Antidumping duty orders on ball bearingsSKF USA Inc. v. US, 10-1128, concerned a challenge to the decision of the Court of International Trade, affirming the final determination of the United States Department of Commerce in its seventeenth administrative review of antidumping duty orders on ball bearings and parts thereof from France, Germany, Italy, Japan, Singapore and the United Kingdom.
In affirming in part, the court held that the Trade Court's decision
that Commerce has the authority to use unaffiliated suppliers' actual
costs of production in calculating constructed value (CV) and to utilize
zeroing is affirmed. However, the court vacated in part and remanded
as, the Commerce in two respects did not provide a reasonable
explanation for its decision to depart from its methodology after
sixteen reviews.
