The key difference between them determines when the court retains judicial discretion and when the law restricts it.

The U.S. Sentencing Guidelines

The U.S. Sentencing Guidelines are recommendations from the U.S. Sentencing Commission. They look at the offense, the facts of the case, and the defendant’s criminal record to suggest a sentencing range.

The federal sentencing guidelines were mandatory until 2005, when the U.S. Supreme Court ruled in United States v. Booker that judges treat the Sentencing Guidelines as advisory. Judges still must calculate the range correctly and consider it alongside the federal sentencing factors Congress sets, such as the seriousness of the crime and the defendant’s background, but are no longer absolutely bound by mandatory minimums. Courts call a sentence outside the range based on those factors a “variance.”

Mandatory Minimums

A mandatory minimum is a specific term of imprisonment set by federal law in a criminal statute. If a person is convicted under that statute, the judge must impose at least the minimum sentence, even if the Guidelines suggest a lower sentence.

Mandatory minimums tie judges’ hands, to a certain extent. The Guidelines suggest a range, but the judge can’t impose a sentence below the minimum term unless a specific form of relief applies. If the Guidelines range is higher than the minimum, the range is the sentencing judge’s starting point. If the range falls below the minimum, the Guidelines treat the minimum as the recommended sentence.

Common federal charges follow the mandatory minimum sentencing laws:

Drug trafficking: Federal drug trafficking law sets a five-year or 10-year minimum for trafficking certain amounts of drugs such as methamphetamine, fentanyl, cocaine, or heroin. The amount determines which minimum applies.

Firearms offenses: Using or carrying a gun during a drug trafficking crime or crime of violence carries at least five years. The defendant must serve that time consecutively, meaning on top of any other sentence.

Child pornography: Receiving or distributing child pornography carries a five-year minimum. Aggravating factors can increase the sentence.

Aggravated identity theft: A prior conviction for aggravated identity theft adds a mandatory two-year prison term. Other repeat offenses may carry the same enhancement.

Any federal felony charge is serious enough to necessitate speaking with a skilled federal crimes attorney.

Comparing the Guidelines and Mandatory Minimums

The Guidelines and mandatory minimums can both apply in a single case, but they serve different roles. The Guidelines give the judge a recommended sentencing range, while a mandatory minimum sets the lowest sentence the judge may impose. The judge may sentence above or below the Guidelines, but cannot go below the mandatory minimum unless a specific exception applies.

Here are the main differences between the two:

Who sets them: The Sentencing Commission creates the Guidelines. Congress establishes mandatory minimums in federal criminal statutes.

When they apply: Judges determine a Guidelines range in almost every federal criminal case. A mandatory minimum applies only if the conviction is for an offense that includes one, which occurred in about one out of five federal cases in fiscal year 2025.

How much they bind the judge: The Guidelines are advisory, which means the judge may sentence above or below the recommended range. A mandatory minimum is binding. The judge may impose a higher sentence, but cannot go below the minimum without a qualifying exception.

How a person can receive a lower sentence: A judge may go below the Guidelines range by granting a variance based on the federal sentencing factors. To receive a sentence below a mandatory minimum, the law requires a specific exception, such as the safety valve or a government motion for substantial assistance.

The Guidelines give judges direction on where to aim, while a mandatory minimum sets the point at which a judge must impose a sentence. This is why a charge subject to a mandatory minimum can change a case’s outcome, and why the pathways to relief matter so much.

How Often Do Mandatory Minimums Apply?

Mandatory minimum penalties are common in federal cases, but they don’t apply to every charge. The United States Sentencing Commission reports that 21% (about one in five) of federal cases in fiscal year 2025 involved a mandatory minimum conviction.

The Commission received data on 66,662 federal cases that year. Of those, 13,926 involved a mandatory minimum offense. Drug trafficking accounted for about two-thirds of them (68%). Sexual abuse (8%), child pornography (7%), firearms (5%), and fraud (3%) were less frequent.

Location also plays a role. In some federal districts, such as the Eastern District of Tennessee and the Eastern District of Kentucky, mandatory minimum cases made up more than half of all cases (54% and 52%, respectively).

How Often Do Defendants Avoid Mandatory Minimums?

In fiscal year 2025, 33% of people whose convictions triggered a mandatory minimum received relief at sentencing. About one in three avoided the minimum sentence.

Relief from a mandatory minimum can make a major difference. In fiscal year 2025, people who remained bound by a mandatory minimum received an average sentence of 158 months, or a little over 13 years. Those who received relief averaged 74 months, or just over six years.

The other 67% did not receive relief, which has become less common over time. The Commission’s data shows a relief rate of 46.5% in fiscal year 2021, 37% in fiscal year 2024, and 33% in fiscal year 2025.

