They function like a grid, calculating a sentence based on the seriousness of the offense and the defendant’s criminal history. While the Supreme Court case U.S. v. Booker made these guidelines advisory rather than mandatory, they remain the critical starting point for every federal sentencing decision.

At first glance, federal sentencing guidelines seem like an impossibly complex bus schedule. The guidelines consist of a “sentencing grid” that places all offenses and offenders on an X-Y axis. Where the two lines meet determines the defendant’s sentencing range in months. Figuring out the defendant’s offense level and criminal history category before calculating the various adjustments can lead to uncertainty and confusion.

In federal criminal cases, judges start with the Federal Sentencing Guidelines. These have been amended periodically since they were first produced in 1987, in response to the Sentencing Reform Act of 1984. This law was passed to address wide disparities in federal sentencing and reduce racial bias.

In this article, we’ll break down the abstract steps of sentencing under the federal guidelines and use examples to make them more concrete. If you’re facing federal criminal charges, make sure you speak with a criminal defense attorney.

Step 1: Calculating the Offense Level

The U.S. Sentencing Guidelines Manual assigns each offense type a “base level,” then adjusts it up or down based on various factors. This becomes the X-axis of the sentencing grid.

Base Offense Level

The base offense level is the offense’s “score” with no other factors included. Base offense levels range from 1 to 43. For example, a federal assault charge has a base offense level of 4. However, if the offense involved physical contact or use of a weapon, it rises to a Level 7.

Specific Offense Characteristics

Each offense has unique factors that can increase the offense level. These specific characteristics apply only to these offenses, not to other offenses.

For our assault example above, the specific offense characteristics are:

If the victim suffered bodily injury, the base level is increased by two levels

If the victim suffered bodily injury and was a spouse, intimate partner, dating partner, or was under the age of 16, the base level is increased by four levels

A defendant who used a baseball bat to hit a stranger will have a starting score of 7. If they struck their spouse, they have a starting score of 11.

Adjustments

Adjustments can add or subtract points from a defendant’s score. The most critical of these is Acceptance of Responsibility. Acceptance of responsibility can remove up to three (3) points from a person’s score if the defendant:

Has a cumulative score of 16 or less

Accepts a plea agreement before the prosecution has made substantial preparations for trial

Additional critical adjustments include:

The age or nature of the victim: Very old, very young, or “official” victims (such as law enforcement officers) can increase the score

The offender’s role in the offense: Playing a minimal or minor role can decrease the score by up to 4 points

Obstruction of justice: Any form of obstruction can increase the score, including flight to avoid arrest

Multiple counts: Combining charges can result in a defendant being sentenced under the guideline range of the highest offense, even though multiple charges do not by themselves increase the score

After all possible points are calculated, the result is determined on the Sentencing Table’s vertical axis.

Step 2: Determining the Criminal History Category

The criminal history category is based on the offender’s prior conviction record. Points are added for each misdemeanor sentence and for those over 18 months. Some offenses, such as fish and game violations and juvenile status offenses (curfew violations, truancy), are not included.

Career offenders may begin at a higher history level. The category is assigned a Roman numeral from I to VI and placed on the horizontal axis.

The Federal Sentencing Table

Below is a representative section of the Sentencing Table showing part of the X and Y axes.

Criminal History Category

Offense Level

II

III

IV

15

21–27

24–30

30–37

16

24–30

27–33

33–41

17

27–33

30–37

37–46

The top line of the table shows the Criminal History Category.
