Shark Attack! Lawyer Allegedly Bit Nose Off Man, Gets Sued

By Tanya Roth, Esq. | Last updated on

They must serve very small portions at the popular Memphis eatery Dish; because clearly, litigation attorney Mark Lambert was still hungry during an evening bathroom brawl with self-employed hair dresser Greg Herbers. So hungry, that he bit Herbers' on the nose, allegedly removing quite a chunk of his victim's nostril.

In a suit filed last week, plaintiff Herbers is suing the Cochran firm attorney for the attack which began in the men's room of the restaurant last June. The fight started after Herbers inquired of two men in what must have been the only stall in the room, when it might become available for his use. Lambert, who appeared "to know the men in the stall" became belligerent, jumped the unsuspecting Herbers and pulled a Mike Tyson on him. According to the suit, the men in the stall screamed "What the (expletive) are you doing?" and with Lambert, then fled the scene. Herbers called police and was sent to a local hospital.

The police report states a major part of Herbers' left nostril was missing. In an even less appetizing detail, Herbers further claims that the shark-like Lambert swallowed the missing portion of his face. Lambert clearly resented the implication and told local news WMC-TV that he was acting in self defense. And of course he spit out the body part. Anything else would be just distasteful.

Reports differ on the amount of damages Herbers is seeking for medical bills, pain, suffering, loss of wages, disfigurement and damage to his sense of smell. However, the reported range of $5-$7.5 million will no doubt remind defendant Lambert there is no such thing as a free munch.
