According to the U.S. Sentencing Commission’s 2024 Annual Report, roughly 97% of people sentenced in federal court that year pleaded guilty instead of going to trial.

Why So Many People Take Plea Deals

Most federal criminal cases never reach a courtroom. In Missouri v. Frye, the U.S. Supreme Court observed that guilty pleas account for 97% of federal convictions and 94% of state convictions. The U.S. Sentencing Commission’s 2024 Annual Report shows the same pattern, with roughly 97% of federal defendants pleading guilty.

In theory, a plea deal is a negotiation between two sides. In practice, however, the two sides are not equal. Prosecutors do not have to share all their evidence before making an offer, which can leave a criminal defendant guessing about how strong the case really is. Some sentencing benefits are also only available if you plead guilty early. So you may feel pressure to accept a deal before you or your attorney can fully review the evidence. A 2018 report from the National Association of Criminal Defense Lawyers (NACDL) also found that prosecutors sometimes threaten added charges if a defendant does not plead.

The report described what critics call coercive plea practices, in which prosecutors use their bargaining power and broad discretion to secure guilty pleas. In many districts, plea agreements require defendants to give up their right to appeal their sentence.

Real Cases That Illustrate the Trial Penalty

The NACDL’s report highlights several cases that help to illustrate the trial penalty in practice. In one Virginia case, a low-level member of a robbery gang took part in three of the gang’s 10 home robberies. He rejected a plea offer and went to trial. Prosecutors then added charges, including a gun charge with a 25-year mandatory minimum, and he was sentenced to 28 years. The gang’s leader, who planned all 10 robberies but pleaded guilty, got 22 years. Other low-level members who pleaded guilty received between 7 and 14 years.

The trial penalty can also affect companies. In 2013, the federal government accused FedEx and UPS of helping distribute controlled substances by delivering packages from online pharmacies. Neither company knew what was inside the packages. UPS quickly agreed to a non-prosecution deal, paid a $40 million fine, and avoided charges. FedEx chose to go to trial. The government then sought $1.6 billion in fines, 40 times what UPS paid. The government eventually dropped its case, and the judge found FedEx factually innocent. UPS paid $40 million and gave up its right to a trial, even though both companies were accused of the same conduct.

In some cases, a judge steps in to address these differences. In a lobbying bribery case, the two leaders of the scheme pleaded guilty and received sentences of four years and 20 months. A lobbyist who went to trial was convicted, and prosecutors asked for a sentence of 17 to 21 years under the guidelines, much harsher than what the leaders received. The judge rejected this and sentenced the lobbyist to 20 months. This example shows how wide the gap can be between pleading guilty and going to trial.

Does the Trial Penalty Appear in All Types of Crimes?

On the surface, it might seem that trial penalty exists mainly because the most serious crimes, such as murder, are more likely to go to trial.

However, trial rates vary widely by crime charged. According to the Commission’s fiscal year 2025 data, murder had the highest trial rate of any offense category at 25.2% (102 of 405 cases), followed by kidnapping at 20.5%. Trials were much rarer for fraud (3.7%) and drug trafficking (2.1%). Only 0.3% of immigration cases went to trial.

If the trial penalty were only about serious cases going to trial, the biggest gaps would appear in murder and kidnapping. The data shows the opposite. Immigration cases almost never go to trial, but they have the largest penalty, at 3.3 times the average plea sentence. Murder has the highest trial rate but one of the smallest gaps, at 1.6 times. The penalty appears in all 12 crime categories reviewed.

Average Sentences by Crime Type

Below is a summary of average sentences by crime type.

<table style="width: 100%; Of the 15,879 people who pleaded guilty, the average sentence was 84.5 months. For the 343 who went to trial, the average was 202.5 months, or 2.4 times longer. That is almost 10 extra years in federal prison.

The gap is even wider in some cases. Fraud cases show a similar pattern. People convicted of fraud at trial averaged 66.3 months, compared to 20.5 months after a plea. The median plea sentence was only 12 months, so for most fraud defendants, going to trial and losing can turn a one-year sentence into a four-year sentence. In economic crimes like fraud, the amount of money lost often drives the sentence. That one factor can mean the difference between a few months and up to 20 years.

The gap is growing in some categories. In fiscal year 2024, people convicted of fraud at trial received sentences about 2.6 times longer than those who pleaded guilty. By 2025, that number rose to 3.2 times.

