Craigslist 'Free Pot' Ads Popping Up in Colorado

By Tanya Roth, Esq. | Last updated on

Just because marijuana is now legal under some states' laws, that doesn't mean it's any easier to get a hold of it. In Colorado, however, some Craiglist "free pot" ads have made it a little easier.

Colorado voters have twice legalized cannabis for different purposes. In 2000, voters passed Amendment 20 relating to the medical use of marijuana. This law allowed patients to possess up to two ounces of medicinal marijuana and to cultivate no more than six plants, three of which were allowed to be flowering at any given time.

The only way registered medical marijuana patients could get cannabis was through a registered dispensary.

Then, last year, voters approved Amendment 64. Under the amendment, adults 21 and over are allowed to possess 1 ounce of cannabis for recreational use.

Regulations about the sale of non-medicinal marijuana, however, is still up in the air. There aren't any hard and fast rules on this and as a result, the confusion has led to some creative ways for people to "sell" cannabis, The Huffington Post reports.

Of course, whenever people feel the need to creatively transfer items, they turn to none other than Craigslist.

Craigslist, the online classified portal, has been notorious for selling many things over the years. But now, Coloradans are turning to it for selling cannabis.

While it's not illegal to gift cannabis to another adult under Amendment 64, it is illegal to sell it, according to HuffPo.

So in Colorado, many people have been listing marijuana under Craigslist's "free" listings. They purport to "give away" the cannabis, but they expect a "donation" in return.

Interesting, but is it legal?

It's hard to say. The recreational marijuana may be legal under state laws in Colorado and Washington, neither states have yet passed the necessary regulations about recreational pot sales. The next step would be to draft proper legislation to make the state marijuana laws work.

Lawmakers in both states are working on that issue. Until they come up with some rules, there will likely be a lot more "free" Craigslist cannabis giveaways.
