First there was a senior prostitution ring at a nursing home, now a nursing home is facing a lawsuit for a stripper show.
Bernice Youngblood, 85, a patient at East Neck Nursing and Rehabilitation Center in New York, and her family are suing her nursing home for urging her to participate and view a strip show against her will, according to the Associated Press.
The rehab center said the show was requested by the resident committee.
The lawsuit filed by the nursing home resident and her family is seeking civil damages against the rehab facility because Youngblood was apparently urged to participate in the strip show even though she didn't want to.
Youngblood's son claims that his mother has dementia. According to Reuters, Youngblood alleges that she felt terrible and was ashamed about what happened, but doesn't recall the details.
However, the nursing home also said that the residents of the facility requested the strip show and that the resident committee voted on it. The request was approved by the facility's management, who had the right to reject it if they deemed the strip show to be detrimental to the residents, Reuters reports.
Youngblood's son claims in the senior stripper lawsuit that the nursing home subjected his mother to "disgraceful sexual perversion," reports Reuters. While it's unclear what exact legal cause of action the Youngblood family is seeking, it's possible that they'll claim intentional infliction of emotional distress.
Intentional infliction of emotional distress involves extreme or outrageous conduct that intentionally or recklessly causes severe emotional distress. To prove emotional distress, the plaintiff can show the intensity of the mental anguish, any related bodily harm that result from the act, or simply get a doctor's note.
Youngblood claims that she was "shaken" from the booty-shaking stripper. She also claims that she was "confused and bewildered" when the stripper directed her to place her hands on his body, including his genital area, according to CNN.
The New York State Health Department is also investigating the incident.
