In most instances, before an employer can apply for an <span data-term-id=\"58342386\">immigration petition<\/span>, they should apply for <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-laws-and-regulations\/obtaining-an-alien-labor-certification.html\">labor certification<\/a>. Through this, the <span data-term-id=\"58342349\">DOL<\/span> verifies that there are no available, willing, or qualified <span data-term-id=\"58342343\">U.S. workers<\/span> to take the job. <span data-term-id=\"58342348\">Hiring <\/span><span data-term-id=\"58342334\">foreign workers<\/span> will not create a negative impact on the <span data-term-id=\"58342345\">working conditions<\/span> and wages of <span data-term-id=\"58342343\">U.S. workers<\/span> with similar roles.<\/p>\n<p>The Secretary of Labor ensures that <span data-term-id=\"58342340\">U.S. employers<\/span> meet the standards for recruitment requirements. This protects the rights of <span data-term-id=\"58342340\">U.S. employers<\/span> and <span data-term-id=\"58342334\">foreign workers<\/span>.<\/p>\n<h2>Eligibility Requirements for <span data-term-id=\"58342340\">U.S. Employers<\/span> To Hire a <span data-term-id=\"58342351\">Foreign National<\/span><\/h2>\n<p>The <span data-term-id=\"58342340\">U.S. employer<\/span> should have a valid\u00a0<a href=\"https:\/\/www.irs.gov\/businesses\/employer-identification-number\" target=\"_blank\" rel=\"noopener\">Federal Employment Identification Number<\/a>\u00a0(FEIN). It should also have a location within the United States to refer <span data-term-id=\"58342343\">U.S. workers<\/span> to.<\/p>\n<p>Before filing a PERM application, the <span data-term-id=\"58342340\">U.S. employer<\/span> should also have a prevailing wage determination for the job order. They assist in investigating work violations and holding abusive employers accountable to protect workers in the United States.<\/p>\n<h2>General Rules on <span data-term-id=\"58342348\">Hiring <\/span><span data-term-id=\"58342334\">Foreign Workers<\/span><\/h2>\n<p>Securing <span data-term-id=\"58342385\">work authorization<\/span> is the foundation of the hiring process. In general, <span data-term-id=\"58342340\">U.S. employers<\/span> wanting to hire <span data-term-id=\"58342351\">foreign nationals<\/span> should file an <span data-term-id=\"58342386\">immigrant petition<\/span> on <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/how-to-apply-for-immigrant-status-based-on-employment.html\">behalf of the <span data-term-id=\"58342334\">foreign worker<\/span><\/a>. Depending on the circumstances of each case, a <span data-term-id=\"58342351\">foreign national<\/span> may work in the U.S. permanently or temporarily. Business owners seeking to diversify their workforce must be attentive to these rules.<\/p>\n<p>When assessing permanent labor certification applications, the <span data-term-id=\"58342349\">DOL<\/span> does not review employees\u2019 qualifications. The certifying officers review the\u00a0<span data-term-id=\"58342386\">immigration petitions<\/span>\u00a0and ensure that the job order matches the position\u00a0the <span data-term-id=\"58342349\">DOL<\/span> certified.<\/p>\n<p>The authority to investigate an employee\u2019s qualifications rests with <a href=\"https:\/\/www.uscis.gov\/\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58342341\">U.S. Citizenship and Immigration Services<\/span><\/a> (<span data-term-id=\"58342335\">USCIS<\/span>). <span data-term-id=\"58342335\">USCIS<\/span> assesses whether the job requirements match the qualifications of the <span data-term-id=\"58342334\">foreign worker<\/span>. This applies, in particular, to <span data-term-id=\"58342366\">skilled workers<\/span> in <span data-term-id=\"58342371\">specialty occupations<\/span> or individuals with <span data-term-id=\"58342361\">advanced degrees<\/span>.