Wyoming District Attorneys

A district attorney (D.A.) represents the prosecution — or the state. Each state has district attorneys for each of its districts or counties. Their titles and responsibilities can vary by state. In Wyoming, district attorneys represent their counties and are called county attorneys.

There are two sides to a criminal trial: the prosecution and the defense. The prosecution presents evidence to prove that the defendant is guilty of a crime beyond a reasonable doubt. The defense's job is to ensure that the prosecution meets its burden of proof and the defendant's civil rights are protected.

In a criminal proceeding, a public defender or a private criminal attorney represents the defendant.

Alternative to Trial: Plea Deals

Not all criminal charges go to trial. Many times, prosecutors offer plea deals. These often involve reduced charges or sentencing. Even if the district attorney offers a deal, they represent the state's interests. They are not looking out for yours. It's always a good idea to consult a criminal defense attorney. Do this before accepting a plea deal offered by the D.A.

Wyoming Attorney General

The state's governor appoints the Wyoming attorney general. The attorney general can only provide legal advice and opinions to state officials. They are not allowed to do so with private organizations or people. The attorney general has a variety of duties, including:

  • Prosecuting and defending all suits that involve the state
  • Defending suits brought against officers of the state (which involve the performance of their official duties), unless the claim is brought against them by Wyoming
  • Representing the state in actions in the state supreme court or any U.S. court where Wyoming has an interest in the outcome

District attorneys and the attorney general handle the prosecution of all crimes. Examples include:

  • Driving under the influence (DUI)
  • Domestic violence
  • Violations of protection orders
  • Sexual assault
  • Criminal child support arrears

Options for Getting Legal Help

There are many legal services available to people in Wyoming. Even if you can't afford an attorney, you still have options. You can contact the office of the public defender. Attorneys with the public defenders' office provide free or low-cost legal assistance to low-income people. Free legal representation from a public defender depends on a person's income.

Consider contacting one of the legal clinics at any law school in your area. Volunteer attorneys and law students can help people with legal problems at legal clinics. These attorneys can provide advocacy services for free, as well. For example, the University of Wyoming College of Law has a criminal law clinic.

You could also contact Equal Justice Wyoming. This nonprofit organization also provides free or low-cost legal services to criminal defendants. And Legal Aid of Wyoming does the same.

Referrals for Private Attorneys

If you need a referral for an attorney, contact the Wyoming State Bar Association. It can provide referrals for free.

If law enforcement has charged you with a crime, don't navigate criminal law and district courts on your own. Self-help, or representing yourself, is a bad idea. You can find help for your legal issues in many places, regardless of your ability to pay. With criminal cases, getting the legal assistance you need is crucial. A criminal defense lawyer is a must when dealing with criminal charges.
