'16 & Pregnant's' Weston Gosa Busted for DUI on Drugs
A young father from MTV's "16 & Pregnant" is behind bars. Weston Gosa was arrested for an alleged DUI on the Fourth of July, but he wasn't driving drunk, police say.
Gosa, 23, who appeared in Season 1 of "16 & Pregnant," crashed his car on a road not far from his home in rural Floyd County, Ga., the local Rome News-Tribune reports. Cops found the prescription drugs Xanax and Lorcet, along with a pipe with residue, in Gosa's wrecked vehicle, a police report states.
Gosa was allegedly driving under the influence of prescription drugs, for which he did not have a prescription, gossip website TMZ reports. So how does a drug-related DUI differ from an alcohol-related DUI?
The difference lies in how the DUI is determined. In general, alcohol-related DUIs require proof that a driver's blood-alcohol level was over 0.08%, typically by the use of alcohol breath tests. In Georgia, police generally must take two sequential breath tests for results to be admissible in court. Georgia law allows police to attempt to do this no more than two times.
For an alleged drug-related incident like Gosa's DUI arrest, a breath test won't work. Instead, Georgia law calls for a chemical test of a driver's blood, urine, or "other bodily substance." Only a doctor, nurse, lab technician, or other qualified person may conduct such a test.
Like all states, Georgia has an implied consent law. That means when a driver applies for a license, he also agrees to alcohol or chemical tests if he's ever pulled over for a suspected DUI. If a driver refuses to submit to testing, he could face an automatic license suspension, among other penalties.
In addition to "16 & Pregnant" star Weston Gosa's DUI charge, he was also charged with possession of controlled substances and drug-related objects. Whitney Purvis, the mother of Gosa's son Weston Jr., reportedly broke up with Gosa last fall, according to The Hollywood Gossip website.