<\/p>\n<h2>Labor Certification Application<\/h2>\n<p>In most cases, before a <span data-term-id=\"58342340\">U.S. employer<\/span> can extend a job offer, the employer should get a\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-laws-and-regulations\/obtaining-an-alien-labor-certification.html\">labor certification<\/a>. During the <span data-term-id=\"58342379\">labor certification process<\/span>, the <span data-term-id=\"58342349\">DOL<\/span> certifies to the <span data-term-id=\"58342335\">USCIS<\/span> that there is a lack of available <span data-term-id=\"58342343\">U.S. workers<\/span> qualified, able, and willing to take the job. Employers must also show that the job opening to <span data-term-id=\"58342334\">foreign workers<\/span> will not create an adverse impact on the <span data-term-id=\"58342345\">working conditions<\/span> and prevailing wage rate of U.S. employees or <span data-term-id=\"58342370\">U.S. citizens<\/span>.<\/p>\n<p>Participating in the labor certification program is the employer\u2019s responsibility. The <span data-term-id=\"58342349\">DOL<\/span> generally ensures that <span data-term-id=\"58342348\">hiring <\/span><span data-term-id=\"58342334\">foreign workers<\/span> is in good faith. They also check that it does not create adverse impacts on <span data-term-id=\"58342343\">U.S. workers<\/span>.<\/p>\n<h2><span data-term-id=\"58342363\">Employment Eligibility Verification<\/span><\/h2>\n<p>The federal government requires employers to verify their employees\u2019 eligibility to work in the United States. Employers must complete the\u00a0<a href=\"https:\/\/www.uscis.gov\/i-9\" target=\"_blank\" rel=\"noopener\">Employee Eligibility Verification (Form I-9)<\/a>\u00a0within three days after hiring an employee. This rule applies to both <span data-term-id=\"58342370\">U.S. citizens<\/span> and <span data-term-id=\"58342378\">noncitizen<\/span> employees.<\/p>\n<p>The employee should attest to their right to work in the United States. They should also submit evidence of their identity. Evidence includes their passport, birth certificate, <span data-term-id=\"58342362\">Social Security<\/span> number, and other relevant document. After submission, employers should check these documents to assess their authenticity.<\/p>\n<p>All <span data-term-id=\"58342340\">U.S. employers<\/span>\u00a0<a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/foia\/Employer_Responsibility.pdf#:~:text=All%20employers%20must%20verify%20that%20each%20individual%20who,can%20result%20in%20severe%20penalties%20against%20the%20employer.\" target=\"_blank\" rel=\"noopener\">should verify<\/a>\u00a0that all employees hired are eligible for employment there. Failure to verify employment eligibility could result in severe consequences against the <span data-term-id=\"58342340\">U.S. employer<\/span>.<\/p>\n<h3>What Is E-Verify?<\/h3>\n<p>The\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/business-laws-and-regulations\/e-verify-basics.html\">E-Verify system<\/a>\u00a0is an online database managed by the <span data-term-id=\"58342356\">DHS<\/span> in partnership with the <span data-term-id=\"58342362\">Social Security<\/span> Administration. Employers can use it to check potential employees\u2019 employment eligibility. Through E-Verify, employers can compare information provided by the employee to records available from the U.S. Department of <span data-term-id=\"58342376\">Homeland Security<\/span> (<span data-term-id=\"58342356\">DHS<\/span>) and the <span data-term-id=\"58342362\">Social Security<\/span> Administration (SSA).<\/p>\n<p>In general, E-Verify is not required for U.S. businesses. However, federal and state contractors must use the system.\u00a0Some states\u00a0have passed laws requiring public and private employers to use E-Verify for all new employees.<\/p>\n<h2>Can Employers Check <span data-term-id=\"58342368\">Immigration Status<\/span> After Hiring?