Everyone is hunting for the <span data-term-id=\"27744986\">best employees<\/span> they can find, so\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/writing-effective-job-descriptions.html\">how you write your <span data-term-id=\"27744942\">job description<\/span><\/a>\u00a0matters.<\/p>\n<p>It may surprise you to learn that there are some legal requirements for a job listing. Employers do not have to have any <span data-term-id=\"27744942\">job description<\/span> at all.\u00a0If they do have one, some things must\u00a0be\u00a0included:<\/p>\n<ul>\n<li>\n<p>The\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/discrimination-in-hiring-and-the-americans-with-disability-act.html\">Americans with Disabilities Act<\/a>\u00a0(ADA) requires all <span data-term-id=\"27744942\">job descriptions<\/span> to include the &#8220;essential job functions.&#8221; These are the duties that a worker must perform with or without accommodations. An essential function is not what an employer might prefer workers be able to do. For instance, a warehouse worker needs to\u00a0be able to lift at least 50 pounds, but a secretary does not.<\/p>\n<\/li>\n<li>\n<p><a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/title-vii-of-the-civil-rights-act-of-1964-equal-employment.html\">Title VII of the Civil Rights Act<\/a>\u00a0prohibits <span data-term-id=\"27744958\">job ads<\/span> that discriminate against protected classes. Employers must beware of subtle discriminatory language\u00a0such as &#8220;all applicants must be U.S. citizens,&#8221; which is illegal and also biased against those who have legal work authorization. However, employers must verify that every hired applicant is legally authorized to work in the U.S.<\/p>\n<\/li>\n<li>\n<p>The\u00a0<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/equal-employment-opportunity-age-discrimination.html\">Age Discrimination in Employment Act<\/a>\u00a0(ADEA) prohibits employers from discriminating against applicants over 40.\u00a0Discriminatory language\u00a0such as &#8220;We&#8217;re a young and tech-savvy company,&#8221;\u00a0may discourage older workers from applying and can be a violation.<\/p>\n<\/li>\n<\/ul>\n<p>Writing good <span data-term-id=\"27744942\">job descriptions<\/span> is more complex than posting on <span data-term-id=\"27744950\">social media<\/span>. You should\u00a0<a href=\"https:\/\/lawyers.findlaw.com\/employment-law-employee\/?fli=dcta\" target=\"_blank\" rel=\"noopener\">consult an employment attorney<\/a>\u00a0and an HR professional if you have questions about listing a <span data-term-id=\"27744970\">job opening<\/span>.<\/p>\n<h2><strong>Interviewing and <span data-term-id=\"27744951\">Job Offers<\/span><\/strong><\/h2>\n<p>Like writing the <span data-term-id=\"27744942\">job description<\/span>, some things are\u00a0not legal to say\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/best-practices-for-employers-in-a-hiring-interview.html\">during a job interview<\/a>. Both federal and state laws limit the questions you may ask <span data-term-id=\"27744980\">job candidates<\/span>. Some questions to avoid include:<\/p>\n<ul>\n<li>\n<p>Asking\u00a0about a candidate&#8217;s religion, race, gender, sexual orientation, or age<\/p>\n<\/li>\n<li>\n<p>Asking if a prospective employee will need a reasonable accommodation for a disability<\/p>\n<\/li>\n<li>\n<p>Asking if a candidate has a criminal history beyond what your state&#8217;s employment guidelines allow<\/p>\n<\/li>\n<li>\n<p>Asking if your candidate has a drug or alcohol problem<\/p>\n<\/li>\n<\/ul>\n<p>Employers\u00a0shouldn&#8217;t make\u00a0promises about future employment, <span data-term-id=\"27744976\">perks<\/span>,\u00a0benefits, or other things that can get them in trouble later.<\/p>\n<h2><strong>Pre-Employment Testing<\/strong><\/h2>\n<p><a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/pre-employment-tests.html\">Pre-employment testing<\/a>\u00a0is part of the <span data-term-id=\"27744953\">recruitment process<\/span>. It can help you find the <span data-term-id=\"27744969\">right candidate<\/span> but\u00a0also open you to liability and lawsuits if done incorrectly. In general, pre-employment tests fall into two categories:<\/p>\n<ul>\n<li>\n<p><strong>Tests you can give before a <span data-term-id=\"27744951\">job offer<\/span><\/strong>:\u00a0In most states, you may give skills-based tests, personality tests, and integrity tests prior to a <span data-term-id=\"27744951\">job offer<\/span>.<\/p>\n<\/li>\n<li>\n<p><strong>Tests you may only give after a conditional <span data-term-id=\"27744951\">job offer<\/span><\/strong>:\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/drug-testing-during-hiring.html\">Drug testing<\/a>\u00a0and other medical exams must wait until after an offer of employment. The ADA considers\u00a0drug and alcohol addiction to be disabilities, so don&#8217;t make <span data-term-id=\"27744978\">hiring decisions<\/span> based on their existence.<\/p>\n<\/li>\n<\/ul>\n<p>Other types of pre-employment testing are often\u00a0done after a <span data-term-id=\"27744951\">job offer<\/span> because of related costs and time.\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/performing-an-employee-background-check.html\">Background<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/checking-the-credit-information-of-job-applicants.html\">credit checks\u00a0<\/a>may take several days or weeks, so there is no point running them until you choose a candidate.