Accident and injury law encompasses medical malpractice, automobile accidents, slip and fall injuries, product liability, workers’ compensation, even dog bites. State courts handle these sorts of claims, each a little differently. Illinois courts, for example, allow plaintiffs in injury suits to collect damages even if they are partially at fault (less than 50 percent). Also, the state imposes a $500,000 cap on compensatory damages for medical malpractice claims and does not allow punitive damages for such claims.