<\/h2>\n<p>The\u00a0<a href=\"https:\/\/www.ice.gov\/factsheets\/i9-inspection\" target=\"_blank\" rel=\"noopener\">Immigration Reform and Control Act (IRCA) of 1986<\/a>\u00a0requires employers to check employees\u2019 eligibility to work in the United States. Employers should not question the employee\u2019s <span data-term-id=\"58342368\">immigration status<\/span> after hiring. But there are certain situations where more verification is essential and lawful.<\/p>\n<p>For instance, <span data-term-id=\"58342340\">U.S. employers<\/span> should re-verify employees whose work permits are about to expire. <span data-term-id=\"58342340\">U.S. employers<\/span> should also follow the guidelines set by the\u00a0<a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/information-for-employers-and-employees\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"58342341\">U.S. Citizenship and Immigration Services<\/span> (<span data-term-id=\"58342335\">USCIS<\/span>)<\/a>.<\/p>\n<h2>Permanent and <span data-term-id=\"58342377\">Temporary Workers<\/span><\/h2>\n<p>There are two main categories of employment visas: permanent and temporary <span data-term-id=\"58342364\">work visas<\/span>.<\/p>\n<h3>Permanent <span data-term-id=\"58342364\">Work Visa<\/span><\/h3>\n<p>Thousands of\u00a0<span data-term-id=\"58342381\">employment-based immigrant visas<\/span>\u00a0are available to <span data-term-id=\"58342378\">noncitizens<\/span> every <span data-term-id=\"58342358\">fiscal year<\/span>. <span data-term-id=\"58342334\">Foreign workers<\/span> who have the right combination of education, skills, and\/or work experience may be able to secure <a href=\"https:\/\/www.uscis.gov\/working-in-the-united-states\/permanent-workers\" target=\"_blank\" rel=\"noopener\">permanent <span data-term-id=\"58342364\">work visas<\/span><\/a>.<\/p>\n<ul>\n<li>The process starts with an immigrant visa petition filed with the <span data-term-id=\"58342335\">USCIS<\/span> on behalf of the <span data-term-id=\"58342351\">foreign national<\/span>. For some categories, it begins with applying for Permanent Labor Certification with the <span data-term-id=\"58342349\">DOL<\/span>.<\/li>\n<li><span data-term-id=\"58342334\">Foreign workers<\/span> living in the U.S. may seek an a<a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/immigration-through-adjustment-of-immigrant-status.html\">djustment of status<\/a> to LPR status. This is done by filing <a href=\"https:\/\/www.uscis.gov\/i-485\" target=\"_blank\" rel=\"noopener\">Form I-485<\/a>, the Application to Register <span data-term-id=\"58342338\">Permanent Residence<\/span> or Adjustment of Status.<\/li>\n<li>For <span data-term-id=\"58342334\">foreign workers<\/span> outside the U.S. or processing their documents in their home country,\u00a0<span data-term-id=\"58342364\">work visas<\/span>\u00a0are processed at the <a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-laws-and-resources\/u-s-embassy-consulate-guide.html\">U.S. embassy<\/a> or through consular processing. The <span data-term-id=\"58342334\">foreign worker<\/span> must complete the Form DS-260 or the online <span data-term-id=\"58342346\">Visa Application<\/span>.<\/li>\n<li>\n<p>The applicant should provide the biometrics required, medical information, and other supporting documentation. The <span data-term-id=\"58342346\">visa applicant<\/span> must also meet other eligibility requirements for the immigrant visa or adjustment of status.<\/p>\n<\/li>\n<\/ul>\n<p>Congress issues a numerical limit on the number of employment-based visas issued every <span data-term-id=\"58342358\">fiscal year<\/span>. With this numerical limit, <span data-term-id=\"58342334\">foreign workers<\/span> can obtain LPR status only if an immigrant\u00a0<a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/visa-availability-and-priority-dates\" target=\"_blank\" rel=\"noopener\">visa is\u00a0<\/a><a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-processes-and-procedures\/visa-availability-and-priority-dates\" target=\"_blank\" rel=\"noopener\">available<\/a>. This availability is often based on the <span data-term-id=\"58342383\">visa category<\/span>, priority date, and country of origin.