Slip and fall accidents\u00a0are among the most common causes of serious injuries each year. Although many happen inside businesses, they also happen outside. In winter, snow and ice lead to wet floors and sidewalks. In summer, increased traffic can result in hurried pedestrians tripping on obstructions.<\/p>\n

Small business owners<\/a>\u00a0are responsible for their properties’ interior and exterior. That duty of care extends to the parking lot and sidewalk. No matter what type of business you operate, you are responsible for accident prevention wherever a hazard may be on the property.<\/p>\n

The best way to avoid a slip-and-fall lawsuit is prevention. Address hazardous conditions that could lead to a\u00a0personal injury case<\/a>. Review your business insurance policy to know the common conditions in your area. Develop an action plan to deal with them before they happen.<\/p>\n

Who Manages Commercial Property for Safe Conditions?<\/h2>\n

The person (or people) with a duty to fix outdoor hazards can vary. As a business owner, you may be responsible for keeping the area outside your business reasonably safe.<\/p>\n

Start by getting a clear view of your duties and\u00a0business liability risks<\/a>.\u00a0\u00a0Check your commercial lease<\/a> or property agreements to understand the responsibilities for any shared spaces.<\/p>\n

Someone else, such as a facility or commercial property manager, might be in charge of certain outdoor needs. If so, keep their contact information easily accessible so you can report any problems.<\/p>\n

You may want to review your responsibilities with a business attorney<\/a>. Don’t assume someone else will handle the outer areas of the property. Lack of awareness doesn’t absolve negligence<\/a>, so it won’t protect you in a personal injury lawsuit<\/a>.<\/p>\n

Hiring Maintenance Services<\/h3>\n

Outsourcing maintenance to another company can help fix common causes of slip-and-fall accidents. Hiring assistance allows you to focus on running your business<\/a> rather than making repairs or clearing snow.\u00a0<\/p>\n

For example, suppose the parking lot has bad drains and is icy in the winter. A shop owner may not be able to repair the drains themselves. The owner can protect themselves by reminding customers and employees to watch for icy conditions.<\/p>\n

Keep Sidewalks Near Your Business Safe<\/h2>\n

Depending on state premises liability laws, you may need to clean up, hose off, or shovel snow on the sidewalks around your business. If your business facade intrudes on the sidewalk, you may be liable if anyone walks into it and injures themselves.<\/p>\n

You must remove any debris or trash that accumulates on the sidewalk, stairwells, and walkways around your business. For example, garbage cans or dumpsters outside your building must be clear of any sidewalks or walkways.<\/p>\n

If you have ramped walkways into your business for American Disabilities Act (ADA) compliance, they must have handrails of a specific height.\u00a0ADA guidelines state<\/a>\u00a0that the angle for walkway ramps is about 5% or a ratio of 1:12. These ramps must be structurally sound and covered with skid-proof material. Ramps should also be free of ice, snow, and debris.<\/p>\n

Check Facility Entrances and Exits<\/h2>\n

Entrances and exits are prime locations for slip-and-fall accidents. Customers will likely be carrying bags and not paying attention to their surroundings.<\/p>\n

Make sure entry and exit doors are clear and free of obstacles. For example, grocery store customers may leave carts and baskets too close to the doors. They may cause a tripping injury.\u00a0<\/p>\n

In hazardous weather conditions, you should place skid-proof mats or carpeting inside and outside. Keep the areas mopped. Place warning signs around wet or slippery areas if the floors are wet.<\/p>\n

It’s a good idea to have security cameras at entrances and exits for the purpose of loss prevention and recording slip and fall accidents. Some states may require notices advising customers that they are being recorded for security purposes when they enter the store. You should get legal advice before placing any security equipment.<\/p>\n

Be Prepared During Business Construction, Repair, and Renovation<\/h2>\n

If you’re carrying out any construction or repairs on your property, you’ll have less concern over customer slip and fall injuries. You must comply with the\u00a0Occupational Safety and Health Administration (OSHA)<\/a>\u00a0requirements. All states, except Texas, require employers to carry workers’ compensation insurance. OSHA has its own requirements for preventing employee slip and fall injuries at construction sites.<\/p>\n

If repairs or renovations are happening inside the building, keep walkways free of trip hazards like boards or barricades.\u00a0Sometimes, repairs cause uneven floors or involve hazardous materials such as paint. Consider closing off the entire section until repairs are complete.<\/p>\n

Plan for Ice, Snow, and Water<\/h2>\n

Slippery conditions are a major cause of broken bones and brain injuries. You can’t control the weather, but you must take a few steps to prevent these types of accidents.\u00a0<\/p>\n

You may not need to remove ice and snow all winter. Depending on your parking lot’s location, you or the property owner can have a professional snow removal company plow your lot and shovel the sidewalks. Snow seldom causes slip-and-fall injuries<\/a> \u2014 ice is the main culprit. Ice results from snow melt, freezing rain, or burst pipes.<\/p>\n

In winter or wet weather, place signs warning of dangerous conditions inside and outside your business. Be alert for slippery floors caused by water or slush tracked in from the street. Mopping up puddles immediately eliminates the common causes of slip-and-fall hazards during winter.<\/p>\n

Invest in Outdoor Lighting for Your Business<\/h2>\n

Outdoor lighting is a serious issue for\u00a0premises liability<\/a>. Poor lighting can be a cause of outdoor slip and fall injuries. Potential hazards, such as broken pavement and debris, are harder to see in the dark. Inadequate lighting can also be a security issue, leading to other liability claims.<\/p>\n

If you own the parking lot, you’re responsible for maintaining the lights.\u00a0If you\u2019re not the property owner, you can reduce your liability by altering the property manager to broken lights or dark corners.<\/p>\n

If you know of uneven surfaces or broken lights and cannot remedy them yourself, you can do your best to warn customers of the hazards. If you notify the property manager, document the date and time so there is a record of your attempt to remedy the condition.<\/p>\n
