We all know that taxes must be paid at the end of each fiscal year, but what happens when those taxes aren't paid? Just like many other states, Oklahoma has penalties for tax fraud or evasion. This is a quick summary of tax fraud and tax evasion laws in Oklahoma.

What’s Prohibited? | Failing or refusing to file a report or return, filing a false report or return, filing a frivolous return, any action or inaction intended to defraud the state or evade taxes, writing a false or bogus check to pay taxes, or failing to testify, produce evidence, or allow examination of tax documents. |
Penalties | There are criminal penalties (felony or misdemeanor with jail time and/or fines) as well as civil penalties. Wages may be garnished and liens may be filed against real or personal property to satisfy unpaid taxes, interest, or penalties. Some examples of possible penalties for specific crimes: Failure or refusal to file a tax return or report is a misdemeanor punishable by up to 1 year in prison and up to $5,000 in fines. Refusing to file a tax return with the intent to defraud or filing a false or fraudulent tax return is a felony punishable by 2-5 years in prison and up to $1,000 - $50,000 in fines. Committing tax fraud is also subject to a 50% penalty (not including interest) on taxes due. Tax fraud consists of continued failure to file Oklahoma Income Tax Returns, filing false returns, or other action or inaction intended to defraud the state or evade taxes. Knowingly verifying any false report or return is a felony punishable by up 10 years (but no less than 90 days) in prison and up to $5,000 (but no less than $500) in fines. |