<\/p>\n<p>Family members of the primary <span data-term-id=\"58342346\">visa applicant<\/span> are also considered in the immigration process. Although the main focus of the employment-based visa is the employee, the U.S. government also <a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-overview\/family-preference-and-immediate-relative-petitions-the-basics.html\">prioritizes their family members<\/a>.<\/p>\n<h3>Temporary <span data-term-id=\"58342364\">Work Visas<\/span><\/h3>\n<p>You may also come to the U.S. temporarily as a nonimmigrant worker. Your <span data-term-id=\"58342354\">prospective employer<\/span> in the U.S. should generally file a <a href=\"https:\/\/www.findlaw.com\/immigration\/visas\/temporary-visas.html\">temporary <span data-term-id=\"58342342\">nonimmigrant visa<\/span><\/a> petition on your behalf with the <span data-term-id=\"58342335\">USCIS<\/span>. There are only a few nonimmigrant classifications that allow you to work in the U.S. without having an employer first file a work petition on your behalf.<\/p>\n<h2>Employee\u2019s Rights Under Anti-Discrimination Laws<\/h2>\n<p>The U.S. Equal Employment Opportunity Commission protects immigrants from\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/employment-discrimination-against-immigrants-overview.html\">employment discrimination<\/a>. The Equal Employment Opportunity Commission (EEOC) enforces these protections. EEOC is a federal agency that enforces laws that\u00a0<a href=\"https:\/\/www.eeoc.gov\/laws\/guidance\/fact-sheet-immigrants-employment-rights-under-federal-anti-discrimination-laws\" target=\"_blank\" rel=\"noopener\">prohibit employment discrimination<\/a>\u00a0based on:<\/p>\n<ul>\n<li>Race<\/li>\n<li>National origin<\/li>\n<li>Religion<\/li>\n<li>Sex<\/li>\n<li>Age<\/li>\n<\/ul>\n<p>Most <span data-term-id=\"58342340\">U.S. employers<\/span> with 15 or more employees must <a href=\"https:\/\/www.eeoc.gov\/overview\" target=\"_blank\" rel=\"noopener\">follow EEOC laws<\/a>. Labor unions and employment agencies should also follow this rule. Anti-discrimination laws apply to all types of work scenarios. No one should discriminate when hiring, firing, promoting, or training employees. Employers should also offer fair wages and benefits to their employees.<\/p>\n<h3>Discrimination Based on Ancestry<\/h3>\n<p>Discrimination may include discrimination based on a person\u2019s customs, looks, or language. In these cases, the person doesn\u2019t need to prove ancestral ties to a specific country or region. For instance, the person may appear Mexican and experience discrimination based on specific characteristics, even though they aren\u2019t Mexican.<\/p>\n<h3>Harassment Based on National Origin<\/h3>\n<p>Verbal or physical conduct based on one\u2019s nationality, such as ethnic slurs, is illegal. This is particularly relevant if these acts create a <a href=\"https:\/\/www.findlaw.com\/legalblogs\/small-business\/employers-what-is-a-hostile-work-environment\/\">hostile or pervasive work environment<\/a>. Or it interferes with performance at work or impacts job opportunities. Examples of this harassment include comments such as &#8220;Go back to where you came from.&#8221;<\/p>\n<h3>Discrimination Based on Accent<\/h3>\n<p>Discrimination based on a foreign accent is unlawful unless the accent significantly affects job performance. For instance, if effective English communication is a requirement for doing one\u2019s job. But a migrant with a foreign accent who can communicate in English and people understand them should not face discrimination.<\/p>\n<h2>What Does the Immigration and Nationality Act Say About Discrimination?<\/h2>\n<p>The <a href=\"https:\/\/www.findlaw.com\/immigration\/immigration-laws-and-resources\/basic-immigration-laws.html\">Immigration and Nationality Act<\/a> (<span data-term-id=\"58342380\">INA<\/span>) has an anti-discrimination provision.
