Allard K. Lowenstein Int'l. Human Rights Project v. Dept. of Homeland Sec., No. 09-2225

By FindLaw Staff on November 22, 2010 | Last updated on March 21, 2019
FOIA Request to Department of Homeland Security

In Allard K. Lowenstein Int'l. Human Rights Project v. Dept. of Homeland Sec., No. 09-2225, an action seeking through the Freedom of Information Act (FOIA) to obtain internal government documents that plaintiff believed might reveal governmental misconduct in its terrorism investigations, the court affirmed partial summary judgment for defendants where the Department of Homeland Security properly withheld certain portions of a 2004 memorandum under Exemption (b)(7)(E) of the Freedom of Information Act.

As the court wrote:  "Plaintiffs-Appellants, the Allard K. Lowenstein International Human Rights Project and the Jerome N. Frank Legal Services Organization (collectively, "the Project"), appeal the district court's partial grant of summary judgment to Defendant-Appellee, the Department of Homeland Security ("DHS"). Having determined that the DHS properly withheld certain portions of a 2004 memorandum under Exemption (b)(7)(E) of the Freedom of
Information Act ("FOIA"), 5 U.S.C. § 552(b)(7)(E), the Court hereby affirms the decision of the district court."