The Two Main Paths to Relief

Commission data show two main paths to a sentence below a mandatory minimum. Both come from federal statutes. The 33% who were able to avoid the mandatory minimum did so through several mechanisms:

14% qualified for the safety valve

15% cooperated with prosecutors and received a substantial assistance motion

5% qualified through both

Each figure represents a share of everyone convicted of a mandatory minimum offense, not those who received relief.

The split between the two paths is now nearly even, but it wasn’t always the case. In fiscal year 2022, the safety valve was the more common route, with 21.6% of people using it compared to 14.4% who cooperated. Safety valve relief has declined each year since, while cooperation rates have stayed about the same.

Who Receives Relief?

Commission data shows large gaps in who receives relief. Gender, citizenship, and charge type all affect outcomes. For example:

Gender: In fiscal year 2025, 61% of female defendants facing a mandatory minimum received relief, while only 30% of male defendants did

Citizenship: Among non-U.S. citizens, 58% received relief, compared with 28% of U.S. citizens

The Commission’s annual figures do not explain these gaps. Many factors play a role, including the type of offense and the person’s role in it. For the citizenship gap, earlier Commission research points to criminal history. A 2011 report to Congress found that non-citizen drug defendants facing mandatory minimums usually had lower criminal history scores than U.S. citizens. According to the Commission, one reason may be that the Guidelines do not count foreign convictions. As a result, more non-citizens meet the safety valve‘s criminal history requirement.

The type of charge also matters as much as the person’s background. Relief is most common in drug offenses because both paths are available, but it’s rare in other categories. In fiscal year 2025, 96% of people convicted of a sexual abuse offense carrying a mandatory minimum remained bound by it at sentencing. That figure was 98% for child pornography and 84% for using or carrying a gun during a drug or violent crime. The safety valve doesn’t apply to these offenses, leaving cooperation as the only statutory path.

How the Safety Valve and Substantial Assistance Work

The safety valve and substantial assistance are the two statutory paths to a sentence below a mandatory minimum. Each has its own requirements and limits.

The Safety Valve

If the defendant qualifies for the safety valve, the statute requires judges to override the mandatory minimum and sentence the defendant according to the Guidelines. The safety valve targets lower-level, nonviolent offenders with little or no criminal record. It only covers certain drug crimes, including:

Federal drug trafficking and possession

Attempts and conspiracies to commit those offenses

Drug import and export offenses

Some maritime drug cases

To qualify, the judge must find that the defendant meets all five of these requirements:

The defendant’s prior record falls within the statute’s limits on criminal history points

The defendant did not use or threaten violence, possess a gun or other dangerous weapon, or cause someone else to possess one during the offense

The offense did not result in anyone’s death or serious bodily injury

The defendant did not organize, lead, manage, or supervise others in the offense, did not compromise community safety, and was not running a continuing criminal enterprise

By the time of sentencing, the defendant truthfully told the government everything they knew about the offense and related conduct

The last requirement listed above is different from cooperation. The defendant must be completely truthful, but the information need not help the government with other cases.

The safety valve relief may keep shifting. In 2024, the U.S. Supreme Court decided Pulsifer v. United States, which addressed the criminal history requirement expanded by the First Step Act of 2018. Federal courts debated how to interpret this new language, but the Court chose a narrow interpretation. Under Pulsifer, a defendant doesn’t qualify for the safety valve if they have any one of the following:

A criminal history exceeding four points, excluding offenses that carry a maximum penalty of one point

A prior three-point offense

A prior two-point violent offense

The Court decided Pulsifer in March 2024, making fiscal year 2025 the first full year of data under the narrower rule. So far, it’s unclear whether the ruling caused a change. Safety valve relief did slip from 16.1% in fiscal year 2024 to 14% in fiscal year 2025. However, that decline started before the ruling.

Substantial Assistance

The second path is cooperation. If a defendant helps the government investigate or prosecute someone else, the prosecutor can file a substantial assistance motion. This motion gives the judge authority to sentence below the mandatory minimum. A related Sentencing Guidelines provision allows a sentence below the Guidelines range.

Cooperation can also happen after sentencing. Under the Federal Rules of Criminal Procedure, the government can ask the court for sentence reductions based on help the defendant provides later. The reduction can go below the mandatory minimum.

This path has real limits. Only the prosecutor decides whether the help is valuable enough to justify a motion. Cooperation can also put a defendant’s personal safety at risk. A defendant should talk with a defense attorney before sharing any information with the government.

Get Legal Help With a Federal Mandatory Minimum Charge

Mandatory minimums can lead to harsh sentences, but ongoing criminal justice reform means they aren’t always the final outcome. Federal law allows for some paths to shorter sentences. Still, most people facing a mandatory minimum serve it.

If you or someone you care about faces a federal charge with a mandatory minimum, consider speaking with a federal criminal defense attorney. They can review the charges and criminal history to see whether the safety valve applies. A criminal defense attorney can also negotiate charges and plea terms with the prosecutor. Getting legal advice early can help preserve options that may not be available later in the case.

Finding the right attorney for your situation isn’t always easy.
