Ninth Circuit to Telecast En Banc Hearings June 19-21

Much like meetings of the Knights of the Round Table or the Jedi Council, Ninth Circuit en banc hearings are a rare and special occurrence.

Approximately 20 Ninth Circuit Court of Appeals cases receive en banc hearings each year; the court will hear 6 of those cases from June 19-21 at the Richard H. Chambers U.S. Courthouse in Pasadena, California. But even if you can't make it to Pasadena, you may be able to catch a live telecast at a courthouse near you.

A live video and audio feed from the proceedings at the Pasadena courthouse will be simulcast at the following Ninth Circuit courthouses:

  • James R. Browning U.S. Courthouse, Courtroom 3
    95 7th St., San Francisco, California
  • U.S. Pioneer Courthouse, Pioneer Courtroom
    700 SW Sixth Avenue, Portland, Oregon
  • William K. Nakamura U.S. Courthouse, En Banc Courtroom, 8th Floor
    1010 Fifth Avenue, Seattle, Washington.

Here's the list of cases the court will be hearing.

Tuesday, June 19, 2012:

  • Cuellar De Osorio v. Mayorkas and Costelo v. Napolitano. Arguments in these consolidated appeals, alleging that the U.S. Citizenship and Immigration Services wrongfully refused to accord the appropriate priority dates to immigrant visa petitions filed on behalf of adult children contrary to the Child Status Protection Act (CSPA), will begin at 10:00 a.m.
  • United States v. Cotterman. The Ninth Circuit will consider whether a forensic analyst's search of the laptop -- lawfully-seized at a U.S. border -- was an "extended border search" that required reasonable suspicion since it occurred 48 hours after the border stop at a field office away from the border. Arguments will begin at 2:00 p.m.

Wednesday, June 20, 2012:

  • Garfias-Rodriguez v. Holder. A Board of Immigration Appeals challenge to determine whether an immigration judge erred when finding Francisco Javier Garfias-Rodriguez removable and denying his application for adjustment of status. Arguments will begin at 10:00 a.m.
  • Carrera v. Ayers. Constantino Carrera, a California state prisoner, appeals the district court's pre-AEDPA denial of his habeas corpus petition challenging his jury conviction for robbery and robbery felony murder. Arguments will begin at 3:00 p.m.

Thursday, June 21, 2012:

  • United States v. Yepez. David Yepez appeals the sentence imposed following his guilty plea to importation of methamphetamine. Arguments will begin at 12:00 p.m.
  • United States v. Montes. In a second meth case, the federal government appeals the sentence imposed on Audenago Acosta Montes following his guilty plea to possession of methamphetamine with intent to distribute and importation of methamphetamine. Arguments will begin at 12:00 p.m.

Public access to the remote viewing locations will be on a first-come-first-served basis. Photographs or recordings/transmissions are prohibited. Proper decorum is expected, so be on your best behavior.
