Employers enrolled in E-Verify can now conduct online confirmation or remote video inspections.<\/p>\n\n    <\/div>\n\n\n\n<p>Although the federal government has always required business owners to verify an employee\u2019s eligibility to work in the U.S., the <span data-term-id=\"54248755\">Department of Homeland Security<\/span> (<span data-term-id=\"54248763\">DHS<\/span>) and <span data-term-id=\"54248773\">U.S. Immigration and Customs Enforcement<\/span> have made recent changes to how this is to be accomplished, and have begun strictly enforcing <span data-term-id=\"54248749\">employment eligibility verification<\/span>.<\/p>\n<p>Employers are required to complete I-9 forms within three days after hiring an employee. The employee fills out basic information such as his or her name, date of birth, address and <span data-term-id=\"54248758\">Social Security number<\/span>, and then the employer certifies that the employee has presented documentation confirming his or her right to work in the U.S. The documentation is from the <span data-term-id=\"54248761\">lists of <\/span><span data-term-id=\"54248752\">acceptable documents<\/span> on the form.<\/p>\n<p>Fortunately, although the government will now enforce this requirement more stringently, it has also made complying with <span data-term-id=\"54248749\">employment eligibility verification<\/span> easier on employers. Employers can now store I-9 forms electronically, check the <span data-term-id=\"54248749\">employment eligibility verification<\/span> forms online, and learn about what to do if the employee\u2019s information does not match the information provided by the government.<\/p>\n<h2>Verify Employment Eligibility Online<\/h2>\n<p>Employers may voluntarily use the <span data-term-id=\"54248754\">E-Verify<\/span> system (formerly known as the Basic Pilot Program), accessible through <a href=\"https:\/\/www.uscis.gov\/\" target=\"_blank\" rel=\"noopener\">www.uscis.gov<\/a>, to verify employment eligibility online. Here are the basic steps to get going on <span data-term-id=\"54248754\">E-Verify<\/span>:<\/p>\n<ul>\n<li>\n<p>You must first enroll in the program and sign a Memorandum of Understanding with the Social Security Administration (SSA) and the <span data-term-id=\"54248755\">Department of Homeland Security<\/span> (<span data-term-id=\"54248763\">DHS<\/span>).<\/p>\n<\/li>\n<li>\n<p>Once your new hire has completed his or her I-9, you log on to the secure <span data-term-id=\"54248763\">DHS<\/span> site given to you when you enrolled in the program. There you can input the employee\u2019s name, date of birth and <span data-term-id=\"54248758\">Social Security number<\/span>.<\/p>\n<\/li>\n<li>\n<p>The system will then either immediately report that the employee is authorized, that <span data-term-id=\"54248763\">DHS<\/span> will work on confirming authorization, or ask the employee to contact either the <span data-term-id=\"54248763\">DHS<\/span> or SSA to clear up a potential issue.<\/p>\n<\/li>\n<\/ul>\n<p>If a new hire is not authorized, the system issues a <a href=\"https:\/\/www.e-verify.gov\/employees\/employee-rights-and-responsibilities\" target=\"_blank\" rel=\"noopener\">\u201cTentative Nonconfirmation<\/a>\u201d and the employer must follow up with the new hire to resolve the problem. The employer provides the new hire with a Further Action Notice with information on how to resolve the mismatch and a Referral Date Confirmation with a deadline to contact the <span data-term-id=\"54248763\">DHS<\/span> or SSA to resolve the mismatch.<\/p>\n<h2>Remote Verification Option (Effective August 1, 2023)<\/h2>\n<p>There have been changes to the <span data-term-id=\"54248783\">verification process<\/span> where employers who participate in the <span data-term-id=\"54248754\">E-Verify<\/span> system and are in good standing may conduct verifications with remote employees. This <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/remote-form-i-9-verification-process-after-august-2023.html\">new <span data-term-id=\"54248777\">Form I-9 process<\/span><\/a> allows an authorized person from the company to conduct live video interactions with employees.<\/p>\n<p>Employers must <span data-term-id=\"54248751\">complete Form I-9<\/span> using a <span data-term-id=\"54248782\">version of Form I-9<\/span> dated 8\/1\/2023 or later, and check the \u2018alternative procedure\u2019 option for remote verifications. They perform a document inspection by live video with the remote employee to review the <span data-term-id=\"54248752\">acceptable documents<\/span>. Note: There is a new version with an expiration date 5\/31\/2027 that must be used after July 31, 2026.<\/p>\n<p>After the <span data-term-id=\"54248750\">employment authorization<\/span>, the employer then keeps a copy of the <span data-term-id=\"54248766\">completed form<\/span> and <span data-term-id=\"54248768\">I-9 documentation<\/span> on file.<\/p>\n<p>You may want to talk to an <a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employer\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">employment attorney<\/a> about the correct procedures to verify employment eligibility.<\/p>\n<h2>Storing <span data-term-id=\"54248749\">Employment Eligibility Verification<\/span> I-9 Forms Electronically<\/h2>\n<p>Electronic storage of I-9 forms is now explicitly allowed by recent regulations. While the regulations do not set forth a specific manner in which to store these records, they do mandate that whatever electronic storage medium is used:<\/p>\n<ul>\n<li>\n<p>Have reasonable safeguards in place to prevent unauthorized access<\/p>\n<\/li>\n<li>\n<p>Ensure the accuracy and integrity of the records<\/p>\n<\/li>\n<li>\n<p>Allow the records to be searched<\/p>\n<\/li>\n<li>\n<p>Allow the records to be reproduced in a hard copy<\/p>\n<\/li>\n<\/ul>\n<h2>Dealing with Discrepancies between Employee and Government-Provided Information<\/h2>\n<p>There are several reasons for the system to not immediately authorize an employee; here are the most common scenarios that take place:<\/p>\n<ul>\n<li>\n<p>If the <span data-term-id=\"54248758\">Social Security number<\/span> and name match existing records, you will receive a message saying that the employee is authorized to work and you\u2019re done.<\/p>\n<\/li>\n<li>\n<p>If the <span data-term-id=\"54248758\">Social Security number<\/span> and name match, but the system cannot verify whether that employee is authorized to work in the U.S., then you will receive a message that says the <span data-term-id=\"54248763\">DHS<\/span> is working to verify his or her authorization and the <span data-term-id=\"54248763\">DHS<\/span> will typically provide an answer within one to three days.<\/p>\n<\/li>\n<li>\n<p>If the <span data-term-id=\"54248763\">DHS<\/span> cannot confirm that the individual is authorized to work in the U.S., then it will notify you to inform the employee to report directly to the <span data-term-id=\"54248763\">DHS<\/span> to clear up the issue.<\/p>\n<\/li>\n<li>\n<p>If the <span data-term-id=\"54248758\">Social Security number<\/span> and name do not match, then the employee is directed to contact the SSA to clear up the issue.<\/p>\n<\/li>\n<\/ul>\n<p>Most issues will be resolved within a week of submitting an online I-9, but in problematic cases, the employee will have to submit documentation and photographs to establish his or her identity and authorization to work in the U.S. If the employee cannot establish his or her identity and authorization to work in the U.S., then you must terminate his or her employment to avoid liability.<\/p>\n<h2>Get Legal Help with Your <span data-term-id=\"54248749\">Employment Eligibility Verification<\/span> Questions<\/h2>\n<p><span data-term-id=\"54248749\">Employment eligibility verification<\/span> rules are subject to change and can involve complicated issues for some businesses.
