You want the same protection for your trademark or service mark. What are the requirements for a trademark? For example, the green mermaid logo on Starbucks&#8217; cups and signage is protected by a trademark.<\/p>\r\n<h2>Who Can Register a Trademark With the USPTO?<\/h2>\r\n<p>Anybody looking to protect a distinct mark can apply for a trademark. But, most trademark owners have a businesses or are in the service industry.<\/p>\r\n<p>Some of the people who commonly submit&nbsp;<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/intellectual-property\/registering-a-trademark.html\">trademark applications<\/a>&nbsp;include:<\/p>\r\n<ul>\r\n<li>Entrepreneurs<\/li>\r\n<li>Startup companies<\/li>\r\n<li>Small business owners<\/li>\r\n<li>Manufacturers<\/li>\r\n<\/ul>\r\n<p>Essentially, anyone in the goods and services markets may need trademark protection. Some want legal protection for their business name, and others want to trademark their logo as a registered mark. This includes brick-and-mortar operations and people who do business online or on social media.<\/p>\r\n<h2>What&#8217;s the Difference Between a Trademark and a Service Mark?<\/h2>\r\n<p>Although many people use the terms &quot;<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/intellectual-property\/what-is-a-trademark.html\">trademark<\/a>&quot; and &quot;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/service-mark.html\" target=\"_blank\" rel=\"noopener\">service mark<\/a>&quot; interchangeably, there is a difference between the two. If you use a mark to identify and distinguish goods, it&#8217;s a trademark. If you&#8217;re using it to identify a service, it&#8217;s a service mark.<\/p>\r\n<p>The law doesn&#8217;t require small business owners or others to seek trademark registration from the&nbsp;<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/intellectual-property\/the-u-s-patent-and-trademark-office.html\">U.S. Patent and Trademark Office<\/a>&nbsp;(USPTO). But registration has benefits.<\/p>\r\n<p>Some of these benefits include the following:<\/p>\r\n<ul>\r\n<li>The legal presumption that you&#8217;re the trademark owner<\/li>\r\n<li>Your mark will appear in the&nbsp;<a href=\"https:\/\/www.uspto.gov\/trademarks\/search\" target=\"_blank\" rel=\"noopener\">trademark electronic search system<\/a><\/li>\r\n<li>Exclusive right to use the mark<\/li>\r\n<li>Ability to file a lawsuit for trademark infringement<\/li>\r\n<\/ul>\r\n<h2>How To Register Your Trademark or Service Mark<\/h2>\r\n<p>If you want a registered trademark, you must follow specific&nbsp;<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/intellectual-property\/how-to-register-a-trademark-with-the-uspto-faq.html\">procedures<\/a>. According to the United States Patent and Trademark Office application process, your trademark application must include a clear&nbsp;<a href=\"https:\/\/corporate.findlaw.com\/intellectual-property\/the-proper-selection-use-and-protection-of-trademarks-corporate.html#:~:text=A%20Trademark%20is%20any%20word%2C%20phrase%2C%20symbol%2C%20logo%2C,them%20from%20the%20goods%20or%20services%20of%20another.\" target=\"_blank\" rel=\"noopener\">description of the mark<\/a>&nbsp;and a drawing.<\/p>\r\n<p>The USPTO then uses the drawing to file the mark in its search records. According to U.S. trademark law, your trademark application must include the following information:<\/p>\r\n<ul>\r\n<li>The applicant&#8217;s name<\/li>\r\n<li>A name and address for communication<\/li>\r\n<li>A precise drawing of the mark<\/li>\r\n<li>Proposed use of the mark<\/li>\r\n<li>A list of the goods or services associated with the mark<\/li>\r\n<li>The filing fee<\/li>\r\n<\/ul>\r\n<p>The&nbsp;<a href=\"https:\/\/www.uspto.gov\/trademarks\/trademark-fee-information\" target=\"_blank\" rel=\"noopener\">filing fees<\/a>&nbsp;are different depending on which type of application you file. When you file your initial application, you must choose between a&nbsp;<a href=\"https:\/\/www.uspto.gov\/trademarks\/apply\/form-teas-plus-application-trademark-or-service-mark\" target=\"_blank\" rel=\"noopener\">TEAS Plus<\/a>&nbsp;and a&nbsp;<a href=\"https:\/\/www.uspto.gov\/trademarks\/apply\/form-teas-rf-application-trademark-or-service-mark\" target=\"_blank\" rel=\"noopener\">TEAS standard<\/a>. A TEAS Plus costs less ($250), but stricter requirements exist. The TEAS Standard costs a little more ($350), but the upfront requirements are fewer.<\/p>\r\n<h2>The Drawing of Your Mark<\/h2>\r\n<p>Regardless of the type of application you file, you must include a drawing.<\/p>\r\n<p>If you file your application through the USPTO&#8217;s&nbsp;<a href=\"http:\/\/www.uspto.gov\/trademarks-application-process\/filing-online\" target=\"_blank\" rel=\"noopener\">Trademark Electronic Application System (TEAS)<\/a>, it will generate a drawing based on the information you enter into the system. The USPTO&#8217;s&nbsp;<a href=\"https:\/\/www.uspto.gov\/trademarks\/guides-and-manuals\/trademark-examination-guides\" target=\"_blank\" rel=\"noopener\">Examination Guide<\/a>&nbsp;provides more details about drawings you submit electronically.<\/p>\r\n<p>To prepare the drawing yourself, you must follow specific standards. You must use non-shiny white paper that is 8\u00bd by 11 inches. Your mark must be a maximum of 3.5 by 3.5 inches.<\/p>\r\n<p>The paper with the drawing must also include a heading with the following information:<\/p>\r\n<ul>\r\n<li>Applicant&#8217;s name<\/li>\r\n<li>Correspondence address<\/li>\r\n<li><a href=\"https:\/\/www.findlaw.com\/smallbusiness\/intellectual-property\/identification-of-specific-goods-services.html\">Identification<\/a>&nbsp;and description of goods or services<\/li>\r\n<li>Dates you have used the mark or the date of &quot;intent to use&quot;<\/li>\r\n<\/ul>\r\n<p>The drawing can be either a &quot;standard character&quot; or a &quot;stylized or special form&quot; drawing. If you want to register your mark, your drawing must be in color. You must also include a color claim naming the colors that are a feature of the mark and a statement that describes where the colors appear on the mark.<\/p>\r\n<p>Once you file your application, you can&#8217;t make material changes to the mark. You must pay an extra fee to amend the mark or file a new application.<\/p>\r\n<h2>Standard Character vs. Stylized or Special Form Drawings<\/h2>\r\n<p>There are two acceptable formats for drawing your mark: standard character and stylized or special form.<\/p>\r\n<p>The standard character drawing is acceptable if the mark meets the following criteria:<\/p>\r\n<ul>\r\n<li>The letters are in Latin characters<\/li>\r\n<li>The numbers are in Arabic or Roman numerals<\/li>\r\n<li>There are only common punctuation marks<\/li>\r\n<li>There is no design element in the mark<\/li>\r\n<\/ul>\r\n<p>You have the freedom to depict the mark in any font. You can also use uppercase and lowercase letters and bold or italic letters.<\/p>\r\n<p>A standard character drawing must also include the following statement: &quot;The mark is presented in standard character format without claim to any particular font style, size, or color.&quot;<\/p>\r\n<p>If the style of lettering is essential to the mark, or the mark includes a design, logo, or color, you must include a stylized or special-form drawing.
