Hawaii Asbestos Regulations

Asbestos is a dangerous fiber used in many construction projects up until the 1980’s, when the potentially deadly effects of inhaling the fiber were better understood. Asbestos fibers can be found in many office buildings, government buildings, schools, churches, and factories. Certain kinds of cancers have been directed linked to unspecified levels of exposure. The most lethal illness linked to asbestos exposure is mesothelioma, a rare form of cancer which harms the lining of internal organs and is generally considered fatal.

Asbestos in Residential Buildings (Regulated Facilities)

A regulated facility is defined as “any institutional, commercial, public, industrial, or residential structure, installation, or building...excluding residences or residential cooperatives that have four or fewer total dwellings…”.

Regulated facilities must follow specific rules in relation to construction activity in the building including the following requirements:

  • A State certified asbestos inspector must be used to identify suspect asbestos-containing materials prior to the renovation/demolition activities which may disturb them;
  • A licensed and certified asbestos contractor must be used to properly remove, containerize, and dispose of the regulated asbestos-containing materials; and
  • Owners/operators must file proper notification documents with the State Department of Health.
