Singer Rhianna Files Countersuit against Ex-Trainer

Grammy-winning singer Rihanna may have been working on her fitness, but this time she is getting a legal workout in a countersuit against her ex-trainer.

Rihanna has filed a countersuit against her ex-personal exercise trainer claiming she gave Cindy Percival money upfront for services she never provided, TMZ reported.

In general a breach of contract is one party's failure, without a legally valid excuse, to live up to any of his or her responsibilities under a contract. A breach can occur by:

  • the failure to perform as promised;
  • making it impossible for the other party to perform; and
  • the repudiation of the contract (announcing an intent not to perform).

Very often a dispute centers not on whether someone has violated a contract, but whether a contract existed in the first place. Other disputes center on whether a change in circumstances has made a contract unenforceable.

Cindy Percival sued the singer last year, claiming Rihanna owes her $26,144.14 in unpaid wages from 2009, as previously discussed.

In addition, the trainer claims she was hired for "exclusive personal training services" that cost $1,500 per day but was not paid for several weeks of work between September and October.

However, the countersuit filed in L.A. County Superior Court claims that the trainer ran off with at least $26,244.63 of Rihanna's funds.

As previously discussed, Rihanna has discussed her exercise regimen, confessing the need for a trainer to keep her motivated. In addition, she also watches her diet, eats lots of vegetables, snacks on fruit all day, and drinks plenty of water.