Even the most serious cases show a penalty. Murder cases have the highest trial rate, and sentences are already long. Still, people convicted at trial received an average of 399 months, or more than 33 years, compared to 247.8 months, or about 20 and a half years, after a plea.

What Creates This Gap? Understanding the Key Factors

The trial penalty does not come from a single rule. First, as we mentioned above, is the case selection effect. Serious cases go to trial more often than less serious ones. A defendant facing decades in prison may see little benefit in a plea deal. Because the trial pool includes more serious cases, the overall trial average is higher.

Second, sentencing benefits are only available to people who plead guilty. Federal judges use the U.S. Sentencing Guidelines to calculate a recommended sentence. The guidelines assign each case an offense level. A higher offense level means a longer sentence. The guidelines are not mandatory, but many judges still follow them closely. Pleading guilty can lower the offense level in a few ways:

Acceptance of Responsibility

Under §3E1.1 of the guidelines, a defendant who clearly accepts responsibility for their offense receives a two-level reduction. If the offense level is 16 or higher, the defendant can receive one more level off. This extra level requires a motion from the prosecutor. The prosecutor files it when the defendant gives early notice of a plea, which saves the government from preparing for trial.

For example, a first-time offender at offense level 26 faces a guideline range of 63 to 78 months. A three-level reduction lowers that to level 23, with a range of 46 to 57 months in prison.

People who deny guilt at trial usually do not qualify for this reduction. A trial does not automatically disqualify someone, but exceptions are rare, such as when a person goes to trial only to challenge whether a law is constitutional.

Substantial Assistance

Cooperating with prosecutors can reduce a sentence even more. If a person helps the government investigate or prosecute someone else, the prosecutor may file a substantial assistance motion. This lets the judge impose a sentence below the guideline range, and sometimes below a mandatory minimum. Because only the prosecutor can file this motion, and cooperation usually happens before trial, these reductions are rare for people who go to trial.

Prosecutorial Leverage

Because guideline sentences can be harsh, prosecutors use them as leverage during plea talks. Under Rule 11 of the Federal Rules of Criminal Procedure, a plea deal can include dropping other charges, allowing the criminal defendant to plead guilty to a lesser charge, or agreeing on a specific sentence.

Bordenkircher v. Hayes illustrates how much power prosecutors have. Paul Hayes was criminally charged with forging an $88.30 check. The prosecution offered to recommend a prison sentence of five years if he pleaded guilty. Because of the two prior felony convictions on Hayes’s criminal record, the prosecutor warned he would seek a habitual offender indictment if Hayes refused. That charge carried a mandatory life sentence. Hayes turned down the deal, and the prosecutor followed through. The jury convicted Hayes of forgery and found that he had two earlier felonies, so he received a life sentence. The Court upheld the result, since Hayes could have accepted or rejected the offer and the prosecutor had enough evidence to support the more serious charge.

A Note on the Data and Methodology

To measure the trial penalty, we analyzed the U.S. Sentencing Commission’s public data files for fiscal years 2024 and 2025. These files contain anonymized information on federal felony and Class A misdemeanor sentences that courts reported to the Commission, allowing us to compare plea and trial outcomes across the federal system.

Our analysis looked at three things:

How the case ended: “Plea” includes every case resolved by a guilty plea. “Trial” includes every case decided by a jury trial or by a judge in a bench trial.

The type of crime: We used the Commission’s official offense categories to compare similar crimes, such as drug trafficking, fraud, and firearms offenses.

Sentence length: We calculated the average (mean) and typical (median) prison sentence for each group.

There are some limits to this data. These are raw comparisons that do not control for factors like criminal history or loss amount. As explained above, cases that go to trial often differ from those that end in a plea. Part of the gap also comes from the plea discount, since people who plead guilty almost always receive the acceptance-of-responsibility reduction. In fiscal year 2025, about 96% of sentenced individuals with complete Guidelines information received it.

For statistical purposes, the Commission counts any sentence longer than 470 months, including life sentences, as 470 months. Because of this cap, the true trial penalty in murder cases and other cases with life sentences is likely larger than the averages suggest.

Trials have been rare in federal court for years. In fiscal year 2024, 2.8% of federal cases ended in a trial. In 2025, that number dropped to 2.3%. These numbers show that the trial penalty is a real and measurable part of the federal justice system.

How to Use This Information

Sentencing data shows broad trends but cannot predict the outcome of any single case. This is why the criminal defense attorney’s role during plea negotiations is so important.
