Moral Turpitude Removal Affirmed

In Mendoza v. Holder, No. 06-72865, a petition for review of an order removing petitioner from the U.S., the court denied the petition where petitioner's offense of robbery under California Penal Code section 211 was a crime involving moral turpitude (CIMT) for the purposes of Immigration and Nationality Act (INA) section 212(a)(2)(A)(i)(I).

 

As the court wrote:  "Robbery under California Penal Code section 211 is a crime involving moral turpitude (CIMT) for the purposes of Immigration and Nationality Act (INA) § 212(a)(2)(A)(i)(I). Therefore, the robbery conviction of Luis Enrique Mendoza, a native and citizen of Mexico, renders him inadmissible and ineligible for adjustment of status. We must then deny the petition for review."
