Seventh Circuit Rides Circuit to Notre Dame Oct. 1
The Seventh Circuit Court of Appeals is heading back to law school.
Appellate judges occasionally like to descend from their lofty lairs to mingle with commoners and law students. In that spirit, a three-judge panel will hear oral arguments at Notre Dame Law School on October 1. The appellate court will consider three cases in this special session:
- Kendale Adams, et al. v. Gregory Ballard, et al., an appeal of a Title VII judgment against African American police officers and firefighters who allege that the promotion processes for public safety personnel in Indianapolis and Marion County are racially discriminatory.
- United States of America v. Christopher Laraneta, an appeal of a restitution and incarceration sentence imposed following the defendant's guilty plea on multiple child pornography charges.
- Emilio Martino v. Western & Southern Financial Group, a summary judgment appeal in a Title VII religious discrimination case. The plaintiff, a part-time Baptist pastor, claimed a financial services company improperly terminated his employment because he refused to relinquish his position as pastor.
Oral arguments will be held in the Patrick F. McCartan Courtroom, Eck Hall of Law, from 1 p.m. to 3 p.m. A live, closed-circuit feed will also be broadcast in Room 1130, Eck Hall of Law. Presiding judges and case attorneys will be available after arguments for Q&A with law students.
We doubt that Notre Dame Law School has overlooked the fact that October 1 is not only a Seventh Circuit oral argument day on campus, but First Monday as well. Is this the law school's way of declaring its allegiance to Team Posner in the Justice Scalia/Judge Posner tiff?
