Some examples of permissible pay docking include, but are not limited to:<\/p>\n<ul>\n<li><span data-term-id=\"28584261\">Absences<\/span> of one or more full days for <span data-term-id=\"28584265\">personal reasons<\/span> unrelated to sickness or accident<\/li>\n<li><span data-term-id=\"28584261\">Absences<\/span> of one or more full days for sickness or disability, if you have a benefit plan that covers these <span data-term-id=\"28584261\">absences<\/span> and the employee has exhausted their benefits<\/li>\n<li>To offset any amount received from <span data-term-id=\"28584281\">jury duty<\/span>, <span data-term-id=\"28584323\">witness fees<\/span>, or <span data-term-id=\"28584268\">military pay<\/span> (beyond this, you can&#8217;t deduct for these <span data-term-id=\"28584261\">absences<\/span>)<\/li>\n<li>As a penalty for violating <span data-term-id=\"28584315\">safety rules<\/span> of major significance or as a disciplinary suspension under company policy (workers must be subject to the penalties and employees must know of the penalties before they receive them)<\/li>\n<li>For <span data-term-id=\"28584295\">unpaid disciplinary suspensions<\/span> of one or more full days imposed in good faith for violations of significant workplace conduct rules (such as policies against sexual harassment or workplace violence)<\/li>\n<li>For intermittent unpaid leave under the <span data-term-id=\"28584271\">FMLA<\/span> (a salaried worker may convert to hourly under <span data-term-id=\"28584271\">FMLA<\/span> without losing their status)<\/li>\n<\/ul>\n<p>All deductions to an <span data-term-id=\"28584285\">exempt employee&#8217;s salary<\/span> are in <span data-term-id=\"28584287\">full-day increments<\/span>, unless under <span data-term-id=\"28584271\">FMLA<\/span>. If the employee worked any part of the day, their employer can\u2019t <span data-term-id=\"28584270\">dock pay<\/span> for that workday. Some exceptions apply. For example, if it\u2019s the employee\u2019s first or last week of employment and they leave mid-week after working only a\u00a0<span data-term-id=\"28584267\">partial day<\/span>, they only need to be paid for the\u00a0time worked.<\/p>\n<h2>When Is Pay Docking Not Allowed?<\/h2>\n<p>Exempt employees must get their <span data-term-id=\"28584279\">full salary<\/span> regardless of the <span data-term-id=\"28584317\">number of days<\/span> or hours worked. <span data-term-id=\"28584255\">FLSA<\/span> rules prohibit pay docking\u00a0based on the &#8220;quality or quantity&#8221; of the work. The employee must receive the <span data-term-id=\"28584311\">predetermined amount<\/span> if they work during the <span data-term-id=\"28584256\">pay period<\/span>. If work is unavailable, but the employee is available and able to work, they must get paid as if they were on the job.<\/p>\n<p>An employer cannot dock an <span data-term-id=\"28584285\">exempt employee&#8217;s salary<\/span> for:<\/p>\n<ul>\n<li><strong><span data-term-id=\"28584267\">Partial-day<\/span> <span data-term-id=\"28584261\">absences<\/span><\/strong>: If an exempt employee works for any part of a day, they must be paid for the full day<\/li>\n<li><strong>Lack of work<\/strong>: If work is unavailable but the employee is ready to work, their salary cannot be reduced<\/li>\n<li><strong>Performance or quality of work<\/strong>: Salary is not tied to the quality or quantity of work produced in a given week<\/li>\n<li><strong><span data-term-id=\"28584281\">Jury duty<\/span> or military leave<\/strong>: While you can offset pay by the amount the employee receives for these duties, you cannot make deductions beyond that<\/li>\n<\/ul>\n<p>The <a href=\"https:\/\/www.dol.gov\/sites\/dolgov\/files\/WHD\/legacy\/files\/FOH_Ch22.pdf\" target=\"_blank\" rel=\"noopener\"><span data-term-id=\"28584301\">U.S. <\/span><span data-term-id=\"28584259\">Department of Labor<\/span><\/a> notes that <span data-term-id=\"28584258\">salaried employees<\/span> cannot have their pay docked for \u201closs of equipment,\u201d such as damage to a company laptop.<\/p>\n<p><span data-term-id=\"28584283\">Improper deductions<\/span> can lead to penalties. Pay can only be withheld if the business is shut down for an entire full <span data-term-id=\"28584252\">workweek<\/span> in which zero work is performed.<\/p>\n<p>An involuntary deduction in an <span data-term-id=\"28584313\">exempt worker<\/span>&#8216;s pay due to a slowdown violates <span data-term-id=\"28584255\">FLSA<\/span> regulations. If the employee is &#8220;ready, willing, and able to work,&#8221; the employer may not send them home or cut their pay if work is slow.
