By agreeing to a fast-track deal, defendants give up important legal rights, such as the right to file certain motions or appeal their sentence.

Early decisions in a federal criminal case can significantly affect the final sentence. In some districts, prosecutors offer a fast-track plea deal. The defendant pleads guilty early and waives certain legal rights. In exchange, the government asks the judge to reduce the sentence.

This option is not available everywhere or to everyone. It also comes with real trade-offs. A defendant who accepts a fast-track offer usually gives up the chance to challenge the evidence or appeal the sentence later.

If you or a family member is considering a fast-track offer, a federal criminal defense attorney can review the terms and explain which rights you’re waiving. They can also compare the fast-track deal with other plea options before the offer expires.

What Is a Fast-Track Program?

A fast-track program is a plea program prosecutors use to resolve federal criminal cases quickly. The official name is an “early disposition program.” The U.S. Attorney General and the U.S. Attorney for the federal district where the case is filed must approve each program, though the Deputy Attorney General can supply the Attorney General’s approval.

Under the federal sentencing guidelines on early disposition programs, the process generally works like this:

The defendant accepts the district’s program terms and pleads guilty

Upon motion of the government, the prosecutor asks the court to lower the defendant’s offense level

The sentencing judge decides whether to grant the sentence reduction, up to a maximum of four levels

Federal judges use the offense level to find the recommended sentence range under the federal guidelines sentencing table. A higher offense level means a longer prison term. Lowering the offense level by several points can reduce a sentence by months or even years.

Where Fast-Track Programs Came From

The Department of Justice (DOJ) developed these programs in the 1990s. Federal courts in U.S.-Mexico border districts were handling a growing number of immigration prosecutions. Prosecutors needed a way to resolve those cases without full trials.

A quick guilty plea saves the government time and resources, allowing prosecutors to focus on other cases. The Justice Department also treats a fast-track plea as a stronger sign of accepting responsibility than a standard guilty plea.

Congress addressed these programs in the PROTECT Act of 2003. This Act ordered the United States Sentencing Commission to adopt a policy statement. The statement allows a sentence reduction of up to four offense levels. The reduction applies when the government asks for one under an approved early disposition program.

Since then, fast-track programs have spread beyond the U.S.-Mexico border. By 2012, certain districts away from the border also received approval to run them. DOJ policy began directing every district that prosecutes illegal reentry felonies to implement an early disposition program. Approval works differently for programs aimed at other offenses.

A program supporting a guideline reduction needs sign-off from the Attorney General and the U.S. Attorney for the district. The 2012 policy extended existing programs for offenses other than illegal reentry only temporarily while the Department reviewed them.

How the 2025 Guideline Change Affects Fast-Track Programs

For more than 20 years, the fast-track rule appeared in the Guidelines Manual as a “departure.” A downward departure occurs when the court departs from the sentence the judge calculates to a sentence below that range.

On November 1, 2025, the Sentencing Commission deleted the former USSG fast-track guideline, §5K3.1, which previously allowed courts to depart downward. It replaced it with a new early disposition policy statement, §3F1.1.

The new rule builds the reduction into the guideline range calculation, lowering the offense level before it reaches the sentencing judge. The Sentencing Commission made this change as part of a shift away from departures after the Supreme Court’s decision in United States v. Booker.

The maximum reduction is still four levels. Older court documents and plea agreements may still refer to the former departure provision, which covers the same program as the new policy statement.

How Common Are Fast-Track Pleas?

Fast-track pleas make up a small but steady share of federal sentences. The U.S. Sentencing Commission’s 2025 Sourcebook covers fiscal year 2025, which ran from October 2024 through September 2025. During that period, 4,012 of 66,662 federal cases involved a fast-track reduction. That is about 6% of all cases. These defendants were sentenced under the old departure rule, since the new rule took effect after that period ended.

Two types of crimes account for nearly all fast-track cases:

Immigration offenses: 81% of fast-track cases

Drug trafficking offenses: 18% of fast-track cases

Other crimes accounted for only a handful of cases.

What a Defendant Gives Up in a Fast-Track Plea

A fast-track deal asks a defendant to act quickly and waive rights that could matter later. Each district sets its own terms. The Justice Department’s baseline policy for illegal reentry cases includes the following requirements:

Agree to a plea deal within 30 days: In general, the defendant has 30 days from the time federal agents take them into custody to sign on to a written plea agreement. Exceptions may apply in unusual situations, such as when the defendant did not have adequate access to a lawyer.

Admit what happened: The written deal must state the facts of what the defendant did, which must be accurate. In illegal reentry cases, the defendant also agrees to the facts about their earlier conviction and removal from the U.S.

Give up pretrial motions: The defendant agrees not to file certain pretrial motions. These include motions to suppress evidence, challenge the charging document, raise a speedy trial violation, or claim selective prosecution. They also include requests for discovery and requests to separate charges or defendants.

Waive appeal and later challenges: Depending on the district, the defendant may give up the right to appeal or to challenge the conviction later in a separate court proceeding. Claims of ineffective assistance of counsel are the exception. Some programs also bar the defendant from asking the judge for a “variance” or seeking statutory relief under 18 U.S.C. § 3553(f). A variance is a lower sentence based on the broader sentencing factors in federal law, such as the defendant’s personal history or the nature of the offense.

