Plaintiff's suit against former employer for racial discrimination
Montgomery v. Am. Airlines, Inc., 08-3951, concerned a challenge to the district court's grant of an employer's motion for summary judgment, in plaintiff's suit against his employer, American Airlines, claiming two civil rights violations relating to his race.
In affirming the judgment, the court held that plaintiff failed to present any evidence that would allow a reasonable jury to impute liability to the employer even if plaintiff had proven that his working environment was hostile. The court also held that plaintiff failed to establish a prima facie case of of racial discrimination, and even if he had, he did not establish a triable issue of fact as to whether the employer's reasons for demoting him were merely pretextual.
