But a trademark is just as important when goods or services are to be sold on the international market as well. Every country has its own notice laws with regard to trademarks and its own laws and methods of handling trademark disputes, although the <a target=\"_blank\" href=\"http:\/\/www.uspto.gov\/trademark\/laws-regulations\/madrid-protocol\" rel=\"noopener\">Madrid Protocol<\/a> adopted by the World Intellectual Property Organization (WIPO) attempts to simplify the process.<\/p>\n<p>An attorney can help you secure international trademark protection, but the following tips will help you get started. See FindLaw&#8217;s <a href=\"https:\/\/www.findlaw.com\/smallbusiness\/intellectual-property\/trademarks.html\">Trademarks<\/a> section for additional articles and resources.<\/p>\n<h2>Protect Your Trademark Internationally: Tips<\/h2>\n<ul>\n<li><p>Research the forms of notice required in any country where the goods or services will be marketed. For example, determine whether the <sup>TM<\/sup> and \u00ae symbols from your country offer any legal protection in the target market.<\/p>\n<\/li>\n<li><p>Research the laws of the foreign countries so that you understand, before any trouble arises, what liabilities or penalties there may be if the goods or services are not properly trademarked under the rules for that country.<\/p>\n<\/li>\n<li><p>Research the history of how courts in that country have handled trademark disputes.<\/p>\n<\/li>\n<li><p>Research whether the country is a signatory to any treaty covering intellectual property.<\/p>\n<\/li>\n<\/ul>\n<blockquote><p><i><b>Example:<\/b> The <a target=\"_blank\" href=\"http:\/\/www.wipo.int\/treaties\/en\/ip\/tlt\/\" rel=\"noopener\">WIPO has a Trademark Law Treaty<\/a> adopted in 1994 contains detailed provisions on how trademarks must be registered, and renewed, in the participating countries. The <a target=\"_blank\" href=\"http:\/\/www.sice.oas.org\/trade\/nafta\/chap-171.asp\" rel=\"noopener\">North American Free Trade Agreement<\/a> (NAFTA) and the <a target=\"_blank\" href=\"https:\/\/www.wto.org\/english\/tratop_e\/trips_e\/intel2_e.htm\" rel=\"noopener\">World Trade Organization<\/a> (WTO) also both contain provisions dealing with intellectual property protection.<\/i><\/p>\n<\/blockquote>\n<ul>\n<li><p>Research whether you may be able to engage in <a href=\"https:\/\/www.findlaw.com\/adr.html\">alternative dispute resolution<\/a> (ADR) if a trademark issue should arise in a foreign country. ADR is often a quicker and more cost-effective way to resolve disputes than full-blown litigation.<\/p>\n<\/li>\n<\/ul>\n<h2>Examples of Foreign Trademark Laws<\/h2>\n<ul>\n<li>The <sup>TM<\/sup> and \u00ae symbols are generally recognized as acceptable forms of notice in the Asia\/Pacific regions and Europe. However, in South America, the \u00ae symbol is only acceptable in Paraguay and Ecuador. Other South American countries require other forms of notice. In still other countries, there may be no specific law on what notice is acceptable. In those situations, manufacturers are left to decide what sign to use.<\/li>\n<li>In some countries, you must provide more than just the <sup>TM<\/sup> and \u00ae symbols. For example, in Iran, pharmaceutical products, toiletry items, and foodstuffs must bear registration symbols or marks and must also include the registration number and registration date.<\/li>\n<\/ul>\n<ul>\n<li><p>Every country differs in how they deal with the failure to indicate that a mark is registered and the false indication that a trademark is registered when it is not. For example, in North America there is no sanction for failing to indicate that a trademark is registered.
