Patent protection provides exclusive ownership rights to inventors or assignees for a specific period of time. These rights allow patent owners to exclude others from:<\/p>\r\n<ul>\r\n<li>Selling&nbsp;the patented invention<\/li>\r\n<li>Using&nbsp;the patented invention<\/li>\r\n<li>Making&nbsp;the patented invention<\/li>\r\n<li>Importing the patented invention<\/li>\r\n<\/ul>\r\n<h2>What rights does an inventor have in a patent?<\/h2>\r\n<p>Inventors&nbsp;<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/intellectual-property\/how-to-protect-your-invention.html\">hold their patent rights<\/a>&nbsp;until they transfer (assign) them to someone else. Employers may require employee inventors to assign their rights to their patents to the company.<\/p>\r\n<h2>Can multiple people own a patent?<\/h2>\r\n<p>Yes, many inventors can hold the same patent. Each inventor is a part owner if they contributed to the invention. Unless the&nbsp;<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/intellectual-property\/10-tips-for-inventors.html\">inventors have otherwise agreed<\/a>, each is free to use the invention without interference from the others. So, each inventor can independently make, use, sell, license, or assign the invention.<\/p>\r\n<p>If an employer wants complete control over an invention, the employer should arrange for all employees who have worked on an invention to&nbsp;<a href=\"https:\/\/dictionary.findlaw.com\/definition\/assignment.html\" target=\"_blank\" rel=\"noopener\">assign their rights<\/a>&nbsp;to the employer through an assignment provision or assignment clause in their employment contract. These agreements are common in the employment relationship.<\/p>\r\n<h2>How does an employer gain ownership of employees&#8217; inventions?<\/h2>\r\n<p>While the U.S. Patent Act (<a href=\"https:\/\/codes.findlaw.com\/us\/title-35-patents\/\" target=\"_blank\" rel=\"noopener\">35 U.S.C.<\/a>) has provisions on employer-employee relationships and patent ownership, no laws require an employee to assign an invention to an employer.<\/p>\r\n<p>Employers can ensure their ownership through several types of agreements. If an employee invents something within the scope of their employment or uses the employer&#8217;s resources, the employer may have a legal claim to the invention.<\/p>\r\n<p>In an&nbsp;<a href=\"https:\/\/corporate.findlaw.com\/contracts\/compensation\/employment-confidential-information-and-invention-assignment.html\/\" target=\"_blank\" rel=\"noopener\">invention-assignment agreement<\/a>, a company requires an employee to sign over all work-related inventions. Some state laws like California prohibit employers from requiring employees to sign over inventions conceived outside of work on their own time.<\/p>\r\n<p>These agreements may be part of an initial&nbsp;<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/employment-contract-provisions.html\">employment agreement<\/a>&nbsp;or made&nbsp;<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/employment-law-and-human-resources\/creating-an-enforceable-noncompete-agreement.html\">at a later point<\/a>. It is important to document the employee&#8217;s hiring for invention purposes in case a dispute arises. Having a written agreement is the best insurance.<\/p>\r\n<h2>Who owns the inventions of outside contractors?<\/h2>\r\n<p>Companies sometimes hire&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/independent-contractors-overview.html\">outside contractors<\/a>&nbsp;to help work on research or development projects.<\/p>\r\n<p>If a contractor invents something, ownership of the invention may be complex. Under ideal conditions, all inventors concerned will have signed an assignment agreement.<\/p>\r\n<h2>What are &quot;shop rights&quot;?<\/h2>\r\n<p>Shop rights are a company&#8217;s right to use technology whose development it supports. This is not the same as an assignment. It gives an employer who provided funding or work time for the project nonexclusive royalty-free rights to use technology. patent ownership last?<\/h2>\r\n<p>Patent ownership durations vary:<\/p>\r\n<ul>\r\n<li>Utility patents last 20 years from the date of filing your patent application.<\/li>\r\n<li>Design patents