<\/p>\n<p>In some cases, a\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/what-to-do-when-you-hire-an-employee-for-the-first-time.html\"><span data-term-id=\"27744944\">new hire<\/span><\/a>\u00a0may need to permit a credit history or criminal <span data-term-id=\"27744957\">background check<\/span>. Employers should confirm what they need\u00a0with their <span data-term-id=\"27744960\">human resources<\/span> or employment law attorney\u00a0before beginning the <span data-term-id=\"27744972\">onboarding<\/span><span data-term-id=\"27744972\"> process<\/span>.<\/p>\n<h2><strong><span data-term-id=\"27744957\">Background Checks<\/span> &amp; Screening Compliance<\/strong><\/h2>\n<p>When <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/performing-an-employee-background-check.html\">conducting <span data-term-id=\"27744957\">background checks<\/span><\/a> and screening of prospective employees, employers must comply with federal and state laws. The Fair Credit Reporting Act (FCRA) governs the screening process for education verification, credit history, and criminal <span data-term-id=\"27744957\">background checks<\/span>. The employer must <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/fcra-consent-disclosure-checklist-for-criminal-background-checks.html\">follow certain procedures under the FCRA<\/a> such as providing a disclosure and summary of rights to the applicant, obtaining written consent from the applicant, and providing any pre-adverse or adverse action notices.<\/p>\n<p>Additionally, employers must know if their state or local area has Fair Chance or <a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/ban-the-box-laws-by-state.html\">\u2018Ban the Box\u2019 rules <\/a>which limit employers from asking about criminal history before giving a conditional <span data-term-id=\"27744951\">job offer<\/span> to an applicant.<\/p>\n<h2><strong>Independent Contractors vs. Employees<\/strong><\/h2>\n<p><span data-term-id=\"27744990\">Small business<\/span><span data-term-id=\"27744990\"> hiring<\/span> practices today often involve independent contractors. Having someone come in for a few days or weeks may be more cost-effective than hiring a <span data-term-id=\"27744943\">new employee<\/span>.\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/hiring-independent-contractors.html\">Independent contractors<\/a>\u00a0pay their\u00a0employment taxes and do not receive employee benefits. They may receive higher payment for the job, but\u00a0leave when\u00a0finished.<\/p>\n<p>Employers must classify contractors correctly. The IRS has an extensive list of factors it uses to determine if a worker is an employee or an independent contractor. The <span data-term-id=\"27744985\">job title<\/span> of\u00a0an\u00a0independent contractor\u00a0is not sufficient. Other factors include:<\/p>\n<ul>\n<li>\n<p><strong>The degree of autonomy the worker has<\/strong>:\u00a0If the worker must wear a company uniform, follow a restrictive schedule, and clock in and out at a specific location, the IRS will consider them an employee, not a contractor.<\/p>\n<\/li>\n<li>\n<p><strong>The purpose for which the employer hired the contractor<\/strong>:\u00a0If the purpose is outside general <span data-term-id=\"27744989\">business needs<\/span> and the contractor was hired for a particular <span data-term-id=\"27744975\">skill set<\/span>, they are not usually employees.<\/p>\n<\/li>\n<li>\n<p><strong>The duration of the employment<\/strong>:\u00a0A fixed term of employment is more likely indicative of contractor status.<\/p>\n<\/li>\n<\/ul>\n<p>Employers\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/be-careful-when-hiring-a-contractor.html\">must use caution<\/a>\u00a0when hiring independent contractors. Penalties and fines for misclassifying employees are severe and expensive. Federal laws exist that prevent:<\/p>\n<ul>\n<li>\n<p>Discrimination based on race, color, national origin, sex, religion, and genetic information (<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/title-vii-of-the-civil-rights-act-of-1964-equal-employment.html\">Title VII<\/a>\u00a0and\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/genetic-information-discrimination-.html\">GINA<\/a>)<\/p>\n<\/li>\n<li>\n<p>Unequal payment based on gender (<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/equal-pay-act-of-1963.html\">Equal Pay Act<\/a>)<\/p>\n<\/li>\n<li>\n<p>Discrimination based on age (<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/age-discrimination-in-employment-act-of-1967.html\">ADEA<\/a>)<\/p>\n<\/li>\n<li>\n<p>Discrimination against disabled workers (<a href=\"https:\/\/www.findlaw.com\/employment\/employment-discrimination\/americans-with-disabilities-act-of-1990-titles-i-and-v.html\">ADA<\/a>)<\/p>\n<\/li>\n<li>\n<p><a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/hiring-minors-for-your-business.html\">Hiring minors<\/a>\u00a0in hazardous occupations<\/p>\n<\/li>\n<\/ul>\n<p>Employers must verify that a person is\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/employment-eligibility-verification.html\">legally eligible to work\u00a0<\/a>in the United States within three days of an employee&#8217;s start date. <span data-term-id=\"27744952\">Interview questions<\/span> must follow federal laws and cannot discriminate against any group.<\/p>\n<h2><strong>Contracts and Employment Agreements<\/strong><\/h2>\n<p>Whether this is your <span data-term-id=\"27745004\">first employee<\/span> or the most recent of a hundred, you should have a\u00a0<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/pros-and-cons-of-written-employee-contracts.html\">written employment agreement<\/a>\u00a0and an employee handbook.
