Road Rage Shooting Claims 4-Year-Old's Life

By Christopher Coble, Esq. on October 23, 2015 12:23 PM

These days, road rage incidents have become more common and more publicized. Fortunately, most are harmless yelling back and forth. Unfortunately, not all end in anger and hurt feelings. Some road rage incidents turn fatal.

That was the case in Albuquerque, New Mexico, where a driver opened fire on a truck, killing a 4-year-old in the back seat.

Angry Words

Alan Garcia was driving his two children, 7-year-old Isaac and 4-year-old Lilly, home from school on Interstate 40 on Tuesday afternoon. He says he was exiting the highway to go to a grocery store when another driver cut him off. Garcia allegedly gestured toward the other driver and called him a "f------ idiot," and the two exchanged words.

After that, Garcia claims he heard two gunshots hit his truck, and two more as he tried to elude the other driver. Garcia saw that Lilly was shot in the head, pulled over on the highway, and tried to give her first aid in the bed of the truck. Attempts to give her aid were unsuccessful and she was pronounced dead at a local hospital.

Aftermath of the Shooting

Tony D. Torrez was arrested Wednesday after law enforcement authorities say he confessed to an acquaintance that "he shot the girl on Interstate 40." Torrez is charged with a laundry list of crimes:

Torrez is currently being held in jail on a $650,000 cash-only bond. Torrez doesn't yet have an attorney and was represented by a public defender at his bail hearing.
