IRS Free Tax Filing Software Now Available in 12 States

This week marked the opening of the IRS's Direct File pilot program, offering individuals the opportunity to file their federal taxes directly through the IRS at no cost. The program is being made available to the public in 12 select states, with the registration period for full access having begun on March 4, 2024.

The Start of the IRS Initiative

The Inflation Reduction Act passed in 2022 required the IRS to explore the possibility and expense involved in creating a proprietary online tax filing service that would be free for public use. Following its report to Congress in May 2023, the agency initiated the development of specialized software that became known as the Direct File system. The system initially launched on January 29 for a select group of taxpayers, and on February 21, it was opened to additional users for testing before it was temporarily closed again. It reopened to the general public this month.

IRS Direct File operates similarly to well-known tax software like Turbo Tax or H&R Block, guiding taxpayers through a series of questions and using their responses to complete and electronically submit tax returns via the IRS website.

Who Is Eligible to Participate?

Eligibility for the Direct File program is restricted to residents of 12 states: Arizona, California, Florida, Massachusetts, New Hampshire, New York, Nevada, South Dakota, Tennessee, Texas, Washington, and Wyoming. Taxpayers using Direct File must not have income from other states. This service is designed for taxpayers with straightforward tax situations, namely those who opt for the standard deduction. The program supports deductions for student loan interest and educator expenses without requiring itemization. The software is limited to three tax credits; the Child Tax Credit, Earned Income Tax Credit, and Credit for Other Dependents. Taxpayers seeking credits for other expenses will need to use alternative filing methods.

Eligibility Criteria

To determine eligibility for Direct File, visit the program's website and use the "Check my eligibility" tool. The process involves a straightforward overview of the program's limitations and qualifications through seven steps. Following these steps, users can sign up for notifications about the program's availability.

The IRS has indicated that the Direct File pilot is in its final testing phase in 12 states. As of March 2024, new users can begin their tax returns, with daily limits on the number of new filings accepted. The goal is to accommodate all interested and eligible taxpayers.

Income restrictions apply to the Direct File program, with caps set based on filing status and income sources, including W-2 income, unemployment compensation, Social Security or railroad retirement benefits, and limited interest income. Independent contractors and those with other types of income are not eligible for this year's program.

A Closer Look

Direct File's interface resembles other tax preparation software, employing a user-friendly questionnaire format. Available in English and Spanish, the software facilitates online inquiries to a live assistant during specified hours.

In recent demonstrations, the IRS showcased Direct File's functionality, emphasizing its capacity to adapt to potential legislative changes affecting tax credits.

For taxpayers in certain states, Direct File will offer seamless integration with state tax filing systems, though some states may require manual data transfer. States without income tax will guide users to relevant tax credits following federal filing.
