ways a judge can impose a sentence below the standard federal guidelines, but it comes with significant risks and no guarantees.

A defendant facing federal charges can sometimes earn a sentence reduction by helping the government investigate or prosecute someone else. This motion covers relief from mandatory sentences alongside statutory safety valve provisions.

The U.S. Supreme Court confirmed this distinction in Melendez v. United States. The Court held that a 5K1.1 motion does not, by itself, authorize a court to sentence below a statutory floor. The government has to specifically invoke the mandatory minimum statute for that relief to be available.

Prosecutors often file the 5K1.1 motion and the § 3553(e) motion together when a mandatory minimum applies. Without the second motion, the judge cannot go below the statutory minimum, no matter how valuable the cooperation was.

What Counts as Substantial Assistance?

Substantial assistance involves helping the government investigate or prosecute another person. It does not relate to the defendant’s own charges, but instead focuses on what the defendant knows about someone else’s criminal conduct, and whether that knowledge actually moves a separate case forward.

There are several ways a defendant can provide this kind of help:

Providing truthful information: Sitting down with investigators and describing what the defendant witnessed or knows firsthand.

Taking part in a monitored operation: Wearing a recording device or participating in a monitored phone call at the government’s direction.

Testifying: Appearing before a grand jury or at a trial in a case against someone else.

Regardless of how the defendant relayed the information, the details provided should be truthful and should help the government’s case. An offer of assistance means nothing unless it produces something useful to the investigation that the government can actually use.

How the Cooperation Process Works

Cooperation usually involves several steps, each with its own legal significance.

Step 1: The Proffer Session or “Queen for a Day” Meeting

The process often begins with a proffer session, also called a “Queen for a Day” meeting. During this meeting, the defendant, with their attorney present, tells the prosecutor and investigators what information they can provide.

Before the meeting, the defense attorney negotiates the proffer agreement or written terms for a plea agreement. It is important to understand exactly what this agreement covers and what it does not:

What it is: A promise that the government generally will not use the defendant’s own words from that session directly against them as part of its case-in-chief.

What it is not: Immunity. The government cannot use the defendant’s exact words from the meeting in its main case. However, the protection is narrow. Prosecutors may use those statements as a roadmap to find other, independent evidence, which they can then use without restriction.

Courts have also upheld the government’s ability to use a defendant’s proffer statements differently. If the defendant later testifies or makes statements that contradict what was written in the proffer, the government can introduce those earlier statements to challenge their credibility. The U.S. Supreme Court upheld that kind of waiver in United States v. Mezzanatto.

This limited protection comes from a federal evidence rule about plea discussions. It is sometimes called “use immunity.” In practice, it offers much less protection than the Queen for a Day nickname suggests.

Step 2: The Prosecutor Evaluates Your Information

After the proffer session, the prosecutor decides if the information is valuable, truthful, and useful enough to move forward with formal cooperation. No guarantee exists at this stage. The government can decide not to proceed, and the defense has little power to change that.

The Supreme Court upheld this in Wade v. United States. In this case, the Court held that the refusal of the prosecutor to file a substantial-assistance motion is reviewable only on a showing of unconstitutional motive.

Step 3: Providing Ongoing Assistance

If the government moves forward, cooperation usually continues beyond the first meeting. It can involve repeated interviews, ongoing debriefings, and, depending on the case, testimony before a grand jury or at a co-defendant’s trial.

This phase can last for months or longer, and the person’s obligations to cooperate continue the whole time.

Step 4: The Government Decides Whether to File The Motion

The government usually files the 5K1.1 motion only after cooperation is mostly complete, often just before the person’s sentencing hearing. This can be months or even years after the first proffer session.

The government alone decides whether it should file a motion, and it also recommends how much the court should depart downward based on the cooperation’s value. Courts generally give considerable weight to the prosecution’s own assessment of how useful the assistance was. That deference matters most when a judge has no independent way to gauge the value of what was provided.

Cooperation doesn’t always end at sentencing. Rule 35(b) of the Federal Rules of Criminal Procedure creates a path for a sentence reduction even after a person has been sentenced. If the defendant provides new and helpful assistance, the government can file a motion within one year of sentencing (or later, in specific circumstances) to ask the judge to reduce the sentence already imposed.

This Rule 35(b) motion filed within a year of sentencing is still possible if it falls into one of the following categories:

The defendant did not have the information until a year or more had already passed

The defendant provided information to the government within the first year; however, it did not turn out useful until later; or

The defendant could not have foreseen the information’s usefulness until a year after sentencing, but once it became clear to the defendant, they promptly shared it with the government.

Factors to Consider

Deciding whether to cooperate is a serious choice with significant consequences.

The Potential Reward

For many people facing federal charges, a 5K1.1 motion is one of the few ways to reduce the sentence below the mandatory minimum. The more valuable the cooperation, the greater the possible reduction in prison time.

The Risks

Cooperation comes with significant risks that go far beyond the courtroom.

Safety risks: Cooperating against others can put you or your family in danger of retaliation, both in prison and after release.

No guarantees: You can tell the government everything you know, and they can still decide your help wasn’t “substantial” enough to earn a motion.

The cooperator label: Being known as an informant can carry social and physical risks in prison and in your community.

Exposing more crimes: Being truthful may require you to admit to crimes the government didn’t know about, potentially leading to new charges.

Get Legal Help Before Cooperating with Federal Prosecutors

Anyone considering cooperation with federal prosecutors should first talk to a federal criminal defense attorney.

An attorney can review whether cooperation makes sense in the specific case, negotiate the proffer or cooperation agreement before any meeting with investigators, and attend every meeting to make sure the government follows the agreement.
