But, the following circumstances change ownership:<\/p>\r\n<ul>\r\n<li>The copyright owner sells the copyright to another person or a company<\/li>\r\n<li>The work was&nbsp;<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/intellectual-property\/what-is-a-work-made-for-hire.html\">made for hire<\/a><\/li>\r\n<li>The company hires an&nbsp;<a href=\"https:\/\/www.findlaw.com\/employment\/hiring-process\/independent-contractors-overview.html\">independent contractor<\/a>&nbsp;to create the work<\/li>\r\n<\/ul>\r\n<h2>How long does copyright protection last?<\/h2>\r\n<p>Copyright protection begins when you create an original work&nbsp;<a href=\"https:\/\/www.findlaw.com\/smallbusiness\/intellectual-property\/how-long-does-copyright-protection-last.html\">in a tangible form<\/a>. For works published after 1977, protection applies for the following term:<\/p>\r\n<ul>\r\n<li>For 70 years after the death of the author<\/li>\r\n<li>For 70 years after the death of the last surviving author of a joint work<\/li>\r\n<li>For 95 years from the date of publication or 120 years from creation if the work was made for hire by an employee or an independent contractor<\/li>\r\n<\/ul>\r\n<h2>Do I need to register my work with the U.S. Copyright Office to enforce it?<\/h2>\r\n<p>Copyright protection is automatic upon the creation of an original work. But, having a timely registration with the&nbsp;<a href=\"http:\/\/www.copyright.gov\/\" target=\"_blank\" rel=\"noopener\">U.S. Copyright Office<\/a>&nbsp;enhances an owner&#8217;s legal remedies. Under the Copyright Act, an owner of a published work that encounters infringement can collect up to&nbsp;<a href=\"https:\/\/www.copyright.gov\/title17\/chapter5.pdf\" target=\"_blank\" rel=\"noopener\">$150,000<\/a>&nbsp;in statutory damages. Only a statute or law authorizes statutory damages. A copyright owner may get attorney fees for the enforcement action if the registration of the published work happens within three months after the first publication date or before the infringement occurs. An owner of an unpublished work is entitled to the same remedies if the work registration occurs before the infringement.<\/p>\r\n<h2>How do I register a copyrightable work?<\/h2>\r\n<p>An applicant can complete the registration application for a copyright claim with the U.S. Copyright Office through the mail or&nbsp;<a href=\"https:\/\/copyright.gov\/registration\/\" target=\"_blank\" rel=\"noopener\">online<\/a>.
