Leaders from the House of Representatives have filed a petition for a writ of certiorari with the Supreme Court in a case challenging the Defense of Marriage Act (DOMA). The House leaders took the unusual step of mounting a legal defense of DOMA after the Justice Department announced that it would not defend DOMA against constitutional challenges. The current petition asks the Court to hear an appeal of a 1st Circuit decision that struck down DOMA as unconstitutional.