Accept added conditions: The U.S. Attorney may set other requirements. Some programs require a binding plea agreement that sets a specific sentence once the judge accepts it. Others may require the defendant to waive a full presentence investigation.

Some districts require the defendant to waive indictment. In these cases, no grand jury reviews the charges. Instead, the prosecutor files a charging document called an information.

What a Defendant Receives in Return

The main benefit is a lower offense level, which results in a shorter recommended sentence. The guidelines limit the reduction to four levels. The exact reduction depends on the district’s program and the prosecutor’s motion.

For illegal reentry cases, the Justice Department’s baseline policy sets two tiers:

Four levels: Most eligible defendants receive this reduction

Two levels: This is for defendants in the highest criminal history category or with a felony conviction for a serious violent offense (the prosecutor must get supervisory approval and review each case individually before making this offer)

The time savings can be significant, especially for statutory mandatory minimum sentences subject to statutory relief under 18 U.S.C. § 3553(e). In fiscal year 2025, the typical fast-track sentence fell about six months below the bottom of the guideline range, according to United States Sentencing Commission data. The gap was larger in drug trafficking cases, where the typical reduction was about three years.

A fast-track plea can also speed up sentencing. For instance, a 2015 court order in the Eastern District of Louisiana set sentencing for fast-track cases within about six weeks after a binding guilty plea.

Who May Not Qualify

Prosecutors have broad discretion to limit or refuse fast-track participation. Under Justice Department policy, a United States Attorney may exclude a defendant based on:

Prior convictions for violent felonies, which can include drug trafficking and firearms offenses

Prior deportations, illegal reentry convictions, or other immigration-related convictions

Past participation in a fast-track program

Involvement in a separate federal investigation

Being on probation, parole, or other court supervision

Aggravating circumstances when the defendant was arrested

Other charges may lead to exclusion.

The Fast-Track Reduction and Acceptance of Responsibility

The fast-track reduction is separate from the standard credit for pleading guilty. It applies in addition to that credit.

A defendant who accepted responsibility for an offense can receive a two-level reduction under the guidelines’ acceptance of responsibility rule. Defendants who start at level 16 or above may get one extra level reduced. For that extra level, the prosecutor must file a motion stating that the early plea saved the government the work of preparing for trial. Fast-track reduction is applied after this credit.

A defendant starting at offense level 24 might receive three levels for acceptance of responsibility. A four-level fast-track reduction would then bring the offense level down to 17.

Neither reduction is automatic. A guilty plea alone does not guarantee credit for acceptance of responsibility.

Fast-track Pleas vs. Other Plea Options

Fast-track pleas, along with provisions like the safety valve, are one of several ways to resolve a federal case with a guilty plea. Other options include:

Standard plea agreements: Most guilty pleas involve an agreement under the federal rules on plea agreements. The federal prosecutor may agree to drop other charges or recommend a particular sentence. The judge may ignore that suggestion. The prosecutor may also agree to a specific sentence, which is binding. For the defendant, the goal is usually certainty about the outcome.

Substantial assistance agreements: Helping the government investigate or prosecute someone else can lead to a sentence below the guideline range under the substantial assistance provision. The prosecutor must file a motion. The judge decides whether to reduce the sentence below the guideline range. This reduction is separate from any credit for accepting responsibility. In fiscal year 2025, about 8% of federal cases involved this type of departure.

Fast-track pleas: A fast-track plea rewards a quick resolution, not cooperation. The defendant does not have to provide information about others. Instead, they resolve the case early and give up certain rights for a lower offense level.

These pleas involve waiving certain rights. Speak to a criminal defense attorney before agreeing to any deal.

Risks To Consider Before Accepting a Fast-Track Offer

A fast-track plea can reduce a sentence, but it also limits future options. A defendant should weigh several factors before accepting, including:

The judge is not required to grant the reduction: The new policy uses permissive language. As a result, the guidelines allow the court to decrease the offense level but don’t require it. The prosecutor’s motion is a request, not a guarantee.

The judge may reject the plea deal: Judges can accept or reject certain plea agreements, even binding ones. If the judge rejects the deal, the defendant must have the chance to withdraw the guilty plea.

The prosecutor decides who is eligible: The Justice Department’s fast-track policy doesn’t create any legal rights. A defendant can’t require the government to offer a fast-track deal.

Waived defenses cannot be raised later: A defendant who agrees to skip pretrial motions gives up the right to move to suppress evidence. If police obtained important evidence illegally without a valid search warrant, a successful motion could weaken or end the prosecution’s case. Accepting fast track means losing that opportunity.

Appeal rights may be lost: Before accepting the plea, the judge must explain any appeal waiver in open court. If the plea agreement includes an appeal waiver, the defendant usually cannot appeal the sentence later.

Keep in mind that any plea deal you accept will require you to plead guilty to a crime.

Getting Legal Help With a Fast-Track Plea Offer

If you or someone you know receives a fast-track offer, there may be little time to decide. In illegal reentry cases, the defendant generally has 30 days from federal custody to agree to the plea deal. Other programs may set their own deadlines. A federal defense attorney can review the evidence for possible pretrial motions, explain which rights the plea agreement waives, and compare the fast-track offer with other plea options. This helps you understand whether the shorter sentence is worth the trade-offs. FindLaw’s
